PRESIDENTIAL DECREE OF THE REPUBLIC OF BELARUS

of November 28, 2005 No. 551

About measures for traffic safety increase

(as amended on 30-12-2019)

For the purpose of enhancement of the organization of traffic, decrease in number of the road accidents and increase in culture of participants of traffic:

1. Approve the enclosed Traffic regulations.

2. Determine that:

2.1. training in control of the motorized vehicle of category "B" is made at least in three-months time according to the 220-hour single program of training of drivers of motorized vehicles of this category including at least 50 hours of training in driving;

2.2. it is excluded

2.3. since February 1, 2006 permissions to the admission of vehicles to participation in traffic are issued by the republican unitary service enterprise "Beltekhosmotr" for the place of passing of the state technical inspection of these vehicles if other is not established by legal acts;

2.4. since April 1, 2006 participation in traffic of vehicles with tinted glasses which degree of svetopropuskaniye does not conform to requirements of the Traffic regulations approved by this Decree (further - Rules) is forbidden;

2.5. since July 1, 2006 preparation, retraining, advanced training of drivers of motorized vehicles are performed only by legal entities who underwent obligatory certification in National system of confirmation of conformity of the Republic of Belarus;

2.6. since January 1, 2009:

the document confirming production of the motorized vehicle, trail car to it, the vehicle chassis in the Republic of Belarus is the passport of the vehicle (vehicle chassis) which is drawn up and issued by the organization (plant) - manufacturer of these vehicles (chassis) according to the procedure and in form, the approved Ministry of Internal Affairs together with the Industry ministry;

2.7. on delivery the motorized vehicle, trail car to it, the vehicle chassis made in the Republic of Belarus, to the consumer or to the place of state registration under the own steam by the organization (plant) - the manufacturer issues temporary number boards. Issue of such signs to the organizations (plants) - to manufacturers is provided with the Ministry of Internal Affairs according to requests of the Industry ministry according to the procedure, established by the Ministry of Internal Affairs together with the Industry ministry;

2.8. in case of sale in the territory of the Republic of Belarus by legal entities and individual entrepreneurs not made in the Republic of Belarus and earlier not registered in the Republic of Belarus of the motorized vehicle, trail car to it, to the vehicle chassis and their delivery to the acquirer or to the place of state registration under the own steam by the seller issue temporary number boards. Issue of such signs to sellers is provided according to their requests with the Ministry of Internal Affairs;

2.9. the form of temporary number boards, procedure for their installation and use affirm the Ministry of Internal Affairs.

3. To Council of Ministers of the Republic of Belarus:

3.1. till January 15, 2006:

in coordination with the President of the Republic of Belarus to adopt the regulatory legal act establishing requirements to activities for preparation, retraining, advanced training of drivers of motorized vehicles, having provided introduction of obligatory certification of these activities;

approve procedure for carrying out the state technical inspection of vehicles and their admission to participation in traffic, single programs of preparation, retraining, advanced training of drivers of the motorized vehicles and persons training to management of them and also to adopt the legal act according to subitem 2.2 of Item 2 of this Decree;

3.2. together with the State secretariat of the Security Council of the Republic of Belarus till April 1, 2006 to prepare and introduce to the President of the Republic of Belarus the draft of the Concept of safety control of traffic in the Republic of Belarus;

3.3. till June 1, 2006:

provide the organization of mass production of the retroreflective elements intended for designation of pedestrians in case of their movement by carriageway in night-time and informing the population on need of their application;

for the purpose of proper ensuring landing (disembarkation) of passengers on landing sites of stopping points to perform measures for reduction of their sizes in compliance with types and intervals of movement of route vehicles;

prepare and bring in accordance with the established procedure in the House of Representatives of the National assembly of the Republic of Belarus the bill providing modification and amendments in the Law of the Republic of Belarus of July 17, 2002 "About traffic" (The national register of legal acts of the Republic of Belarus, 2002, No. 85, 2/881) for the purpose of its reduction in compliance with this Decree;

provide reduction of other regulatory legal acts in compliance with this Decree and take other measures for its realization;

3.4. till September 1, 2006:

provide inclusion in training programs of organizations of education studying of Rules in volume of requirements imposed to pedestrians, passengers, drivers of bicycles, mopeds, horse drawn vehicles;

take measures for the universal equipment (re-equipment) at land crosswalks of islands of safety according to requirements of Rules.

4. To the Ministry of Internal Affairs:

till January 1, 2006 to determine the list of the islands of safety designated by means of lines of horizontal road marking;

exercise constant control behind safety control of traffic during the designing, construction, reconstruction, repair and road maintenance, road constructions, railroad crossings and technical means of the organization of traffic, determination of requirements to design and technical condition of the vehicles participating in traffic;

together with the Ministry of Transport and Communications, other interested state bodies it is permanent to perform identification of the reasons and conditions promoting abuse of regulations and making of the road accidents and to take timely measures on their elimination.

5. To the Ministry of Transport and Communications:

provide within number of hours, provided for preparation, retraining, Corrected advanced trainings of drivers of motorized vehicles, studying the citizens finishing training in control of these vehicles after December 15, 2005;

till June 1, 2006 to perform complex check of organization activity, performing preparation, retraining, advanced training of drivers of motorized vehicles, on their compliance to the requirements established by the legislation to these organizations;

together with the Ministry of Internal Affairs till July 1, 2006 for the purpose of increase in handling capacity of roads to conduct their examination by results of which to take measures for optimization of motion speed of vehicles on condition of observance of safety requirements of traffic.

6. To committee on standardization, metrology and certification under Council of Ministers of the Republic of Belarus till January 1, 2006 to take measures for increase in availability to physical persons and legal entities of technical regulatory legal acts in the field of traffic and ensuring its safety, including through the global computer Internet.

7. This Decree becomes effective since January 1, 2006, except for subitem 194.12 of Item 194 of Rules which becomes effective since April 1, 2006, and also Items 3-6 and this Item which are becoming effective from the date of official publication of this Decree.

Traffic regulations

Chapter 1. General provisions

1. These rules determine procedure for movement on roads of the Republic of Belarus.

2. In these rules the following main terms and concepts are applied:

2.1. the bus - the car with number of places for sitting more than nine, including driver's seat;

2.2. the car - the motorized vehicle having at least four wheels located at least on two axes, except for wheel tractors and self-propelled machines. Kvadritsikla (microcar) - the four-wheel motorized vehicles having drives of management of automobile type and weight in the equipped condition no more than 550 kilograms are equated to cars;

2.3. the road train - the structure of vehicles consisting of the car (the wheel tractor) and the trail car towed by it, the pole trailer, semitrailer truck (unless otherwise specified, further - trail car);

2.4. traffic safety - the traffic condition providing the minimum probability of emergence of danger to movement and the road accident;

2.5. the bicycle, the cycle mobile (further - the bicycle) - the vehicle, except for wheelchairs, set in motion by the muscular strength of the person(s) who is on (in) it;

2.6. bicycle lane – the isolated road or the road element allocated structurally or by means of lines of horizontal road marking intended for movement of drivers of bicycles (further – cyclists) designated by route sign "Bicycle lane";

2.7. visibility of the road - the maximum distance in driving direction on which from driver's seat it is possible to recognize elements of the road and technical means of the organization of traffic before the vehicle and is correct to be guided under management of it;

2.8. the driver – the physical person operating the vehicle, the self-propelled vehicle, except for person trained in control of the motorized vehicle, the self-propelled machine (the control of the motorized vehicle, the self-propelled machine taking qualification practice examination for the right). Are equated to the driver the person training to control of the motorized vehicle, the self-propelled machine (holding qualification practice examination for the right of control of the motorized vehicle, the self-propelled machine) and at the same time being in he (she), and also the rider, the driver of the cattle;

2.9. forced stop of the vehicle - traffic congestion of the vehicle because of its materiel failure or danger created by participants of traffic, the transported load, condition of the driver (passenger), emergence of the object obstructing traffic;

2.10. lawn - the land area with natural or artificially created vegetable, mainly grassy, cover;

2.11. the main road - the road designated by route signs "Main road", "Crossing with minor road", "Adjunction of minor road", "Highway" or "The road for cars" in relation to crossed (adjoining), is expensive with advanced covering in relation to the road without such covering, any road in relation to departures from the adjacent territories or living areas is expensive with gravel covering in relation to soil. Availability on minor road right in front of the intersection of the site with covering (advanced or gravel) does not do it equal on value with crossed;

2.12. the state technical inspection – set of the organizational and technical measures directed to non-admission to participation in traffic of vehicles, which are not conforming to requirements of the international legal documents concerning safety of wheel vehicles, equipment items and parts which can be established and used on wheel vehicles, to requirements of technical regulatory legal acts of the Republic of Belarus, obligatory for observance, in this sphere (further – technical regulatory legal acts);

2.13. the horse drawn vehicle - the vehicle set in motion by the muscular strength of animal (animals);

2.14. children are minor participants of traffic whose age is known or obvious on external signs to other participants of traffic;

2.15. the road - the complex of engineering constructions or strip of the earth intended and used for movement in accordance with the established procedure of vehicles and pedestrians;

2.16. path for riders - the earth strip intended for movement in accordance with the established procedure of riders, designated by route sign "Path for riders";

2.17. traffic - movement of pedestrians and (or) vehicles on the road, including the parking and stop within the road, and the related public relations;

2.18. the road accident - the incident made with participation at least of one motorized vehicle which was in movement as a result of which harm is done to life or health of physical person, its property or property of the legal entity;

2.19. the rail vehicle - the locomotive, electric train, diesel train, the railcar, other vehicle intended for public conveyance and loads on railway track;

2.20. railroad crossing - crossing of the road with railway tracks at one level;

2.21. the living area - the territory on which entrances and departures with which are designated by route signs "Living area" and "The end of the living area", and also the domestic territory adjacent to the housing estate;

2.22. the wheel tractor - the motorized vehicle for accomplishment of various technological transactions by means of hinged, semi-hinged and trailing machines or tools, and also for the drive of stationary machines or movement in structure with trail car;

2.23. the extreme right (left) position on the carriageway the vehicle dorogipolozheniye on the carriageway intended for movement in this direction which is not giving the chance of movement even of single-track vehicles respectively is more right (more to the left) in the passing direction;

2.24. maneuvering (maneuver) - start of motion, evolution of the vehicle in movement from one driving lane in another (further - evolution), and also its turn to the right or on the left, turn, congress from carriageway, movement by back run;

2.25. the route vehicle - the motorized vehicle (the bus, the trolleybus, the tram, other vehicle performing the movement in the regular regular, high-speed message, including express) moving along the established route with the designated stopping points;

2.26. the motorized vehicle - the vehicle set in motion by the engine;

2.27. the moped - the motorized vehicle set in motion by the engine with working volume up to 50 cubic centimeters and having the maximum constructive motion speed determined by its technical characteristic, no more than 50 km/h. Bicycles with outboard engine, mokik and other motorized vehicles with similar characteristics are equated to mopeds;

2.28. the motorcycle – the two-wheeled motorized vehicle with side trail car or without it, set in motion by the engine with working volume of 50 cubic centimeters and more. The three-wheeled motorized vehicles having weight in the equipped condition no more than 400 kilograms, and also the motorized vehicles equipped with the engine with working volume up to 50 cubic centimeters, having the maximum constructive motion speed determined by their technical characteristic, more than 50 km/h are equated to motorcycles;

2.29. the settlement - the territory on which entrances and departures with which are designated by route signs "The beginning of the settlement" and "The end of the settlement" or route signs "The beginning of border of the settlement" and "The end of border of the settlement";

2.30. insufficient visibility of the road - the visibility of the road in driving direction less than 300 meters caused by weather (meteorological) conditions (rain, snow and other precipitations) and other factors reducing transparency of the atmosphere (dust, smoke, fog, smog);

2.31. overtaking - the advancing of one or several moving vehicles connected with movement driving into the oncoming lane (the party of carriageway);

2.32. visibility of the road - objective opportunity to see road situation from driver's seat;

2.33. the designated intersection – the intersection before which on this road the route sign (signs) of priority is established;

2.34. roadside - the road element allocated structurally or firm line of horizontal road marking adjoining directly outer edge of the carriageway located with it at one level and not intended for movement of vehicles except the cases provided by these rules;

2.35. limited visibility of the road - the visibility of the road limited to geometrical parameters of the road, roadside engineering constructions, plantings and other objects, and also vehicles;

2.36. the single-track vehicle - the vehicle on wheels which are placed on one line one behind another;

2.37. danger to movement - the change of conditions of traffic or technical condition of the vehicle menacing to safety of participants of traffic, forcing the driver to reduce the motion speed or to stop;

2.38. advancing - movement of the vehicle with the speed exceeding speed in passing of the moving vehicle (vehicles);

2.39. organized pedestrian column - the group of pedestrians designated according to these rules, having the head and moving along certain route;

2.40. organized road convoy - the vehicle or road convoy moving with constantly turned on dipped head light of headlights accompanied by the vehicle (vehicles) of operational assignment with the included flashing signals (indicators) (further - indicators) blue or blue and red colors;

2.40-1. leaving of the place of road and transport incident action of the participant of the road accident, directed to the concealment of the fact of such incident or circumstances of its making which entailed need of conducting the State automobile inspection of the Ministry of Internal Affairs by employees (further - GAI) actions for establishment (search) of this participant and (or) search of the vehicle;

2.41. vehicle stop - deliberate traffic congestion of the vehicle for a while up to 5 minutes, and also more than for 5 minutes if it is necessary for landing (disembarkation) of passengers or loading (unloading) of the vehicle;

2.42. safety island - the technical tool of the organization of traffic at land crosswalks (if is not determined other, further - the crosswalk) which is structurally allocated over carriageway and intended as protective element for stop of pedestrians upon transition of carriageway. The site of lane line through which there passes the crosswalk belongs to island of safety. In the cases determined by the Minister of Internal Affairs designation of islands of safety by means of lines of horizontal road marking is allowed;

2.43. the eyewitness of the road accident - the physical person who was directly observing the road accident which has the relevant information also can provide it;

2.44. the passenger - the physical person, not privy to vehicle control, which is in (on) the vehicle, and also entering (sitting down) in (on) the vehicle or descending (landing) from the vehicle;

2.45. the intersection - the place of crossing, adjunction or branching of roads at one level. The border of the intersection is determined by the imagined lines connecting respectively opposite, the most remote from the center of the intersection of the beginning of curves of carriageways of roads. Are not intersections of crossing with bicycle, pedestrian walkways and paths for riders;

2.46. the pedestrian - the physical person participating in traffic out of the vehicle, including moving in wheelchair, on roller skates, skis, on other sports equipment, conducting the bicycle, the moped or the motorcycle, carrying the sledge or carriage, and not carrying out in accordance with the established procedure on the road repair and other work;

2.47. pedestrian walkway - the road element allocated structurally or by means of lines of horizontal road marking intended for movement of pedestrians designated by route sign "Pedestrian walkway";

2.48. the pedestrian zone - the territory intended for movement of pedestrians and cyclists on which entrances and departures with which are designated by route signs "Pedestrian zone" and "The end of the pedestrian zone";

2.49. the crosswalk - the site of the carriageway intended for movement of pedestrians through carriageway and the "Crosswalk" designated by route signs and (or) horizontal road marking;

2.50. driving lane - any of longitudinal strips of carriageway designated or not designated by horizontal road marking and having width sufficient for movement of vehicles (except for single-track) in one row;

2.51. benefit - the right to first-priority movement in the planned direction in relation to other participants of traffic;

2.52. obstacle for traffic - object which is on the way of the participant of traffic and forces it to reduce motion speed, to make detour or to stop;

2.53. the adjacent territory - the territory directly adjacent to carriageway which is not intended for the through passage in which the yards, the platforms specially allotted for the parking of vehicles, gas stations, building sites and other objects are located;

2.54. trail car - the vehicle intended for movement in structure with the motorized vehicle;

2.55. carriageway - the road element intended for movement of vehicles and in the cases provided by these rules - for movement of pedestrians;

2.56. the overpass - engineering construction over the road (railway tracks) which has congresses on other road, the providing movement at the different levels;

2.57. dividing zone - the road element allocated with horizontal road marking dividing adjacent carriageways and not intended for movement or stop of vehicles and pedestrians out of specially designated places;

2.58. lane line - the road element allocated structurally dividing adjacent carriageways and not intended for movement or stop of vehicles and pedestrians out of specially equipped and designated places;

2.59. the traffic controller - the employee of GAI performing regulation of traffic in equipment (uniform of the increased visibility with elements from retroreflective material, with staff and whistle). The employee of Military automobile inspection of Armed Forces of the Republic of Belarus in equipment is equated to the traffic controller (to uniform of the increased visibility with elements from retroreflective material, with disk with red signal (retroreflector) and whistle) when ensuring movement of organized road convoys which part the vehicles belonging to the Ministry of Defence, the Ministry of Internal Affairs, Committee for State Security, the State boundary committee, other troops and military forming of the Republic of Belarus are;

2.60. the self-propelled machine – the chain track tractor, farm, road, construction, other vehicle which without the additional security measures of traffic provided by the organization (plant) - manufacturer, are not intended for participation in traffic. With participation in traffic self-propelled machines are equated to vehicles, and their movement on roads shall be performed according to requirements of these rules imposed to vehicles if these Rules do not establish other concerning self-propelled machines;

2.61. the parking of the vehicle - deliberate traffic congestion of the vehicle more than for 5 minutes for the reasons which are not connected with landing (disembarkation) of passengers or loading (unloading) of the vehicle;

2.62. the tachograph – the equipment intended for installation on vehicles for the purpose of the indication or registration in the automatic or semi-automatic mode of these vehicles this about movement or about certain periods of work of their drivers;

2.63. night-time - period which begins after sunset and comes to an end with the sunrise;
