This agreement determines procedure for representation by the Russian Side to the Kazakhstan Side of plans of starts of spacecrafts and test missiles launches from the Baikonur spaceport and representation by the Kazakhstan Side to the Russian Side of the conclusion (approval) by them.
Test missiles launches in this agreement are understood as launches of intercontinental ballistic missiles for the benefit of defense and safety of the State Parties of the Agreement on collective security of May 15, 1992 including in case of start of passing useful load.
Information on plans of starts of military spacecrafts and test missiles launches is confidential and is not subject to disclosure.
The Russian side no later than November 30 of prior year provides to the Kazakhstan Side through diplomatic channels plans of starts of spacecrafts and test missiles launches for the next year with indication of the name and purpose of spacecrafts (except military), names of carrier rockets (in respect of test missiles launches - basic model of the intercontinental ballistic missile), the planned terms of starts of spacecrafts and missiles launches (quarterly).
Construction projects new and reconstruction of the used objects of the Baikonur complex for conducting the state environmental assessment and approval of entering of inseparable improvements into leased property are attached to plans of test missiles launches.
The Russian organization making missile launch from the Baikonur spaceport (The federal space center "Baikonur" or body 11284), not later than 5 days (if other is not established, the term approved by the Parties) notifies Space committee of the Department of Energy, the industry and trade of the Republic of Kazakhstan, the Ministry of Defence of the Republic of Kazakhstan, emergency situations Agency of the Republic of Kazakhstan, Akimats of the areas of the Republic of Kazakhstan along the route of flight of rockets on each forthcoming start of the spacecraft and test missile launch from the Baikonur spaceport with the subsequent submission of information on the facts of their carrying out within a day. The specified organizations of the Republic of Kazakhstan within a day from the moment of receipt of the notification confirm its obtaining.
In the notification are represented: the name of the spacecraft (except military), parameters of its orbit, the name of the carrier rocket, components of rocket fuel and their quantity on steps, quantity of warranty remaining balance of components of rocket fuel on steps, areas of fall of the separated parts of the carrier rocket, date (the main and reserve) and estimated time of start of the spacecraft and test missiles launches.
In case of change of date of start of the spacecraft and test missile launch or transition to reserve date of start (start-up) the Russian Side notifies on it the Kazakhstan Side not later than 24 hours before new date of start (start-up).
The Kazakhstan Side till December 30 of prior year through diplomatic channels notifies the Russian Side on the decision according to plans of starts of spacecrafts and test missiles launches from the Baikonur spaceport for the next year. The conclusion (approval) according to plans is the basis for their realization.
In case of lack of the conclusion (approval) in the specified time plans are considered as approved.
At the same time the Kazakhstan Side reports the Russian Side of the address (faxes, phones) of the organizations notified before start-up according to Article 3 of this agreement.
Disputes on interpretation and application of this agreement are permitted by the Subcommittee on the Baikonur complex of the Intergovernmental commission on cooperation between the Republic of Kazakhstan and the Russian Federation.
This agreement becomes effective from the date of its signing and is effective before the termination of the duration of the agreement of lease.
By mutual consent of the Parties changes and additions which are drawn up by the separate protocols which are integral parts of this agreement can be made to this agreement.
It is made in the city of Astana on November 18, 1999 in duplicate, everyone in the Kazakh and Russian languages, and both texts are equally authoritative.
