For the purpose of the prevention of cases of export out of limits of Ukraine with exceeding of regulations of radioactive radiation and ensuring the state control of observance of requirements of the nature protection legislation and regulations of ecological safety during export of scrap of ferrous and non-ferrous metals the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure of environmental control of export consignments of scrap of ferrous and non-ferrous metals by territorial authorities of the State ecological inspection which is applied.

Grant the right to the Ministry of Ecology and Natural Resources to make explanations concerning application of this Procedure.

2. Ceased to be valid

Procedure of environmental control of export consignments of scrap of ferrous and non-ferrous metals by territorial authorities of the State ecological inspection

General provisions

The procedure of environmental control of export consignments of scrap of ferrous and non-ferrous metals by territorial authorities of State ecoinspection (further - the Procedure) is developed for the purpose of the prevention of cases of export them out of limits of Ukraine with exceeding of regulations of radioactive radiation and ensuring the state control of observance of requirements of the nature protection legislation and regulations of ecological safety.

The procedure determines rules of implementation by territorial authorities of State ecoinspection of environmental control of export consignments of scrap of ferrous, non-ferrous, other metals and metal ceramics (daleemetallolom) on availability of chemical or radioactive pollution.

The procedure is obligatory for subjects of business activity of all patterns of ownership.

Each export consignment of scrap metal is subject to environmental control.

The load which goes at the same time to the address of one receiver, as a part of one departure from one sender is considered batch.

Environmental control of export consignments of scrap metal is exercised in the territory of its warehousing, and also at check points through frontier of Ukraine.

Environmental control is exercised by the state inspectors on protection of the surrounding environment.

Implementation of environmental control

Environmental control is carried out in two steps - during forming of transfer quantities of scrap metal in places of its accumulating and at the check point through frontier of Ukraine.

Environmental control of transfer quantities of scrap metal in places of its accumulating is exercised based on the request of the exporter according to appendix 1. The request goes in 15 days prior to shipment of export consignment. To this period it is carried out:

verification of accompanying documents, namely:

contract;

written consent (message) to cross-border transportation of dangerous wastes,

the license for collection, procurement, conversion, purchase and sale of scrap metal issued in accordance with the established procedure;

certificate of origin of scrap metal;

check of compliance of structure of load of noted documentation;

measurements of levels of radiation, and also availability of chemical and other pollution of surface of scrap metal;

in case of need, for the purpose of detection of nature and origin of pollution, additional chemical and/or radiochemical researches are carried out;

documentary registration of the conducted researches.

Measurements of levels of radiation are carried out by the state inspector on protection of the surrounding environment. Results of inspection are drawn up by the protocol (appendix 2).

In case of need in the presence of the owner of load or person who represents him sampling for carrying out chemical analysis, radiochemical researches is made and the act is drawn up (appendix 3).

Analytical control of export consignment of scrap metal is carried out according to the existing regulating documents in the certified (accredited) in accordance with the established procedure laboratories. Results of inspection are drawn up by the protocol (appendix 4).

Based on protocols (appendices 2 and 4) in case of lack of violations of the nature protection legislation the Certificate of environmental control is drawn up (appendix 5) in duplicate which are signed by the official designated by the head of territorial authority of State ecoinspection. The first copy is issued to the applicant for presentation during passing of environmental control on border, the second remains in territorial authority of State ecoinspection, it issued.

The request, protocols, the Certificate of environmental control are registered in the special magazine and are stored in territorial authority of State ecoinspection at least one year from the date of issue.

If the research is specified exceeding of admissible regulations of radiation or the inadmissible level of chemical pollution which in certain terms cannot be eliminated, the state inspector makes the decision concerning prohibition of export of this batch of scrap metal and reports about it in the relevant services.

The certificate of environmental control issued according to this Procedure is one of the bases for scrap metal export implementation.

During implementation of environmental control of scrap metal at the check point through frontier of Ukraine it is carried out:

verification of presence and reliability of accompanying and allowing documents;

visual survey of load and vehicle;

check of compliance of type and properties of load to contents of accompanying documents;

carrying out control measurements of radiation of load and vehicle.

Based on performed in accompanying documents (commodity-transport delivery note) the mark (stamp) about passing is put down by load of environmental control.
