About approval of the Regulations on procedure for calculation of professional years of service for determination of the right to early professional pension

According to Item 3 of article 11 of the Law of the Republic of Belarus of January 5, 2008 "About professional pension insurance" the Council of Ministers of the Republic of Belarus DECIDES: No. 322-Z

1. Approve the enclosed Regulations on procedure for calculation of professional years of service for determination of the right to early professional pension.

2. To make to Social Security Fund of the population of the Ministry of Labour and Social Protection explanations concerning calculation of professional years of service for determination of the right to early professional pension according to the legislation on professional pension insurance.

3. This resolution becomes effective since January 1, 2009.

Regulations on procedure for calculation of professional years of service for determination of the right to early professional pension

Chapter 1. General provisions

1. This Provision is developed according to Articles 11, 13 and 21 Laws of the Republic of Belarus of January 5, 2008 "About professional pension insurance" (further - the Law) and establishes procedure for calculation of professional years of service for determination of the right to early professional pension according to the Law.

2. In this Provision concepts and terms of the values determined by the legislation on professional pension insurance, on the individual (personified) accounting in system of the national social insurance and about provision of pensions are applied.

3. Calculation of professional years of service of insured person is made by Social Security Fund of the population of the Ministry of Labour and Social Protection (further - Fund) on the basis of data of the insurer (insurers) on the periods of work of this insured person in special working conditions and (or) occupations separate types of professional activity (further - work with special working conditions) for which fees on professional pension insurance, by summing of their duration with the accruing result are paid. At the same time each 30 days of professional years of service are accepted for complete month, each 12 months - for complete year. Data on professional years of service are created with the frequency established for the insurer (insurers) for submission of documents of the personified accounting in the PU-6, form and brought on professional part of individual personal account of insured person (daleeprofessionalny part of personal account).

The periods (period) of work after January 1, 2009 during which because of the employer certification of workplaces under the terms of work is not carried out join in professional years of service taking into account the authorized representative of labor union of the conclusion prepared by bodies of state examination of working conditions with participation by results of examination of working conditions on workplaces for establishment of the actual employment at works with special working conditions of the workers specified in subitems 1. 1, 1.2, 1.7 of Item 1 of article 5 of the Law, on condition of payment by the employer for these periods of fees on professional pension insurance.

Payment of fees on professional pension insurance is performed in the budget of state non-budgetary fund of social protection of the population of the Republic of Belarus (further - the budget of fund) according to the rates established by legal acts, in full taking into account the income from investment of funds of professional pension insurance.

4. Calculation of professional years of service from number of persons employed of flight and flight-test structure of civil aviation which positions are provided by the list of positions of workers of flight and flight-test structure of civil aviation for the purposes of professional pension insurance approved by Council of Ministers of the Republic of Belarus (further - the list of positions of workers of flight and flight-test structure) and also for operators of aircrafts of civil aviation is made for insured persons taking into account the features established by Chapter 2 this provision.

5. Calculation of professional years of service for determination of the right of insured person to early professional pension is performed in complete years and months based on the data on such years of service fixed on professional part of personal account.

6. In case of realization of the right of insured person to early professional pension the professional years of service are confirmed by the statement from professional part of personal account. The form of the statement is established by Fund.

Chapter 2. Features of calculation of professional years of service of separate categories of insured persons

7. The professional years of service of insured person from number of persons employed of aircrew of civil aviation, and also operators of aircrafts of civil aviation are determined on the basis of data of the insurer (insurers) on raid of hours from calculation:

7.1. complete month of professional years of service in each 20 hours of raid by planes in position (positions) of the member of flight crew of the aircraft, the operator (except hours of raid on accomplishment of aviation works);

7.2. complete month of professional years of service in each 12 hours of raid by planes (helicopters) in position (positions) of the member of flight crew of the aircraft, the operator in case of accomplishment of aviation works, flight and instructor and command aircrew.

8. The professional years of service of insured person from number of persons employed of flight-test structure of civil aviation are determined on the basis of data of the insurer (insurers) from calculation:

8.1. two years of professional years of service for each complete year of work as the worker of the flight-test structure which is directly carrying out test flights on regular workplaces;

8.2. two years of professional years of service for each complete year of work as the worker of the technical structure which is directly carrying out flights on testing (researches), delivery, acceptance of aircrafts, their systems, aggregates, devices and the equipment, in case of raid a year 120 and more hours or in case of raid at least 50 percent of the specified time if flights were carried out by helicopters;
