Regulations on Federal Highway Agency

I. General provisions

1. The Federal Highway Agency (Rosavtodor) is the federal executive body performing functions on rendering the state services and management of state-owned property in the sphere of road transport and road economy including in the field of accounting of highways, and also function on rendering the state services in the field of ensuring transport safety in this sphere and on urban land electric transportation.

The Federal Highway Agency performs powers of competent authority in the field of road transport and road economy on implementation of the obligations following from international treaties of the Russian Federation regarding accomplishment of functions on rendering the state services and management of state-owned property.

2. The Federal Highway Agency is under authority of the Ministry of Transport of the Russian Federation.

3. The Federal Highway Agency in the activities is guided by the Constitution of the Russian Federation, the Federal constitutional Laws, the Federal Laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, acts of the Ministry of Transport of the Russian Federation, and also this Provision.

4. The Federal Highway Agency performs the activities in interaction with other federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies, public associations and other organizations.

II. Powers

5. The Federal Highway Agency performs the following powers in the established field of activity:

5.3.1. in accordance with the established procedure work on withdrawal and fixing of the parcels of land, and also reservation of lands for the state needs for the purpose of placement of highways public of federal importance, including the conclusion of agreements with owners, owners of the parcels of land and (or) other real estate units located on them, and also on registration of the appropriate rights to the specified parcels of land and objects;

5.3.2. it is excluded

5.3.3. ceased to be valid according to the Order of the Government of the Russian Federation of 26.03.2020 No. 341

5.3.4. ensuring compliance of condition of highways public federal importance to statutory rules, standards, technical regulations and other regulating documents;

5.3.5. accounting of indicators of security status of traffic on the extent, technical condition of highways and availability of objects of road service on them;

5.3.6. informing participants of traffic on availability of objects of service and safe traffic conditions on the respective sections of roads, and also the edition together with executive bodies of subjects of the Russian Federation of the atlas of automobile road net of the Russian Federation;

5.3.7. acceptance for operation finished with construction, reconstruction and repair of sections of highways public of federal importance;

5.3.8. preparation of offers on implementation of operation on paid basis of highways;

5.3.9. coordination of decisions of executive bodies of subjects of the Russian Federation and local government bodies about provision of the parcels of land within the roadside strips of highways public of federal importance or the parcels of land which are out of these strips, but requiring special access to them, and also the parcels of land under parking and stops;

5.4. performs:

5.4.1. ceased to be valid according to the Order of the Government of the Russian Federation of 26.03.2020 No. 341

5.4.1 (1). decision making about withdrawal for federal needs of the parcels of land and (or) other real estate units located on them for construction and reconstruction of highways of federal importance, and also about reservation of lands for the specified purposes;

5.4.1 (2). decision making about preparation of documentation on the layout of the territory for the purpose of development of highways public of federal importance;

5.4.1 (3). the conclusion of agreements on seizure of land and (or) the real estate units located on them for placement of highways of federal importance and forming of strips of withdrawal of such highways with owners of such parcels of land;

5.4.1 (4). coordination of the site planning of the territory providing construction, reconstruction of linear object of federal importance, linear object of regional value or linear object of local value according to which reconstruction of the existing linear object or linear objects which approval of the site planning is referred to powers of the Agency is necessary;

5.4 (2). makes decisions on preparation of documentation on the layout of the territory providing placement of highways public of federal importance, provides preparation of such documentation, including project development of the layout of the territory and boundary-setting plans, and its approval according to the Town-planning code of the Russian Federation;

5.4.3. introduction of the periods of temporary restriction or the termination of movement of vehicles on highways public of federal importance for the purpose of traffic safety;

5.4.5. the actions aimed at safety of movement on sections of highways public of federal importance in case of work on their construction, reconstruction, repair and content;
