About approval of the Instruction about making of customs transactions when finding goods in places of unloading and overload (transfer) in the sea and river ports open for the international freight and (or) passenger traffic, without placement on warehouses of temporary storage under customs control

Approve the enclosed Instruction about making of customs transactions when finding goods in places of unloading and overload (transfer) in the sea and river ports open for the international freight and (or) passenger traffic, without placement on warehouses of temporary storage under customs control (further - the Instruction).

4. Consider this order become effective from 01:01. 2004, except for Items 9 and 10 of the Instruction which are becoming effective after 90 days from the date of official publication.

The instruction about making of customs transactions when finding goods in places of unloading and overload (transfer) in the sea and river ports open for the international freight and (or) passenger traffic, without placement on warehouses of temporary storage under customs control

I. General provisions

1. The instruction about making of customs transactions when finding goods in places of unloading and overload (transfer) in the sea and river ports open for the international freight and (or) passenger traffic, without placement on warehouses of temporary storage under customs control (further - the Instruction) is developed based on the legislation of the Russian Federation and international treaties of the Russian Federation.

The instruction regulates making of customs transactions in case of stay (further - storage) goods in places of their unloading and overload (transfer) in sea and river ports without placement on warehouses of temporary storage.

2. Goods after arrival and representation to customs authority of the relevant documents and data can be unloaded or overloaded, placed on warehouse of temporary storage, are declared for the room under certain customs regime or for internal customs transit.

3. Goods from the moment of their presentation in the place of arrival acquire the status being on temporary storage.

4. Unloading and overload (transfer) of goods from the vessel *, arrived to customs area of the Russian Federation, is performed in the place of arrival, and also in working hours of customs authorities in the places which are specially intended for these purposes.

Loading of the goods which are under customs control on the vessel decreasing from customs area of the Russian Federation, and also their storage is performed in the places approved with customs authorities.

5. In places of regular carrying out transactions on unloading, overload (transfer) and storages of the goods which are under customs control are created the permanent customs control zone (CCZ). In other cases for carrying out transactions on unloading, overload (transfer) and for storage of the goods which are under customs control temporary ZTK are created.

6. Unloading, overload (transfer) and storage in ZTK of the goods and vehicles which are not under customs control is allowed. Accounting and storage of the goods which are under customs control and other goods is conducted separately.

II. Procedure for receipt of permission to storage of goods in the place of unloading and overload (transfer) and goods placement imported by courts on customs area of the Russian Federation to customs control zones

7. For storage of goods in ZTK without their placement on warehouse of temporary storage, person performing cargo operations in port sends the written request in customs in which region of activities ZTK is located.

8. The decision on storage of goods in ZTK is made by the chief of customs in writing in terms no more than three working days based on the written request of person performing cargo operations in port (appendix 1).

The decision on possibility of storage of goods in ZTK can be effective during term:

- functioning of ZTK;

- determined by the customs legislation for completion of the transactions connected with customs clearance of the goods imported on customs area of the Russian Federation;

- operations of contracts with linear shipping companies;

- necessary for implementation of cargo operations with the imported goods.

9. When placing goods the documents containing data on the name and the location of the sender (receiver) of goods according to transport (transportation) documents, the country of departure and the country of destination of goods, the name of goods, their quantity, quantity of cargo pieces, nature and method of packaging and marking of goods, mass gross of goods (in kilograms) or amount of goods are submitted to ZTK in customs authority (in cubic meters).

In documents there can be no information about the receiver of goods, and also other data if it is provided by international conventions, transport charters and codes, other laws and rules published according to them concerning international carriages of loads.

10. For goods placement and their further accounting are represented to ZTK:

- the bills of lading or other documents confirming availability and contents of the agreement of maritime (river) transport;

- the document ordered by the World post convention (in transit the international mailings).

Also the documents published by person performing cargo operations in port can be submitted to customs authority.

11. If the submitted documents do not contain the data specified in Item 9 of the Instruction, person placing goods in ZTK reports in customs authority missing data by submission of other documents which are available for it or additional documents constituted by it (or according to its order other person) in any form.

12. In servicing cases in port of regular linear calling of courts (according to the approved schedule based on the signed agreements) person performing cargo operations in port can provide to customs authority agreements with linear shipping companies and their agents on transfer and storage of goods, and also the approved schedule of calling of courts with the obligation of acceptance of goods on storage from the moment of their actual unloading in ZTK.
