About approval of the Federal aviation rules "Rules of Transportation of Dangerous Goods by Air Vehicles of Civil Aviation"

According to article 113 of the Federal Law of March 19, 1997 N 60-FZ "The air code of the Russian Federation" (The Russian Federation Code, 1997, N 12, Art. 1383; 1999, N 28, Art. 3483; 2004, N 35, Art. 3607; 2004, N 45, Art. 4377; 2005, N 13, Art. 1078; 2006, N 30, Art. 3290, Art. 3291; 2007, N 1 (h 1), Art. 29; N 27, of Art. 3213; N 46, of Art. 5554; N 49, of Art. 6075; N 50, of Art. 6239; Art. 6244; Art. 6245; "The Russian newspaper", 2008, N 153) and with Articles 32, 33 Conventions on International civil aviation for implementation of standards and recommended practice of International Civil Aviation Organization (Appendix 18 "Safe transportation of dangerous goods by air") order:

1. Approve the enclosed Federal aviation rules "Rules of Transportation of Dangerous Goods by Air Vehicles of Civil Aviation".

2. Not apply in the territory of the Russian Federation the order MGA USSR of November 30, 1990 N 277 "About distribution of action of Technical instructions for safe transportation of dangerous goods by air of ICAO on the air transportation of dangerous goods which are carried out by air vehicles of the USSR".

Federal aviation rules "Rules of Transportation of Dangerous Goods by Air Vehicles of Civil Aviation"

I. General provisions

1. These rules 33 Conventions on international civil aviation (Chicago, 1944) are drafted for implementation of standards and recommended practice of International Civil Aviation Organization according to article 113 of the Federal Law of March 19, 1997 N 60-FZ "The air code of the Russian Federation" *, Articles 32, (Appendix 18 "Safe transportation of dangerous goods by air") and extend to flights of the air vehicles of civil aviation (further - air vehicles) in airspace of the Russian Federation registered in the State register of civil air vehicles and (or) operated by the operators having the certificate (certificate) of the operator of the Russian Federation and also on ground handling operations of air vehicles at the civil airports (airfields) of the Russian Federation.

2. The authorized body in the field of civil aviation based on the decision can provide release from accomplishment of these rules provided that it will be done everything possible for achievement of equivalent level of safety of transportation of the dangerous goods by the air vehicle provided with observance of these rules and Technical instructions on safe transportation of dangerous goods by air (Doc 9284 AN/905 of ICAO) (further - Technical instructions).

3. The dangerous objects and substances creating threat for health of the person and safety of property or the environment, specified in the list of Technical instructions and which are classified according to Technical instructions (further - dangerous goods), are transported by air vehicles according to requirements of Technical instructions.

4. These rules do not extend to the dangerous goods necessary onboard the air vehicle according to requirements of the flight validity and service regulations, or for the special purposes specified in Technical instructions.

5. The products and substances classified as dangerous which are removed from the air vehicle for replacement or are intended for replacement of products and substances of the air vehicle for the purpose of recovery of its flight validity, are transported onboard the air vehicle according to these rules and Technical instructions.

6. Dangerous goods is transported by passengers or crew members of the air vehicle according to requirements of Technical instructions.

7. Requirements for ensuring aviation security to the consignors, operators and other persons providing transportation of dangerous goods by air vehicles are established by the Technical instructions and the Federal aviation rules "Requirements of Aviation Safety to the Airports" approved by the order of the Ministry of Transport of the Russian Federation of November 28, 2005 N 142 (it is registered by the Ministry of Justice of the Russian Federation on December 28, 2005, registration N 7321).

8. Dangerous goods is classified by degree of danger according to Technical instructions.

9. The dangerous goods prohibited by these rules and Technical instructions is not accepted for transportation by air vehicles.

10. Dangerous goods, marking are not accepted for transportation by air vehicles, danger signs and (or) packaging of which do not conform to requirements of Technical instructions.

11. Programs of training of specialists of the operator, the consignor and other persons specified in Technical instructions and participating in cargo sending, processing, packaging and transportation of dangerous goods by air vehicles are constituted, updated and affirm in accordance with the established procedure according to requirements of Technical instructions.

12. Control of execution of these rules is exercised by authorized body in the field of civil aviation.

II. Restrictions in transit dangerous goods air vehicles

13. Transportation of the dangerous goods by air vehicles, except as specified, specified in these rules and Technical instructions is forbidden.

14. Transportation of the dangerous goods by air vehicles specified in Technical instructions as prohibited for transportation by air vehicles in usual conditions, and the infected animals in the absence of release according to Item 2 of these rules or specifying in Technical instructions about possibility of transportation of dangerous goods according to release (permission) issued by the state of departure is forbidden (the state in the territory of which the dangerous goods was originally submerged aboard the air vehicle).

15. Transportation of the dangerous goods by air vehicles of any type specified in Technical instructions as prohibited for transportation by air vehicles under any circumstances is forbidden.

III. Packing of dangerous goods

16. Dangerous goods is packed and transported in packaging sets (reservoirs or other components or materials which are necessary for ensuring function on deduction of content) according to these rules and Technical instructions.

17. Requirements to packaging sets are specified in Technical instructions.

18. Packaging sets pass tests according to Technical instructions.

19. For transportation of liquid dangerous goods the packaging sets maintaining the value of pressure specified in Technical instructions are used.

20. Packaging sets are protected and supplied with laying and the absorbing materials not entering dangerous interaction with dangerous goods.

21. The packaging set is not reused until undergoes testing which established lack in it of corrosion or other damages.
