The contract between the Russian Federation and the Republic of Uzbekistan on cooperation in military area

of March 2, 1994

The Russian Federation and the Republic of Uzbekistan which further are referred to as with the Parties

confirming the commitment to the purposes and the principles of Articles of organization of the United Nations, the Helsinki Final act and other documents on safety and cooperation in Europe,

being guided, everyone respectively, the Declaration on the state sovereignty of the Russian Federation of June 12, 1990 and the Law on bases of the state independence of the Republic of Uzbekistan of August 31, 1991,

based on the relevant articles of the Agreement on bases of the interstate relations, friendship and cooperation between the Russian Federation and the Republic of Uzbekistan,

considering the contracts and agreements on military questions signed within the Commonwealth of Independent States and also the relevant international agreements which participants are the Parties,

considering need of the mutually acceptable and organized solution of the questions connected with creation of own Armed Forces and interest in joint use of the military facilities located in the territories of the Parties

agreed as follows:

Article 1

The parties in the relations in military area are based on legislations of the states and decisions on creation of own Armed Forces made according to them.

Article 2

Any of the parties will not assume that its territory was used by the third state or the third states for the purpose of the armed aggression or hostile activities against other Party.

In case of threat of military attack from the third states of the Party will consult with each other both on bilateral basis, and within associations of the states which include both Parties.

Article 3

The parties according to the mutual arrangement allow arrangement in the territories of military facilities of joint use.

Article 4

The parties will participate in implementation of the Statement of the Representative of USSR in Joint advisory group of June 14, 1991 Measures for accomplishment of this Statement are determined by the free standing agreement between the Parties by the Treaty on Conventional Armed Forces in Europe.

Article 5

The parties with observance of their international obligations keep on contractual basis the developed bonds on production and supply with arms, the military equipment, operational technical documentation completing with elements, spare parts and accessories (ZIP) and other appliances and also on repair of military equipment, warranty supervision, claims, completions, research and development works.

Material logistics of participants of development and the arms production and military equipment is performed according to state orders of the Parties respectively.

The parties provide order placement of the Ministries of Defence of the Parties at the companies of the industry and provide measures for their accomplishment.

Order placement and ensuring deliveries of arms, the equipment, ZIP, other appliances is performed on the basis of intergovernmental agreements.

Article 6

The parties will perform cooperation in the field of export of arms and military equipment and in other questions of military and technical interaction with the third countries.

The directions and forms of this cooperation, and also the mechanism of interaction are regulated by free standing agreements.

Article 7

The parties will perform mutual deliveries on logistic, medical support and servicing of military transportations on the basis of free standing agreements between the Ministry of Defence of the Russian Federation and the Ministry of Defence of the Republic of Uzbekistan.

Article 8

Deliveries of arms, military equipment and other appliances are performed by each of the Parties on the territory of other Party under mutual approval without collection of duties and other taxes.

Article 9

The parties use proving grounds according to free standing agreements between the Ministry of Defence of the Russian Federation and the Ministry of Defence of the Republic of Uzbekistan.

Article 10

The parties will perform preparation of military personnel on the basis of mutual calculations and free standing agreements between the Ministry of Defence of the Russian Federation and the Ministry of Defence of the Republic of Uzbekistan.

Article 11

The parties will provide observance of the social rights of the military personnel, persons discharged from military service and members of their families in case of their movement from the territory of one Party of the territory another. Measures for realization of these rights are regulated by the free standing agreement.

For the military personnel of Armed Forces of one Party the right to transfer for passing of further service to Armed Forces of other Party remains. The procedure for transfer and service is determined by the Agreement between the Ministry of Defence of the Russian Federation and the Ministry of Defence of the Republic of Uzbekistan on procedure for passing of military service by officers, ensigns, warrant officers and military personnel of extra urgent service of January 22, 1993.

The parties, considering the status of the military personnel and feature of military service, grant the right to the military personnel, persons discharged from military service and the members of their families leaving on permanent residence from the territory of one Party on the territory another to export the property belonging to them, including vehicles, without restrictions and collection of duties, taxes, charges.

Article 12

The parties keep the existing procedure for use of airfield network, their airspace, communication systems, information and material logistics, and also other objects of their military infrastructure by parts of the Air Force and air units of Air defense of the Parties.

Article 13

The parties perform interaction of forces and anti-aircraft weapons and cooperate on the questions connected with exchange of information about aerospace situation, assistance to aircrafts, in distress or lost orientation, and suppression of stealing or hijacking of aircrafts.

Article 14

Changes and additions can be made to this Agreement at the initiative of the either party on the basis of mutual consent.

Article 15

This Agreement is subject to ratification and will become effective in day of exchange of instruments of ratification.

This Agreement is signed for the term of five years. Validity then will be prolonged automatically for one year if in six months prior to the expiration of the corresponding period any of the Parties in writing does not notify other Party on the desire to stop its action.
