Agreement between the Government of the Russian Federation and Government of the Republic Turkmenistan on mutual organization of the Trade missions

of May 18, 1995

The government of the Russian Federation and the Government of the Republic Turkmenistan which are hereinafter referred to as with Contracting Parties

being guided by the aspiration to promote practical realization of provisions of the Russian-Turkmen Free-trade agreement of November 11, 1992,

wishing to promote development of trade and economic relations between both countries on the principles accepted in world practice

agreed as follows:

Article 1

The Russian side establishes the Trade mission of the Russian Federation in the capital of the Republic Turkmenistan, and the Turkmen Side establishes the Trade mission of the Republic Turkmenistan in the capital of the Russian Federation.

Article 2

The trade mission acts on behalf of the Government of the state and is component of the relevant embassy in the country of other Contracting Party.

The sales representative and his deputies, and also administrative technicians of the Trade mission use privileges and immunities which are recognized according to international law for members of the corresponding categories diplomatic and administrative technicians of foreign diplomatic missions.

Office and premises of the Trade mission, its property and archives use the immunities and privileges recognized according to international law for office and premises, property and archives of diplomatic representations.

The trade mission is not subject to rules about the trade register.

Article 3

The trade mission will perform the following main functions:

a) promote development of trade and economic relations between the Russian Federation and Turkmenistan;

b) represent the interests of the states in adoptive state in all that concerns trade and other types of economic cooperation between both countries;

c) inform state bodies of the country on economic conditions in adoptive state and its legislation in the field of foreign economic activity, and also provide such information on the country to the interested bodies of adoptive state;

d) render assistance to legal entities and physical persons of the countries in implementation of transactions by them in the field of trade, economic and sci-tech cooperation with legal entities and physical persons of adoptive state.

Article 4

The organization of the Trade missions does not affect the rights of the Russian and Turkmen legal entities and physical persons to maintain the direct relations with each other, in particular, for the purpose of the conclusion and execution of the transactions connected with implementation trade and economic and sci-tech cooperation.

Article 5

By agreement of Contracting Parties in other cities of adoptive state departments of the Trade missions can be open. Along with achievement of such arrangement legal status of such departments will be determined.

Article 6

This agreement becomes effective from the date of its signing and will be effective until one of Contracting Parties does not declare the desire to stop its action by the written notice of other Contracting Party at least in six months prior to the beginning of the next calendar year.

It is made in Moscow on May 18, 1995 in two authentic copies, everyone in the Russian and Turkmen languages, and both texts are equally authoritative.
