Article 1. The main characteristics of the budget of the Pension Fund of the Russian Federation for 2009

1. Approve the main characteristics of the budget of the Pension Fund of the Russian Federation (further - Fund) for 2009:

1) the predicted total amount of budget receipts of Fund in the amount 3 282 951 083, 1 thousand rubles, from them 2 994 149 643, 3 thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions including at the expense of the interbudget transfers received from the federal budget in the amount 2 053 995 672, of 3 thousand rubles and budgets of subjects of the Russian Federation in the amount 2 925 427, of 0 thousand rubles;

2) the total amount of expenses of the budget of Fund in the amount 3 041 483 420, 5 thousand rubles, from them 2 998 653 912, 2 thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions, including the interbudget transfers transferred to budgets of subjects of the Russian Federation in the amount of 73rd 929, of 2 thousand rubles;

Limiting 3) amount of budget surplus of Fund in the amount 241 467 662, 6 thousand rubles and limiting amount of budget deficit of Fund in the part which is not connected with forming of means for financing of funded portion of work pensions in the amount 4 504 268, 9 thousand rubles.

Determine that in 2009 source of financing of budget deficit of Fund in the part which is not connected with forming of means for financing of funded portion of work pensions is change of remaining balance of means on accounts on accounting of budget funds of Fund during 2008 as of January 1, 2009 in the part which is not connected with forming of means for financing of funded portion of work pensions.

Article 2. Chief managers of budget receipts of Fund and chief managers of sources of financing of budget deficit of Fund

1. Approve the list of chief managers of budget receipts of Fund according to appendix 1 to this Federal Law.

2. Approve the list of chief managers of sources of financing of budget deficit of Fund according to appendix 2 to this Federal Law.

Article 3. Sources of internal financing of budget deficit of Fund

Approve sources of internal financing of budget deficit of Fund for 2009 according to appendix 3 to this Federal Law.

Article 4. Budgetary appropriations of the budget of Fund for 2009

1. Approve distribution of budgetary appropriations of the budget of Fund for 2009 for Sections and subsections, target articles and expense types of classification of expenses of the budget according to appendix 4 to this Federal Law.

2. Approve the total amount of the budgetary appropriations directed by Fund to execution of public normative obligations, for 2009 in the amount 2 930 755 466, of 3 thousand rubles.

Article 5. The interbudget transfers to the budget of Fund and from the budget of Fund to other budgets of the budget system of the Russian Federation

1. Approve distribution of the budgetary appropriations provided at the expense of the interbudget transfers from the federal budget and budgets of subjects of the Russian Federation for 2009 according to appendix 5 to this Federal Law.

2. Approve distribution of the interbudget transfers from the budget of Fund to other budgets of the budget system of the Russian Federation for 2009 according to appendix 6 to this Federal Law.

4. Determine that in 2009 financial provision of expenses on realization of item 4 of the Resolution of the Supreme Council of the Russian Federation of January 15, 1993 N 4302-1 "About procedure for enforcement of the Law of the Russian Federation "About the status of Heroes of the Soviet Union, Geroyev of the Russian Federation and complete order bearers of Slava" is performed within the interbudget transfers from the budget of Fund to other budgets of the budget system of the Russian Federation provided by appendix 6 to this Federal Law on measures of social support of Heroes of the Soviet Union, Heroes of the Russian Federation and complete order bearers of Slava.

6. The other non-paid receipts considered in volume of the interbudget transfers from the federal budget in 2009 in Fund from the federal budget in the amount 5 701 444, of 8 thousand rubles go for expense recovery on the tax discharge on profit of the organizations, added concerning the profit got as a result of temporary placement of the amounts of insurance premiums for funded portion of work pension and from placement of temporarily available funds of the budget of Fund, other taxes and penalties according to Item 1 of Article 122 and with article 123 of the Tax Code of the Russian Federation.

7. Permit Fund to perform in 2009 within the budgetary appropriations provided by appendix 4 to this Federal Law on the subsection "Other Interbudget Transfers" of the Section "Interbudget Transfers" of classification of expenses of the budget, provision of subsidies to budgets of subjects of the Russian Federation on the social programs of subjects of the Russian Federation connected with strengthening of material and technical resources of organizations of social servicing of the population and rendering the address public assistance to the unemployed pensioners who are receivers of work old-age pensions and on disability in 2009 in the amount up to 1 200 000, of 0 thousand rubles.

8. Determine that financial provision of the actions specified in part 7 of this Article is performed according to the procedure, established by the Government of the Russian Federation, due to receipt of the amounts of shortage on fees in Fund formed for January 1, 2001, the amounts of penalty fee and other financial sanctions on the specified fees, the amounts of penalty fee and other financial sanctions on insurance premiums for insurance part of work pension, and also cash penalties (penalties) for violation of the law of the Russian Federation about state non-budgetary funds and about specific types of compulsory social insurance, the budget legislation of the Russian Federation (regarding the budget of Fund).

9. Determine that financial provision of payment commitments on implementation of measures for social security of the population and other measures of social protection is performed by Fund in 2009 at the expense of the interbudget transfers from the federal budget provided on the specified purposes with entering of corresponding changes into summary budget list of the budget of Fund.

10. Determine that compensation of the losses which arose in case of investment by Fund of the amounts of the insurance premiums for financing of funded portion of work pension which arrived in Fund for 2007, considered in special part of individual personal accounts of the insured faces and subjects to transfer to trust management to managing companies and to non-state pension funds, and also expense recovery tied with ensuring maintaining special part of individual personal accounts of the insured persons who voluntarily entered legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded portion of work pension is performed by Fund in 2009 at the expense of the interbudget transfers from the federal budget provided on the specified purposes.

Article 6. Features of use of budgetary appropriations on ensuring activities of Fund

1. Determine that for the purpose of implementation of the Federal Law of July 24, 2002 N 111-FZ "About investment of means for financing of funded portion of work pension in the Russian Federation" and the Federal Law of April 30, 2008 N 56-FZ "About additional insurance premiums for funded portion of work pension and the state support of forming of pension accruals" in 2009.

1) the expenses connected with maintaining special part of individual personal accounts of insured persons join processing costs of statements of insured persons for the choice of investment portfolio (managing company), transition from Fund in the non-state pension fund performing mandatory pension insurance, transition from one non-state pension fund to other non-state pension fund performing mandatory pension insurance and transition from non-state pension fund to Fund;

2) the expenses connected with maintaining special part of individual personal accounts of the insured persons who voluntarily entered legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded portion of work pension join processing costs of statements of insured persons for the voluntary introduction in legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded portion of work pension and processing costs of copies of the payment documents confirming payment of additional insurance premiums for funded portion of work pension;

The cost of processing of one statement of insured person and one copy of the payment document constitutes 3) on 4 rubles excluding tax on value added.

2. The amounts of means which came to the budget of Fund on payment of insurance part of work pension on which insurers as of January 1, 2009 do not provide data of the individual (personified) accounting for reflection in general part of individual personal accounts of insured persons are aimed by Fund at financial provision of payment of insurance part of work pension.

3. Determine that as a part of balance of the pension accruals which are not delivered in trust management to managing companies as of January 1, 2009 the insurance premiums for financing of funded portion of work pension which came to the budget of Fund and are not considered in special part of individual personal accounts of insured persons in connection with non-presentation of data by insurers of the individual (personified) accounting are considered.

4. Fund in the procedure established by it having the right in 2009 within the budgetary appropriations provided by appendix 4 to this Federal Law according to the target expenditure item "Offices of Governing Bodies of State Non-budgetary Funds" of the subsection "Provision of pensions" of the Section "Social policy" of classification of expenses of the budget to perform:

1) financial provision of fee to the organizations for acceptance and creation of electronic petitions from citizens about refusal of receipt of set of social services (social service) or about renewal of its provision, proceeding from the cost of processing of one statement in the amount of 4 rubles excluding tax on value added;

2) direction of funds for rendering medical services to employees of Fund and its territorial authorities;

3) the direction of means in the amount to 100 million rubles on provision to employees of Fund and its territorial authorities of one-time subsidy for acquisition of living space.

Article 7. Features of use of budgetary appropriations of the budget of Fund in the sphere of social policy

1. The fund has the right to perform:

1) financial provision of pension payment, benefits, monthly money payments to separate categories of the citizens and other social payments referred by the legislation of the Russian Federation to competence of Fund for festive and the days off of January, 2010 in December, 2009 within the budgetary appropriations approved by part 1 of article 1 of this Federal Law. Financial provision of payment of work pensions for festive and the days off of January, 2010 in December, 2009 regarding the obligations of Fund arising since January 1, 2010 is performed at the expense of the interbudget transfers from the federal budget provided by appendix 5 to this Federal Law, with modification of summary budget list of the budget of Fund for 2009 by funds redistribution, provided on payment of basic part of work pension, on covering of budget deficit of Fund, with reflection in the performance report of the budget of Fund for 2009 of the specified expenses according to the target expenditure item "Payment of Insurance Part of Work Pension" of the subsection "Provision of pensions" of the Section "Social policy" of classification of expenses of the budget;

2) compensation made in 2009 by budget funds of Fund of the costs connected with payment of insurance part of work pensions in connection with offsetting in insurance years of service of not insurance periods including expenses on delivery, according to the Federal Law of March 21, 2005 N 18-FZ "About the funds of the federal budget allocated to the Pension Fund of the Russian Federation for expense recovery on payment of insurance part of work pensions to separate categories of citizens" at the expense of the interbudget transfers received from the federal budget on pension payment on the state provision of pensions;

3) financial provision of obligations assumed in 2009 for the purpose of implementation of the Federal Law of July 22, 2008 N 156-FZ "About modification of separate legal acts of the Russian Federation concerning provision of pensions", and also expenses of Fund on social benefits for burial and rendering the services connected with increase in the size of the specified benefits including expenses on delivery of pensions and benefits, at the expense of the interbudget transfers received from the federal budget on pension payment on the state provision of pensions;

4) financial provision of delivery of pensions, benefits, monthly money payments to separate categories of citizens and other social payments in limits of 1,35 of percent of the delivered amounts excluding tax on value added;

5) financial provision of payment for claims of citizens based on the decisions of the courts which took legal effect at the expense of sources from which are provided the corresponding pension (part of pension), monthly money payments to separate categories of citizens, other social payments and compensation for expenses on payment of fare to the pensioners living in the region of the Far North and areas equated to them and being receivers of work old-age pensions and on disability, to the vacation spot in the territory of the Russian Federation and back, carried by the legislation of the Russian Federation to competence of Fund;

7) financial provision of pension payment, the appointed ahead of schedule, to the citizens recognized as the unemployed and social benefits for burial of the died not working pensioners who ahead of schedule drew up pension according to the offer of bodies of employment service of the population of subjects of the Russian Federation (if the death of the pensioner came during receipt of early pension before achievement by it of the age granting the right to the corresponding pension), and rendering services in burial according to the guaranteed list of these services, including expenses on delivery of the specified pensions and benefits, with subsequent compensation for the account of the interbudget transfers received from budgets of subjects of the Russian Federation through bodies of employment service of the population of subjects of the Russian Federation.

2. The fund has the right to establish for 2009 the size of the standard rate of turnover money differentially, considering need of early implementation of financial provision of pension payment, benefits, monthly money payments to separate categories of citizens and other social payments in separate months of financial year, but at least 25 percent of amount of expenses on the specified payments forthcoming month.

Article 8. Features of budget implementation of Fund in 2009

1. The remaining balance of means of the federal budget as of January 1, 2009 formed in the budget of Fund as a result of incomplete use in 2008 of the interbudget transfers on pension payments, monthly money payments to separate categories of citizens and other social payments and also on compensation for expenses on payment of fare to the pensioners living in the region of the Far North and areas equated to them and being receivers of work old-age pensions and on disability to the vacation spot in the territory of the Russian Federation and back, goes Fund in 2009 to the same purposes with the corresponding modification of indicators of summary budget list of the budget of Fund.

2. Establish the following bases of increase in budgetary appropriations with the corresponding modification of indicators of summary budget list of the budget of Fund according to Item 6 of Article 184.1 of the Budget code of the Russian Federation:

1) use of budget funds of Fund on implementation of the Federal Law of May 7, 1998 N 75-FZ "About non-state pension funds", the Federal Law of July 24, 2002 N 111-FZ "About investment of means for financing of funded portion of work pension in the Russian Federation" and the Federal Law of April 30, 2008 N 56-FZ "About additional insurance premiums for funded portion of work pension and the state support of forming of pension accruals" if the amounts of the means which arrived in Fund on payments to legal successors of the died insured persons and means of the pension accruals considered in special part of the individual personal accounts which are subject to transfer to non-state pension funds will exceed annual amounts of the budgetary appropriations approved by summary budget list of the budget of Fund;
