About approval of the Regulations on Public administration of rail transport of Ukraine

Cabinet of Ministers of Ukraine decides:

1. Approve Regulations on Public administration of rail transport of Ukraine which are applied.

2. Declare invalid Item 1 of the resolution of the Cabinet of Ministers of Ukraine of July 30, 1993 No. 586 "About approval of the Regulations on Public administration of rail transport of Ukraine" (the joint venture of Ukraine, 1993, No. 12, the Art. 265).

Regulations on Public administration of rail transport of Ukraine

1. The public administration of rail transport (Ukrzheldortrans) is governing body of railway transport public, the subordinated Ministry of Infrastructure.

The Donetsk, Lviv, Odessa, Southern, Southwest and Dnieper railroads, and also other associations, the companies, organizations and the organizations of rail transport (further - the companies) according to the list determined by the Ministry of Infrastructure fall within the scope of management of Ukrzheldortrans.

Ukrzheldor exercises centralized process control of transportations in the internal and international message and regulates production economic activity of the railroads in the sphere of the organization of this process.

2. Ukrzheldortrans in the activities is guided by the Constitution and the laws of Ukraine, and also the presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, orders of the Ministry of Infrastructure and this Provision.

3. The main tasks of Ukrzheldor are:

1) the organization of harmonious work of the railroads and the companies for the purpose of requirements satisfaction of social production and the population in transportations;

2) ensuring effective operation of railway rolling stock, its repair and updating;

3) development of concepts of development of rail transport;

4) taking measures for safety of functioning of rail transport, its infrastructure and reliability of its work.

4. Ukrzaliznytsya according to the tasks assigned to it:

1) performs the functions connected with operational activities relatively:

the direction of railway vehicles according to plans of transportations;

developments of the approved train schedule and the plan of their forming;

forming and realization of single tariff and price policy on rail transport;

opening of the single account and the organization of carrying out calculations for transportation of goods and passengers by the railroads and uses of railway vehicles, and also distribution between the railroads of the means (in particular, currency receipts) received from transportations in through traffic (taking into account specific participation of each railroad in these transportations);

developments and introductions of new routes of freight and passenger traffic in internal and international railway service;

the organizations of carrying out calculations with the railroads of foreign states for international carriages;

developments of technical requirements to new types of railway vehicles and the equipment of rail transport, forming of orders for the industry and the organization of control over their production;

acquisitions of railway vehicles and containers, ensuring their capital repairs and upgrade at the companies located both in the territory of Ukraine and beyond its limits;

2) helps:

to ensuring needs of rail transport for the material, fuel and energy, attracted financial resources and services which are connected with implementation of borrowings, in particular legal and that which provide the international rating agencies;

to market grouping of transport and forwarding services, formation of new organizational structures of all patterns of ownership on rail transport;

to provision of the state support of development of rail transport for the purpose of ensuring its settled work;

3) performs functions on property management which is nation-wide property and it is assigned to the companies, in part:

approvals of charters (provisions) of the companies, control of observance and decision making in connection with violation of their requirements;

the conclusion and contract cancelation with heads of the companies (except chiefs of the railroads);

control over efficiency of use and safety of the state-owned property assigned to the companies;

preparation together with local executive bodies and local government bodies of offers of the Ministry of Infrastructure concerning differentiation of state-owned property between nation-wide, republican (Autonomous Republic of Crimea) and municipal property;

participations in preparation of international treaties of Ukraine concerning nation-wide property;

Develops 4) and approves in accordance with the established procedure conditions of transportations of export, inward and transit cargoes;

5) develops plans of transportation of goods by railway transport in the direct, mixed and international message, represents the interests of the railroads during coordination of these plans in relevant organs;

6) enables the realization of single investment policy, coordinates development planning of the railroads and the companies, determines single policy of implementation of borrowings by the railroads and the companies, coordinates activities of the railroads and the companies in the sphere of borrowings, directly participates in its realization, including in the international markets of the capital, involves legal advisers, banks, other financial institutions, financial consultants, carries out work with the international rating agencies and attracts other persons whose services are necessary for implementation of borrowings;

7) provides development of repair base of rail transport, development and deployment in practice of modern means of automatic equipment, telemechanics, communication, power, computer facilities;

8) takes measures for train service safety, investigates the reasons of accidents, develops traffic safety regulations according to requirements of international standards and the legislation of Ukraine;

9) will organize work on preparation, retraining and advanced training of personnel;

10) represents the interests of rail transport of Ukraine in the international organizations and the unions of railroad workers;
