The agreement between the Government of the Russian Federation and the Government of the Republic of Kazakhstan on cooperation and mutual calculations in case of utilization of nuclear ammunition

of January 20, 1995

The government of the Russian Federation and the Government of the Republic of Kazakhstan which below are referred to as with the Parties

confirming commitment of the Parties to strengthening of the international non-proliferation regime of nuclear weapon and its basis - the Nuclear Non-Proliferation Treaty of July 1, 1968,

considering accession of the Republic of Kazakhstan to this Agreement as the state which does not have nuclear weapon

being guided by the Treaty of friendship, cooperation and mutual aid between the Russian Federation and the Republic of Kazakhstan of May 25, 1992, the Contract on military cooperation between the Russian Federation and the Republic of Kazakhstan of March 28, 1994, the Agreement between the Russian Federation and the Republic of Kazakhstan on the strategic nuclear forces which are temporarily placed in the territory of the Republic of Kazakhstan of March 28, 1994,

considering obligations of the Russian Federation and the Republic of Kazakhstan under the Contract between the Union of Soviet Socialist Republics and the United States of America on reducing and restriction of strategic offensive arms of July 31, 1991 and to the related documents,

in view of contribution of the Russian Federation and the Republic of Kazakhstan to industrial and technological development, and also testing of nuclear ammunition of strategic offensive arms,

agreed as follows:

Article 1

For the purposes of this agreement the stated below terms have the following value:

1. "Nuclear ammunition" - nuclear military unit of the intercontinental ballistic missile or cruise missile of air basing from structure of the strategic nuclear forces which are temporarily located in the territory of the Republic of Kazakhstan;

2. "Utilization of nuclear ammunition" - process of dekitting, transportation, disassembly, storage and conversion of nuclear ammunition and the sharing materials for use in the peace purposes;

3. "Highly enriched uranium" - uranium with uranium-235 isotope content on weight equal or more than 20 percent;

4. "Low-enriched uranium" - uranium with uranium-235 isotope content on weight to 20 percent;

5. "The fixed share" - the relation of weight mass of VOU containing in the nuclear ammunition exported from the Republic of Kazakhstan to the weight mass of VOU which is subject to conversion and realization under the executive contract according to the Agreement between the Government of the Russian Federation and the Government of the United States of America on use of the highly enriched uranium extracted from nuclear weapon of February 18, 1993.

Article 2

The Russian side provides utilization of all nuclear ammunition from structure of the strategic nuclear forces listed in appendix 1 to the Agreement between the Russian Federation and the Republic of Kazakhstan about the strategic nuclear forces which are temporarily placed in the territory of the Republic of Kazakhstan, of March 28, 1994 and removed on the territory of the Russian Federation according to the schedule approved by the Parties.

The highly enriched uranium extracted from nuclear ammunition is processed in the territory of the Russian Federation into low-enriched uranium.

The plutonium extracted from nuclear ammunition is stored in the territory of the Russian Federation before acceptance of agreed decision of its rather further use by the Parties.

Article 3

In case of sale by the Russian Federation to the United States of America of the low-enriched uranium received as a result of utilization of nuclear ammunition, the Republic of Kazakhstan receives the fixed cost portion of each batch of the sold uranium on the terms of the current contract between the Russian Federation and the United States of America,

From receivable to the Republic of Kazakhstan shares are subtracted all costs and expenses of the Russian Federation connected with dismantle of nuclear weapon, utilization of nuclear ammunition and sale of low-enriched uranium.

Determination of share of the Republic of Kazakhstan from sale of low-enriched uranium, the costs and expenses of the Russian Federation connected with dismantle of nuclear weapon, utilization of nuclear ammunition and sale of low-enriched uranium, terms and procedure for settlement are subject to approval in the contract signed by the Parties within three months after the signature of this agreement.

Article 4

The Kazakhstan Side provides free and duty-free exportation of nuclear ammunition on the territory of the Russian Federation for the purpose of their utilization.

Article 5

The parties provide free and duty-free entrance and departure of the personnel enabling the realization of this agreement.

Article 6

The parties provide conditions for safe operation of nuclear ammunition, dismantle and their movement of the territory of the Russian Federation for the purpose of utilization. At the same time dismantle of nuclear ammunition and transportation are performed by forces and means of the Russian Federation according to the requirements and rules existing in the Russian Federation. The Kazakhstan Side is responsible for creation of safe and free conditions of movement of nuclear ammunition on the territory,

Article 7

Each of the Parties appoints specially authorized body (bodies) for accomplishment of this agreement and has the right to perform replacement of this body by the direction to other Party of the written notice in thirty days prior to replacement.

The parties will resolve all matters of argument which can arise in connection with interpretation and application of this agreement, by negotiations and consultations.

Article 8

The agreement will be considered executed after receipt by the Republic of Kazakhstan of all-in cost of the realized low-enriched uranium less the costs of the Russian Federation and acceptance of agreed decision by the Parties connected with it concerning use of the plutonium extracted from nuclear ammunition.

Article 9

This agreement becomes effective from the date of its signing.

It is made in Moscow on January 20, 1995 in duplicate in Russian, and both texts are equally authoritative.
