1. Approve Regulations on approval procedure on distribution of products of foreign mass media it (is applied).

2. This resolution becomes effective since February 8, 2009.

Regulations on approval procedure on distribution of products of foreign mass media

1. This Provision determines procedure for issue by the Ministry of information of permission to distribution of products of foreign mass media in the territory of the Republic of Belarus without change of its form or content (further – permission).

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus of July 19, 2005 No. 45-Z "About telecommunication", the Law of the Republic of Belarus "About mass media are applied".

3. For receipt of permission to distribution of foreign printing mass media founder (founders), the publisher of foreign printing mass media, the legal entity of the Republic of Belarus, the individual entrepreneur registered in the Republic of Belarus, other authorized person provide in the Ministry information the statement for issue of permission to distribution of foreign printing mass media with indication of its name, type, specialization (subject), and also data provided in Item 5 of article 14 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures".

For receipt of permission to distribution of foreign TV or radio program the operator of telecommunication, the service provider of telecommunication provides in the Ministry information the statement for issue of permission to distribution of foreign TV or radio program with indication of its name, type, specialization (subject), and also data provided in Item 5 of article 14 of the Law of the Republic of Belarus "About bases of ministerial procedures".

The following documents are enclosed to the application:

the copy of the registration certificate of the foreign mass media or other document confirming competence of its release;

copies of the agreements confirming availability at the applicant of the appropriate rights to distribution of foreign mass media in the territory of the Republic of Belarus;

three last issues, the magazine, the bulletin, other edition which issue precedes date of filing of application on issue of permission to distribution of products of foreign mass media in the territory of the Republic of Belarus (for printing mass media);

one copy of daily video of the program (for video, TV, film chronicle programs);

the developed concept of broadcasting of TV or radio program (for television and broadcasting mass media).

4. Issue of permission is performed after carrying out in the Ministry of information of examination of such products regarding compliance to requirements of the legislation of the Republic of Belarus.

Effective period of permission to distribution of foreign printing mass media – it is termless, foreign TV or radio program – three years.

4-1. The ministry of information creates and keeps the list of the foreign mass media which got permission (further – the list).

The list is posted in open access on the official site of the Ministry of information.

Availability of foreign mass media in the list exempts the other persons authorized on distribution of these foreign mass media from receipt of the corresponding permission.

In 15 working days before expiration of permission to distribution of products of foreign mass media of person authorized on its distribution 3 this provision provided in Item part three shall file in the Ministry of information petition for issue of permission to distribution of these foreign mass media with application of documents.

5. In case of the cancellation of the registration certificate of foreign mass media or other documents confirming competence of its release, expiration of the contract or other document confirming availability of the appropriate rights to distribution of products of foreign mass media, change of the creative concept of broadcasting of foreign TV or radio program person who got permission shall notify in writing no later than five days on it the Ministry of information.

6. Permission is terminated in cases:

expirations of its action;

cancellations of the registration certificate of the foreign mass media or other document confirming competence of its release;

acceptances by the Ministry of information of the decision on cancellation of permission in the cases provided by legal acts.

7. Distribution of products of foreign mass media (sale, subscription, delivery, other form of bringing mass information to general data) after receipt of permission is performed according to the procedure, established by the legislation for the corresponding type of activity.
