1. Approve Regulations on procedure for education at the companies, in the organizations and organizations of fund for labor protection and use of its means according to appendix.

to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of November 12, 2008 No. 245
1. The companies, the organizations and organizations (further - the organization) according to the Law of the Republic of Uzbekistan "About labor protection" and for the purpose of financing of research works in the field of labor protection, the target programs and other measures directed to improvement of conditions and labor protection of the workers having the right to create fund for labor protection (further - Fund).
2. The fund is not independent legal entity and is created based on the decision of relevant organ of management of the organization for accumulation of the means specified in Item 3 this provision.
3. Fund is created for the account:
profit (income) of the organization after tax payment and other obligatory payments;
voluntary contributions of legal entities and physical persons, including foreign;
other receipts according to the legislation.
4. Fund is used strictly for financing of the actions directed on:
development of programs for improvement of conditions and labor protection in the organization;
the equipment of workplaces according to requirements of rules and regulations of labor protection and safe engineering;
carrying out research works in the field of labor protection;
improvement of working conditions and creation of conditions for safe and effective work, training (advanced training) of workers in labor protection;
accident prevention on production;
prevention of occupational diseases;
providing security service of work with regulatory legal acts and means of promotion of labor protection;
holding of conferences, seminars, meetings and exhibitions on labor protection;
organization of international cooperation for labor protection;
stimulation of activities for improvement of conditions and labor protection;
implementation of measures for other directions of labor protection determined by internal regulating documents of the organization.
5. Actions for labor protection and the size of necessary means for their financing are provided in the collective agreement and if such agreement is not signed - in the agreement between the employer and trade-union committee or other representative body of workers.
6. In case of development of perspective and annual actions plans on labor protection of the organization, first of all, reveal the productions, sites, objects, engineering procedures requiring decrease (liquidations) in dust content, gas contamination, vibration, noise, other dangerous and harmful production factors, fire-and-explosion hazards, hard manual work and also plan actions for reduction of number of the workers (especially women) occupied in harmful productions and on hard work, to creation of safer working conditions.
7. Do not join in actions for labor protection:
running repair of ventilating installations, sanitary and household devices;
the device of barriers of workplaces about buildings under construction, constructions, assembly sites, trenches, step-ladders, etc.;
production, installation and dismantle of the woods, device of stage, fixture of trenches and ditches;
acquisition, storage, repair, washing, dust removal, drying, disinfection of overalls and special footwear;
acquisition and testing of individual protective equipment and load gripping devices;
providing workers with treatment-and-prophylactic food, milk, soap, acquisition and servicing of sanitary and household and service premises;
color finishing of walls, ceilings, designs, equipment as one of elements of content of buildings, constructions and equipment;
improvement of the territory of the organization, asphalting of passable roads, walking paths, gardening of the territories;
the actions for reduction or liquidation of pollution of air and water basins having main objective creation of normal sanitary conditions for the residential districts located near the company.
8. The organization annually, proceeding from this provision, in the IV quarter of the current year develops the actions plan on labor protection the forthcoming year and approves it in accordance with the established procedure in coordination with trade-union committee or other representative body of workers.
Actions for labor protection shall be provided with sources of financing and material resources.
9. The expenditure of fund is performed within the estimate approved by relevant organ of management of the organization based on the official report of service for labor protection.
10. Along with employees of service on labor protection control of target use of fund is performed by the chief accountant and trade-union committee or other representative body of employees of the organization.
11. Fund, unused in reporting year, is not subject to withdrawal, passes for the next year and is spent for the purposes determined by this Provision and internal regulating documents of the organization.
12. The funds allocated for financing of actions for labor protection cannot be used on other purposes, including on debt repayment on taxes and obligatory payments, other accounts payable.
13. The management of the organization bears responsibility in the procedure established by the legislation for target use of fund.
