3. To department of declaring and customs regimes (Naumenko V. P.) and Legal department (Babyuk V. L.) provide submission of this order on state registration in the Ministry of Justice of Ukraine.

4. Determine that this order becomes effective in 30 days after its official publication.

5. To impose control over the implementation of this order on the vice-chairman of State Customs Service of Ukraine Fedorov O. O.

The instruction about order of interaction of officials of customs authorities and responsible persons of structural divisions of gas-transport system when implementing customs control of the natural gas moved through customs border of Ukraine with pipeline transport

1. General provisions

1.1. This Instruction establishes order of interaction of officials of customs authorities and responsible persons of structural divisions of gas-transport system when implementing customs control of the natural gas moved through customs border of Ukraine with pipeline transport including for storage in underground gas storages.

1.2. The terms used in this Instruction:

active amount of natural gas - amount of natural gas which periodically downloads in underground gas storage and is selected from it;

documentation of places of customs control of gas: for gas-measuring stations (further - GIS), Items of measurement of expenses of gas (further - PIRG), gas distribution stations (further - GRS) and underground gas storages (further - UGS) - delivery-acceptance certificates of gas, certificates (passports) of quality of gas; for UGS - reports on gas flow in UGS, and also others the stipulated by the legislation documents of Ukraine constituted in places of customs control of gas;

means of the measuring equipment (further - SIT) - the technical means used to measurement of high-quality quantitative indices of natural gas;

sliding armature - cranes, latches in places of customs control of natural gas which are used for regulation of the directions of movement of natural gas and its amounts;

1.4. Customs control over amounts of natural gas is exercised in the customs control zones created in MTKG.

Responsibility for implementation of such control is conferred on customs authorities in which zone of activities the corresponding MTKG are located.

Copies of orders of customs authorities on creation of customs control zones and about introduction of amendments to these orders go to Energy regional customs to two weeks after their signing.

1.5. Coordination of actions of customs authorities for implementation of customs control of natural gas is performed by Energy regional customs.

1.6. Responsible persons of JV GTS for implementation by authorized officers of customs authorities of the actual control:

provide access for these officials to the territory and to rooms of MTKG, to SIT, sliding armature, other equipment and documentation of MTKG;

provide to officials of customs authorities delivery-acceptance certificates of natural gas in the terms determined by Procedure for customs control and customs clearance of the natural gas moved through customs border of Ukraine with the pipeline transport approved by the resolution of the Cabinet of Ministers of Ukraine of 17.12.2003 N 1958 (with changes), and sheets based on which delivery-acceptance certificates of gas are drawn up, certificates (passports) of quality of gas, and also reports on gas flow in UGS (the report form is given in appendix 1 to this Instruction) and registers of amounts of the natural gas which is stored in UGS (the form of the register is given in appendix 2 to this Instruction);

draw up together with officials of customs authorities statements of imposing of seals of customs authority on SIT and sliding armature (the form of the act is given in appendix 3 to the Instruction), acts of removal of seals of customs authority (the form of the act is given in appendix 4 to this Instruction);

instruct by rules of stay in the territory of objects of gas-transport system of officials of the customs authorities authorized on implementation of customs control in MTKG about what record in the relevant magazine which makes sure the signature of the instructed person is made.

1.7. The actual control of natural gas is exercised taking into account the period of delivery determined by Procedure for customs control and customs clearance of the natural gas moved through customs border of Ukraine with the pipeline transport approved by the resolution of the Cabinet of Ministers of Ukraine of 17.12.2003 N 1958 (with changes).

1.8. The actual control of natural gas is exercised by officials of customs authority in the presence of responsible persons of JV GTS.

When implementing the actual control of natural gas in the territory of objects of gas-transport system officials of customs authorities shall follow rules of stay on these objects.

2. Imposing and removal of customs providing

2.1. The customs authority approves places of imposing of seals of customs authority on SIT and sliding armature with management of JV GTS.

2.2. The quantity of the seals of customs authority imposed on SIT and sliding armature is determined by management of customs authority separately for each MTKG depending on its technical features.
