About questions of professional pension insurance

Based on Item 2 of Article 5 and item 4 of article 6 of the Law of the Republic of Belarus of January 5, 2008 "About professional pension insurance" the Council of Ministers of the Republic of Belarus DECIDES: No. 322-Z

1. Determine that in case of professional pension insurance according to the procedure and on the conditions determined by the Law of the Republic of Belarus "About professional pension insurance" are applied:

1.1. for the workers occupied full time at underground works, at works with especially harmful and especially severe conditions of work – the List of productions, works, professions, positions and indicators at underground works, at works with especially harmful and especially severe conditions of work in which employment grants pension entitlement on age for work with special working conditions (The list No. 1) approved by the resolution of Council of Ministers of the Republic of Belarus of May 25, 2005 No. 536;

1.2. for the workers occupied full time at works with harmful and severe conditions of work – the List of productions, works, professions, positions and indicators at works with harmful and severe conditions of work in which employment grants pension entitlement on age for work with special working conditions (The list No. 2) approved by the resolution of Council of Ministers of the Republic of Belarus of May 25, 2005 No. 536;

1.3. the operating results of the certification of workplaces under the terms of work which is carried out in the procedure established by the legislation are applied to the workers provided in the lists and the list specified respectively in subitems 1.1 and 1.2 of this Item and subitem 2.1 of Item 2 of this resolution.

2. Approve:

2.1. the list of textile productions and professions for the purposes of professional pension insurance of the workers of textile production occupied on machines and machines (is attached);

2.2. the list of positions of workers of flight and flight-test structures of civil aviation for the purposes of professional pension insurance (is attached);

2.3. the list of positions of the workers exercising direct control of flights of aircrafts of civil aviation for the purposes of professional pension insurance (is attached);

2.4. the list of works and positions for the purposes of professional pension insurance of workers of technical structure of civil aviation (is attached);

2.5. the list of work types for the purposes of professional pension insurance of cattle breeders and breeders (is attached);

2.6. the list of categories of actors of theaters and other theatrical and spectacular organizations, collectives of art creativity for the purposes of professional pension insurance (is attached);

2.7. the list of sports for the purposes of professional pension insurance of separate categories of the athletes performing activities in the sphere of professional sport (is attached);

2.8. the list of organizations, organizations and positions for the purposes of professional pension insurance of health and pedagogical workers (is attached);

2.9. the list of the sporting achievements giving to athletes from among members of national teams of the Republic of Belarus on sports the right to professional pension according to the paragraph the second subitem 1.9 of Item 1 of article 11 of the Law of the Republic of Belarus "About professional pension insurance" before achievement of generally established retirement age for 10 years (is attached);

2.10. the list of professions (positions) in which employment grants the right to professional pension according to the paragraph the second subitem 1.1 of Item 1 of article 11 of the Law of the Republic of Belarus "About professional pension insurance" before achievement of generally established retirement age for 15 and 20 years (is attached);

2.11. The regulations on criteria for evaluation of working conditions for separate employee categories and (or) features (types) of the performed works for the purposes of professional pension insurance and procedure for their application (are applied).

3. Professional pension insurance of the workers of textile production occupied on machines and machines is performed during the periods of direct accomplishment of works by them in the productions and professions provided by the list specified in subitem 2.1 of Item 2 of this resolution during full time (within its duration established by the legislation) and labor leave.

4. Professional pension insurance of the workers who are subject to this insurance on two or several bases, the stipulated in Article 5 Laws of the Republic of Belarus "About professional pension insurance" is performed on the basis for which the specified Law provides more preferential terms on duration of professional years of service and retirement age.

5. Authorize republican state bodies to exercise control of correctness of application of the lists and the Provision specified in subitems 2.2-2.9 and 2.11 of Item 2 of this resolution concerning category (categories) of workers in the sphere of regulation according to competence of body.

6. To republican state bodies to bring the regulatory legal acts into accord with this resolution and to take other measures necessary for its realization.
