The government of the Republic of Uzbekistan and the Government of Turkmenistan which are hereinafter referred to as with the Parties
recognizing importance of free money transfer to citizens on socially important non-commercial payments,
agreed as follows:
The parties will provide free transfer and payment through banks and organizations of mail service of money of citizens by the following types of socially important non-commercial payments:
transfers of pensions, the alimony, public welfare payments, payments and compensations, including the payments for indemnification caused to workers by the mutilation, occupational disease or other damage of health connected with execution of labor obligations by them;
the amounts paid based on sentences, decisions, determinations and resolutions of judicial and investigating authorities;
the payments connected with the death of the citizen (transportation expenses and expenses on funeral);
payments on expense recovery to judicial, investigating, arbitral, notarial and other law enforcement agencies, and also the state fee on the cases considered by these bodies;
transfer of monetary compensations to the victims of political repressions, members of their families and heirs.
Acceptance of money on socially important payments from senders and payment to their receivers is made in national currencies of the relevant Parties.
The parties will provide for these purposes complete and timely mutual converting of national currencies according to the procedure, determined by the Central banks of the Republic of Uzbekistan and Turkmenistan.
The parties authorize the Ministries of Communications of the states to sign the free standing agreement about the mechanism and conditions of money transfer of citizens on socially important non-commercial payments with calculations through authorized banks in coordination with the Ministry of Finance and the Central bank of the Republic of Uzbekistan and the Ministry of Economics and finance and the Central bank of Turkmenistan.
The parties confirm the social importance of realization by citizens of the right to the free order with savings deposits, including their transfer from the Republic of Uzbekistan to Turkmenistan and from Turkmenistan to the Republic of Uzbekistan.
The parties recommend to savings and other banks of the states to sign agreements on procedure for contributions transfer of the population taking into account the national legal system.
Changes can be made to this agreement and additions by mutual consent of the Parties which will be are drawn up by separate protocols. The specified protocols are integral part of this agreement.
All matters of argument connected with accomplishment and interpretation of this agreement will be permitted by negotiations.
This agreement becomes effective from the date of its signing.
This agreement is effective until one of the Parties does not notify in writing through diplomatic channels other Party on the intention to stop its action. In this case the Agreement voids after three months from the date of receipt of one of the Parties of such notification.
It is made in the city of Chardzhev on January 16, 1996 in two authentic copies, everyone in the Uzbek, Turkmen and Russian languages.
In case of disagreements in interpretation of provisions of this agreement, the text in Russian will be taken as basis.
