About some questions of the national historical and cultural and natural park "Janar Dag"

For the purpose of ensuring execution of Item 2 of the Order of the President of the Azerbaijan Republic of May 2, 2007 No. 2141 "About creation of the national historical and cultural and natural park "Janar Dag" Cabinet of Ministers of the Azerbaijan Republic decides:

1. Transfer the national historical and cultural and natural park "Janar Dag" to subordination of the Ministry of Culture and tourism of the Azerbaijan Republic.

2. To determine borders of the national historical and cultural and natural park "Janar Dag" according to the plan scheme, the provided by the Ministry of Culture and tourism of the Azerbaijan Republic in coordination with State committee on the ground and cartography, Azerbaijani National Academy of Sciences and the Executive authority of Absheronsky district.

3. Approve "The regulations on the national historical and cultural and natural park "Janar Dag" (are applied).

4. This resolution becomes effective from the date of signing.

Regulations on the national historical and cultural and natural park "Janar Dag"

I. General provisions

1.1. The national historical and cultural and natural park "Janar Dag" (further - the Reserve) is the structure equated to research establishments and created by the Order of the President of the Azerbaijan Republic of May 2, 2007 No. 2141.

The reserve is effective in subordination of the Ministry of Culture and tourism of the Azerbaijan Republic.

1.2. The reserve is guided in the activities by the Constitution of the Azerbaijan Republic, the laws of the Azerbaijan Republic, decrees and orders of the President of the Azerbaijan Republic, resolutions and orders of the Cabinet of Ministers of the Azerbaijan Republic, other existing regulatory legal acts, orders of the Ministry of Culture and tourism of the Azerbaijan Republic, orders of board and this Provision.

1.3. All territory of the Reserve is inviolable, is in its use and under its control.

1.4. The reserve is the organization financed from the government budget, has the state account, seal with the name of the Ministry of Culture and tourism of the Azerbaijan Republic and own name, the corresponding angular stamps and forms. The Reserve has own emblem.

1.5. The reserve represents to the Ministry of Culture and tourism of the Azerbaijan Republic annual statements about the activities.

1.6. For the purpose of safety of the monuments located in the territory of the Reserve, their functional purpose, architectural and esthetic type and longevity there are Reserve borders approved by the Cabinet of Ministers of the Azerbaijan Republic and its conservation zone determined by the Ministry of Culture and tourism of the Azerbaijan Republic in case of approval of the competent organizations.

1.7. The earth in the specified territory based on the current legislation fully or partially is withdrawn from economic use and civil circulation and transferred to permanent use of the Reserve.

II. Tasks and activities of the Reserve

2.1. The reserve carries out the following tasks according to the activities established by this Provision:

2.1.1. exercises the state control in the territory of the Reserve;

2.1.2. will organize works on forecasting and planning in the field of the Reserve and provides development of the Reserve;

2.1.3. prepares the corresponding plans for management of the Reserve, will approve them with the Ministry of Culture and tourism of the Azerbaijan Republic and performs them;

2.1.4. in the appropriate order will organize greening sites and traffic circulation in the territory of the Reserve. In case of danger to protection of monuments from pipelines, the electric lines and other communications which are on sections of the roads passing near monuments or in their conservation zone and also movements of vehicles takes in the procedure corresponding to the legislation measures for their prohibition or restriction;

Projects are performed after their approval by the Ministry of Culture and tourism of the Azerbaijan Republic under control of the Reserve and the author (authors) of the project.

2.1.6. based on the decision of the Ministry of Culture and tourism of the Azerbaijan Republic plans and will organize repair and restoration of monuments and structures within Reserve borders, exercises control over accomplishment of the specified works, determines security measures in connection with conducting the repair work able to constitute danger to monuments, and in the appropriate order carries out them;

2.1.9. provides protection and immunity of the historical and cultural monuments located in the territory of the Reserve, in established by the legislation to lock takes necessary measures for prevention of abuse of regulations of their use and the mode of protection of the Reserve and accountability of perpetrators;

2.1.10. will organize tourism development, determination of tourist routes in the territory of the Reserve and creation of the infrastructure connected with it;

2.1.11. will organize scientific research and studying, involves specialists to detection and studying of monuments;

2.1.12. within the means provided for the Ministry of Culture and tourism of the Azerbaijan Republic in centralized expenses of the government budget for the next year propagandizes scientific, historical and cultural value of monuments.

Will organize exhibitions, photostands, excursions, lectures, takes adequate measures for shooting of documentary and short films and the edition of popular scientific literature;

2.1.13. in the appropriate order will organize in the territory of the Reserve conducting archeological excavations according to the legislation, exercises control over studying of monuments, conducting archeological excavations and other similar works;

Excavation and detection of monuments in the territory of the Reserve it is allowed after receipt of permission of the Azerbaijani National Academy of Sciences and registration in the Ministry of Culture and tourism of the Azerbaijan Republic. The historical and cultural monuments found during archeological excavations in the territory of the Reserve are contributed to fund of the Reserve;
