1. Approve Regulations on procedure for issue to citizens of permissions when using radio-frequency range it (is applied).

2. Ceased to be valid

Regulations on procedure for issue to citizens of permissions when using radio-frequency range

Chapter 1. General provisions

1. This Provision establishes procedure for issue to citizens of permissions to operate of ship radio station, on right to use of radio-frequency range in case of operation of radio-electronic means of civil assignment of amateur and amateur satellite radio service (further - RES), permissions to the radio fan (Radio Amateur Licence).

2. In this Provision terms and their determinations in the values established by the Law of the Republic of Belarus of July 19, 2005 No. 45-Z "About telecommunication" and also the following terms and their determinations are applied:

amateur radio service – radio service for the purposes of self-improvement, the reciprocal radio communication and technical researches performed by the citizens having on this permission and who are engaged in radio engineering only from private interest without extraction of material benefit;

amateur satellite radio service – the radio service using the space stations established on satellites of Earth for the purposes of self-improvement, the reciprocal radio communication and technical researches performed by the citizens having on this permission and who are engaged in radio engineering only from private interest without extraction of material benefit;

operation of RES – the inclusion of RES leading to radiation in air in case of which density of flow of emitted capacity at distance of one meter from any of its elements exceeds 3 MW on square meter.

3. Operation of RES is performed in the presence of the permission issued by the State inspectorate of the Republic of Belarus for telecommunication of the Ministry of Communications and Informatization (the republican unitary enterprise for supervision of telecommunication of "BELGIE") (further – the State inspection) if other is not established by the legislation.

4. The application form, represented by the citizen for issue of the permissions provided in this Provision, and also forms of the permissions issued to BELGIE are established by the Ministry of Communications and Informatization.

5. The state inspectorate for the purpose of establishment of reliability of the documents and data provided by the citizen for issue of the permissions provided by this Provision can use documents and (or) data which are available in the State inspection, and also received from other state bodies, other organizations, the state registers, registers, inventories, lists, directories, bases and databanks.

6. In case of violation by citizens of requirements of the legislation the State inspection suspends or stops the permission issued to it. At the same time the State inspectorate does not bear damage liability which the citizen as a result of failure in issue of permission, suspension or cancellation of the permission issued to it can incur.

Chapter 2. Approval procedure on operation of ship radio station

7. The state inspection, having received the application and documents attached to it, checks the documents and data necessary for issue of the permission to operate of ship radio station, including compliance of such documents and data to decisions of the State Commission on Radio Frequencies under the Security Council of the Republic of Belarus (further – the Commission) about selection of bands of radio frequencies, radio-frequency channels or radio frequencies (in the presence of such decisions).

8. By results of consideration of documents and data the State inspectorate makes the decision on issue of the permission to operate of ship radio station or the decision on failure in issue of such permission.

In case of decision making about issue of the permission to operate of ship radio station the State inspection:

performs assignment of the international call sign, identification number of the ship station of satellite communication, opoznavately sea mobile service, number of the selective challenge of the ship station;

issues to the citizen the permission to operate of ship radio station;

sends to the International Telecommunication Union of the data on the issued permission to operate of ship radio station.

In case of decision making about failure in issue of the permission to operate of ship radio station the State inspection sends to the citizen the motivated notice of failure in issue of such permission.

The bases for failure to the citizen in issue of the permission to operate of ship radio station are determined according to subitem 2.12 of Item 2 of the Presidential decree of the Republic of Belarus of April 18, 2006 No. 240 "About payment for use of radio-frequency range", article 25 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures".

9. The permission to operate of ship radio station is terminated in case of suspension of state registration of the vessel in the State register of ocean ships of the Republic of Belarus (the ship book) or vessel exceptions of the specified register (the ship book). The State inspection within 10 working days informs the International Telecommunication Union on cancellation of the permission to operate of ship radio station.

Chapter 3. Approval procedure on right to use of radio-frequency range in case of operation of RES

10. No. 643 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 19.09.2019

11. The state inspection, having received the application and documents attached to it, checks:

compliance of documents and data to decisions of the Commission on selection of bands of radio frequencies, radio-frequency channels or radio frequencies (in the presence of such decisions);

compliance of parameters of the declared RES to technical requirements of technical regulatory legal acts, technical regulations of the Customs union and Eurasian Economic Union, obligatory for observance;

possibility of use of the declared RES only in bands of the radio frequencies distributed for amateur or amateur satellite radio service;

fact of issue and effective period of permission to the radio fan (Radio Amateur Licence);
