The agreement between the State committee of the Russian Federation on defensive industries and Industry ministry of the Republic of Moldova about economic and sci-tech cooperation

State committee of the Russian Federation on defensive industries and Industry ministry of the Republic of Moldova,

hereinafter referred to as with the Parties,

based on provisions of the Contract on creation of Economic union between state members of the Commonwealth and the Agreement between the Government of the Russian Federation and the Government of the Republic of Moldova about production and scientific and technical cooperation of the companies of defensive industries,

considering the developed technological communications between the companies and the organizations of defensive industries of the Parties,

recognizing crucial role of direct production interaction of business entities of the Parties in the conditions of the market relations,

relying on experience economic and sci-tech cooperation of the Parties in 1993,

agreed about the following:

Article 1

The parties will promote implementation of economic communications between the companies, associations and the organizations on the basis of mutual advantage and non-admission of the actions causing mutual economic damage.

Article 2

The parties shall promote implementation of research and development works on the basis of joint target programs of the arms production, military equipment and civil products under contracts between business entities of the Parties on the terms of intergovernmental agreements and with preserving the operating economic communications, the existing procedure for development, statement on production, delivery and testing of products at the companies of the Russian Federation and the Republic of Moldova.

Article 3

The parties promote mutual contractual deliveries between the companies of the Russian Federation and the Republic of Moldova of the materials, components and other material resources necessary for the arms production and military equipment according to the Agreement between the Government of the Russian Federation and the Government of the Republic of Moldova on production and scientific and technical cooperation of the companies of defensive industries on annually approved lists containing lists of the companies - suppliers, the nomenclature and amounts of mutually delivered goods.

Article 4

The parties consider expedient carrying out coordinated policy in the field of investing activities and pricing, including price regulation on products of enterprise monopolists.

Article 5

The parties consider inadmissible presentation by suppliers unilaterally in case of the conclusion and execution of delivery contracts of products of additional requirements about counter delivery of goods, rendering the services which are not connected with its production and payment of products in currency, except for deliveries of products in export make.

Article 6

The parties not transfer without mutual consent the obtained documentation and information to the third party, and also foreign physical persons and legal entities irrespective of the territory of their stay.

The parties undertake obligations on information security of the closed nature on the basis of regulations of the Parties.

Article 7

The parties shall pursue coordinated policy in the field of standardization, metrology and certification, to keep the developed procedure for providing the companies with the specifications and technical documentation.

Regarding arms, military equipment and components to them of the company, being under authority of the Parties, will be guided by the existing specifications and technical documentation on standardization, unification and rules of testing, product acceptance and conducting damage work.

Article 8

The parties agreed that removal from production of the components, materials and raw materials going for production, repair and maintenance of arms and military equipment is carried out in coordination.

Article 9

The parties shall render every possible assistance to the companies in their export policy on the basis of preserving and further development of sci-tech cooperation, interstate cooperation and mutually advantageous settlement system for products sold to the third countries.

Article 10

The parties will promote education of interstate financial and industrial groups, production associations, associations and joint-stock companies of various patterns of ownership, to support intentions of the companies and associations on creation of business entities whose activities will be directed to stabilization and development of production.

Article 11

The parties consider expedient in necessary cases the conclusion of agreements, adoption of joint decisions and execution of protocols on cooperation in the separate directions of production of special and economic purpose.

Article 12

The agreement comes into effect from the moment of signing, is effective within two years and can be changed and added according to the mutual arrangement of the Parties.

It is made on February 18, 1994 in Moscow in duplicate, and both copies are equally authoritative.
