About approval of the Regulations on the organization of the personified accounting of data in system of general national pension insurance

In pursuance of the Presidential decree of Ukraine of May 4, 1998 N 401 "About actions for implementation of the personified accounting of data in system of compulsory national pension insurance" the Cabinet of Ministers of Ukraine DECIDES:

1. Approve Regulations on the organization of the personified accounting of data in system of general national pension insurance it (is applied).

2. To provide to the pension fund together with the Ministry of Labour and Social Policy, the Ministry of Finance and State Tax Administration since October 1, 1998 implementation of the personified accounting of data in system of general national pension insurance.

3. Determine that since July 1, 2002 calculation of pensions according to the Law of Ukraine "About provision of pensions" is performed from earnings of person for the period of work after July 1, 2000 according to system of the personified accounting.

Regulations on the organization of the personified accounting of data in system of general national pension insurance

1. The personified accounting consists in collecting, processing, systematization and preserving the information about physical persons, stipulated by the legislation about provision of pensions, which are connected with determination of the right to payments from the Pension fund and their size on general national pension insurance (further - the information about physical persons).

2. The main objectives of the personified accounting:

creation of the single national automated bank of information about physical persons;

assistance of development of interest of physical persons in introduction of payments on general national pension insurance (daleepensionny insurance) and creation of conditions for their control of payment of these payments;

assistance to creation of conditions for more complete payment receipt on pension insurance;

creation of information prerequisites for determination of the amount of payments for pension insurance depending on duration of insurance years of service and personal fee of physical person in forming of means of this insurance;

providing according to the legislation of protection of information about physical persons;

information support of tasks of forecasting and planning in system of pension insurance.

3. At the head of the angle of the personified accounting obligation of use of individual identification number of data of the State register of physical persons - taxpayers and other obligatory payments lies.

4. The personified accounting is performed according to Bases of the legislation of Ukraine on general national social insurance, the legislation on compulsory national pension insurance, this Provision.

5. The personified accounting performs the Pension fund and its bodies on places (further - authorized body).

6. The authorized body with observance of requirements of article 23 of the Law of Ukraine "About information" has the right:

to receive timely in accordance with the established procedure from physical persons and employers of the data, stipulated in Item 1 this Provision;

perform at employers of reliability of the provided information about physical persons, in particular verification of financial and other records which confirm the specified data;

in accordance with the established procedure to make responsible persons guilty of violation of terms of submission of data, and also submission of inveracious information about physical persons;

issue regulations in limits of the competence and perform explanations concerning the organization of the personified accounting, and also other rights which follow from tasks of the personified accounting.

7. Authorized body:

creates and provides functioning of the single national automated bank of information about physical persons and for this purpose collecting, processing, systematization and preserving information about physical persons organizes;

provides the automated use of information about physical persons for determination of the right to payments on pension insurance and the amount of these payments;

supplies to physical persons with the information about them that contain in system of the personified accounting, and in case of their change, untimely receipt of insurance fee (fees), viewing of the size of paid pension, its indexation, change of conditions of provision of social services or viewing the question of opportunities of their provision - informs in writing at the scheduled time insured person;

gives to employers the help in the organization of preparation of information about physical persons.

8. The authorized body performs functions concerning the organization of the personified accounting in close interaction with central and local executive bodies, local government bodies, State Tax Administration, financial bodies, bank institutions.

9. Employers have the right to supplement and specify the information about the physical person provided to authorized body according to the legislation.

10. Employers shall:

in accordance with the established procedure to submit to authorized body the authentic information about physical persons which works for them;

provide upon the demand of physical person of the copy of documents with the information about him concerning the personified accounting.

11. The physical person has the right:

study the information about him entered into the system of the personified accounting;

in case of disagreement with the data entered into the system of the personified accounting to file in authorized body petition for their correction;

demand from employers of complete and timely idea to authorized body of data concerning the personified accounting.

12. Physical person for obtaining in the future payments from the Pension fund:

informs during acceptance him for work the identification number from the State register of physical persons - taxpayers and other obligatory payments and the data which are entered into the system of the personified accounting;

informs authorized body and the employer on changes in information about him concerning the personified accounting;

submits to authorized body or the employer documents which confirm the information about themselves that they shall be entered into the system of the personified accounting.

13. For forming of information base of system of the personified accounting the arriving data in accordance with the established procedure are used from:

information fund of the State register of physical litsplatelshchik of taxes and other obligatory payments;

State Tax Administration;

employers;

physical persons;

state bodies of registration of acts of civil condition of citizens who died;

public service of employment;

other companies, organizations and organizations.

14. Sheets about physical persons gather and remain in documentary and electronic form authorized body in accordance with the established procedure throughout life of physical person and remain also within 75 years after his death.
