About preferential calculation of length of service to aircrew of customs authorities

In pursuance of orders of the Government of the Russian Federation of 02.02.1998 N 103 * "About procedure for calculation of length of service for appointment and pension payment and benefits to persons serving (working) in customs authorities of the Russian Federation" and of 15.02.2001 N 117 "About entering of amendments into item 4 of the Regulations on calculation of length of service for purpose of pensions to customs officers taking into account features of the service in customs authorities of the Russian Federation approved by the order of the Government of the Russian Federation of 02.02.1998 N 103" and also according to the order of the State Customs Committee of Russia of 30.01.2002 N 87 ** "About the organization of work on calculation of length of service" I order to customs officers of the Russian Federation:

N 457 above-named order of STC Russian Federation of January 30, 2002 N 87 are declared by the order of STC Russian Federation of April 25, 2003 invalid after 30 days after official publication of the mentioned order

1. Approve the Instruction about conditions and procedure for preferential calculation of length of service to aircrew of customs authorities (appendix).

2. Establish for calculation of length of service to aircrew of customs authorities for receipt of length-of-service allowance and purpose of pensions on favorable terms the minimum annual regulation of raid by helicopters with jet and turbo-propeller engines (one month of service in two months) - 50 hours.

3. To chiefs of structural divisions of the State Customs Committee of Russia and regional customs authorities to inform subordinate employees of this order and to perform necessary organizational actions for its execution.

4. To exercise control of execution of this order to the vice-chairman of the State Customs Committee of Russia I. A. Mezhakov.

The instruction about conditions and procedure for preferential calculation of length of service to aircrew of customs authorities

I. General provisions

1. This Instruction about conditions and procedure for preferential calculation of length of service to aircrew of customs authorities is developed taking into account provisions of article 27 of the Federal Law of 21.07.1997 N 114-FZ "About service in customs authorities of the Russian Federation" (The Russian Federation Code, 1997, N 30, Art. 3586; 2000, N 33, Art. 3348; 2000, N 46, Art. 4537; "The Russian newspaper" of 02:07. 2002, N 118), orders of the Government of the Russian Federation of 02.02.1998 N 103 "About procedure for calculation of length of service for appointment and pension payment and benefits to persons serving (working) in customs authorities of the Russian Federation, and to their families" (The Russian Federation Code 1998, N 6, Art. 737; 2000, N 2, Art. 249; 2001, N 9, the Art. 856) and of 15.02.2001 N 117 "About entering of amendments into item 4 of the Regulations on calculation of length of service for purpose of pensions to customs officers taking into account features of the service in customs authorities of the Russian Federation approved by the order of the Government of the Russian Federation of 02.02.1998 N 103" (The Russian Federation Code, 2001, N 9, the Art. 856).

II. Conditions of preferential calculation of length of service

2. The length of service on favorable terms to aircrew of customs authorities for receipt of length-of-service allowance and award of pension is charged on condition of accomplishment of the minimum annual regulation of raid on aircrafts with jet and turbo-propeller engines - 50 hours. If the aircrew was at flight work incomplete calendar year, the specified regulation of raid of hours is determined in proportion to time of the actual stay at flight work.

2.1. In the same procedure (it is pro rata to time of the actual stay at flight work) the specified regulation of raid of hours is determined for aircrew which one part of calendar year performed flight work on aircrafts with jet or turbo-propeller engines, and other part of calendar year - on aircrafts with piston engines. At the same time, if the regulation of raid of watch on aircrafts with jet or turbo-propeller engines for the corresponding part of year is not executed, then the raid of hours in these courts joins in raid of watch on aircrafts with piston engines and on condition of accomplishment of general annual regulation of raid this calendar year of service is set off in length of service on favorable terms (one month of service in one and a half months).

2.2. To the aircrew discharged of flight work, time of service from the date of the actual termination of flight work is set off in length of service in calendar calculation.

III. Procedure for preferential calculation of length of service

3. The length of service in preferential calculation to the staff (officials) of the customs authorities consisting on aircrew positions is set off at flight work in reactive and turbo-propeller aircraft on favorable terms - one month of service in two months (the subitem "an" of item 4 of the order of the Government of the Russian Federation of 02.02.1998 N 103) since March 5, 2001, and till March 5, 2001 - one month of service in one and a half months (the subitem "b" of item 4 of the order of the Government of the Russian Federation of 02.02.1998 N 103, the Russian Federation Code, 1998, N 6, Art. 737; 2000, N 2, Art. 249; 2001, N 9, Art. 856).

3.1. After each flight day (night) or departure the pilot (the navigator, the onboard engineer or the technician) shall fill in the flight sheet (flight task), and then to bring raid time in the flight book. Upon termination of month the results according to all graphs of the flight book separately on types of airplanes (helicopters) taking into account time of day (day and night flights), and upon termination of year - general result in year are summed up.

Records about raid in flight leaf (flight task) and the flight book (in month and year) are signed by the chief of customs authority or the official authorized by it. Records are certified official stamp.

3.2. Following the results of calendar year the order of customs authority on the actual raid of aircrew of aviation division of customs authority for the current year is issued. In case of accomplishment of the established raid regulation the order is the basis for calculation of length of service to the specific employee on favorable terms.
