About elections of deputies of Majlis of Turkmenistan

Chapter I. General provisions

Article 1. Bases of the electoral system

According to the Constitution of Turkmenistan and this Law elections of deputies of Majlis (Parliament) are performed by citizens of Turkmenistan on the basis of general, equal and direct suffrage in case of secret vote and on the alternative beginnings.

Elections are held on single-candidate constituencies. One deputy of Majlis is elected from each constituency.

The electoral process is performed on the basis of free and equal promotion of candidates, publicity and openness, freedom of propaganda, equal opportunities for all candidates in holding the election campaign.

Term of office of deputies of Majlis - five years.

Article 2. Universal adult suffrage

The citizens of Turkmenistan who reached by the election day of 18-year age have to choose the right.

Any straight lines or indirect restrictions of the voting rights of citizens of Turkmenistan depending on nationality, origins, property and official capacity, floor, language, education, the relation to religion, political convictions, are forbidden party accessory.

The citizens recognized by court incapacitated, persons containing according to the court verdict in places of detention do not participate in elections.

Article 3. Equal suffrage

All voters participate in elections on an equal basis, each voter has one voice.

Article 4. Direct suffrage

Elections are straight lines, deputies of Majlis are elected citizens directly.

Article 5. Secret vote

Vote on elections is secret, control of declaration of will of voters is not allowed.

Article 6. Calling of an election

Elections of deputies of Majlis are appointed by Majlis of Turkmenistan not later than three months before the expiration of powers of deputies of Majlis.

In case of early dissolution of Majlis elections of deputies of Majlis are appointed by the President of Turkmenistan not later than three months before date of their carrying out. In this case the organization and elections are performed with observance of requirements of this Law.

The message on the election day is published in seal.

Article 7. Elections by the electoral commissions

Elections of deputies of Majlis are provided by the relevant electoral commissions which are formed of representatives of political parties, public associations, bodies of territorial public self-government and groups of citizens, the military personnel on military units.

Representatives in structure of the electoral commissions are pushed at meetings (conferences, plenums, councils) of velayatsky, etrapsky and city bodies of political parties, public associations, at meetings of their primary organizations; meetings of citizens who are convoked at the initiative of groups of citizens. The meeting of citizens is considered competent if at it there are at least 30 voters living in the territory of the constituency.

Article 8. Material security of elections

The expenses connected with preparation and elections of deputies of Majlis are made at the expense of the state. The procedure for use of funds for preparation and elections is established by the Central commission on elections and referenda in Turkmenistan.

Article 9. Responsibility for violation of the electoral law

Persons interfering by violence, deception, threats or other way to free implementation by the citizen of Turkmenistan of the right to choose and be the elected deputy of Majlis, to carry on election propaganda, and also the members of the electoral commissions who committed forgery of the selective documents, obviously wrong counting of votes or allowed other violations of this Law bear the responsibility established by the law. Also persons distributing in any manner obviously false and damaging evidence about the nominated candidate in deputies of Majlis are brought to responsibility.

In case of violation by the candidate of this Law district electoral commission can cancel the decision on its registration.

The statements for violations of the law of Turkmenistan for elections which arrived in the electoral commissions during preparation for elections or within 15 days after elections shall be considered in week time.

Chapter II. Constituencies and sites

Article 10. Formation of constituencies

For elections of deputies of Majlis 125 territorial constituencies with approximately equal number of voters are formed. Constituencies are formed by the Central commission on elections and referenda in Turkmenistan.
