About approval of Rules of release, placement, the address, servicing and repayment of the government special compensation treasury bonds

1. Approve the enclosed Rules of release, placement, the address, servicing and repayment of the government special compensation treasury bonds.
2. To provide to the ministry of information of the Republic of Kazakhstan according to the legislation the notification in mass media about compensation of remaining balance of deposits of citizens of the Republic of Kazakhstan.
3. This resolution becomes effective from the date of publication.

These rules determine procedure for release, placement, the address, servicing and repayment of the government special compensation treasury bonds "Memlekettik of arnaula? that? azynashyla? obligatsiyalar" - MA?? About (further - bonds).
1. In these rules the following basic concepts are used:
1) depositary - "Central Securities Depository" private company;
2) issuer - Ministry of Finance of the Republic of Kazakhstan;
3) the financial agent - the People's Bank of Kazakhstan open joint stock company providing placement, servicing and bond redemption;
4) renewal of deposits - recalculation of remaining balance of deposits of citizens of the Republic of Kazakhstan as of January 1, 1992 in the bond from ruble equivalent in dollar on the stock exchange rate for January 3, 1992 of 150 rubles for 1 US dollar, and then in tengovy equivalent at the rate of National Bank of the Republic of Kazakhstan on date of issue of bonds;
5) the register - the single list of accounts on which the deposits of citizens of the Republic of Kazakhstan which are subject to compensation, with indication of remaining balance as of January 1, 1992 are placed.
2. Bonds are issued by the Ministry of Finance of the Republic of Kazakhstan on behalf of the Government of the Republic of Kazakhstan for the purpose of compensation of deposits of the citizens of the Republic of Kazakhstan as of January 1, 1992 in the former Kazakh republican savings bank of the USSR who are stored on the existing accounts of the financial agent.
3. Bonds are issued in paperless form with circulation periods one, two and three years.
4. Bonds are coupon. The remuneration rate on each bond issue is fixed and equal to the rate of remuneration of short-term and medium-term state treasury obligations with the corresponding circulation periods which developed at the last auction, preceding date of issue of bonds.
5. Nominal value of one bond makes one tenge.
6. The issuer approves parameters of release and draws up the Global certificate according to appendix to these rules on each bond issue. The global certificate is constituted in duplicate, one of which is stored at the financial agent, another at the issuer.
7. Placement of bonds is made by carrying out subscription through the financial agent until the end of 2004 among his investors based on the register as follows:
1) first release: on compensation amount of deposits of citizens from 1936 to 1940 year of birth inclusive, taking into account the inherited deposits;
2) second release: on compensation amount of deposits of citizens from 1941 to 1960 year of birth inclusive, taking into account the inherited deposits;
3) third release: on compensation amount of deposits of citizens since 1961 on 1991 year of birth inclusive, taking into account the inherited deposits;
4) additional release: on compensation amount of deposits of citizens from 1936 to 1940 year of birth inclusive, taking into account the inherited deposits.
8. The circulation of bonds begins next day after date of their release and comes to an end in three working days prior to payment date of remuneration and bond redemption.
9. The circulation of bonds in the secondary market is performed according to the current legislation of the Republic of Kazakhstan.
10. Bond redemption is made by the issuer on their indexed nominal value in the repayment date established for the corresponding release.
11. Indexed nominal value of bonds is calculated as the work of their nominal value on the relation of the official US dollar exchange rate established by National Bank of the Republic of Kazakhstan for settlement date to similar rate on start date of the circulation of bonds, but cannot be lower than its nominal value.
12. The amount of remuneration is calculated for bonds as the work of the nominal value of bonds indexed on payment date of remuneration, rates of remuneration, stipulated in Item 4 these rules, and circulation period of bonds (advanced in years), divided on 100.
13. Payment of remuneration for bonds is made one-timely in repayment day of bonds.
14. The depositary in three working days prior to payment date of remuneration and repayment date of bonds provides to the issuer the summary sheet on repayment and the payment of remuneration of bonds including data on the number of bonds.
15. Accounting and fixing of transition of the property rights to bonds are performed in depositary and at the financial agent.
16. The procedure for the taxation with bonds is determined by transactions according to the tax legislation of the Republic of Kazakhstan.
17. Renewal of deposits is made by the financial agent and other representative it body in case of corporal appearance of the owner of the contribution or person having the right to contribution.
18. Owners of deposits fill in the request for renewal of contribution (further - the request) in the form approved by the issuer which contains data on the owner of contribution: the identity certificate, the registration taxpayer number (RTN), details of the savings book, the contribution remaining balance amount as of January 1, 1992, the number of bonds, consent to renewal of contribution. The written request is drawn up in duplicate, one of which is stored at the financial agent, another at the owner of contribution.
