4. To the head of department of regulation of safety of nuclear installations Semenov O. F. in 10-day time after replication of Requirements and conditions to provide its mailing according to mailing calculation.

1.1. These Requirements and conditions are developed according to the Law of Ukraine "About allowing activities in the field of use of nuclear energy" and in pursuance of the resolution of the Cabinet of Ministers of Ukraine of December 6, 2000 N 1782 "About approval of the Procedure for licensing of separate types of activity in the field of use of nuclear energy".
1.2. Requirements and conditions are obligatory for the subjects of activities in the field of use of nuclear energy performing designing of nuclear installation or storage for burial of radioactive waste (further - storages).
1.3. To activities for designing of nuclear installation or storage works on development of the project documentation (and changes to her) on nuclear installation or storage, including all objects located on the platform of this nuclear installation or storage and technology with them connected concern.
1.4. The term "project documentation" is used in the value given in Appendix B of the State construction regulations "Designing. Structure, procedure for development, approval and approval of the project documentation for construction" DBN A.2.2-3-2004, approved by the order of the State Committee for Construction of Ukraine of January 20, 2004 N 8.
2.1. Activities for designing of nuclear installation or storage in the field of use of nuclear energy are allowed on condition of availability of the license granted according to the Procedure for licensing of separate types of activity in the field of use of nuclear energy approved by the resolution of the Cabinet of Ministers of Ukraine of December 6, 2000 N 1782.
2.2. The licensee performs the activities according to the current legislation of Ukraine and regulations, rules and standards for nuclear and radiation safety which list (taking into account specifics of activities) affirms the order on the company.
2.3. The licensee shall have organizational structure of the company with distribution of obligations, powers and responsibility of personnel.
2.4. The licensee shall have the financial provision sufficient for high-quality accomplishment of the planned amount of project works.
2.5. The licensee provides process of development of the project documentation technical (computing, multiplying), software, the corresponding regulating documentation necessary for accomplishment of the planned amount of project works.
2.6. The licensee shall have personnel of the corresponding qualification sufficient for high-quality accomplishment of the planned amount of works. Responsibility and requirements concerning qualification of personnel, including responsibility and requirements concerning qualification of those which perform the works influencing safety of nuclear installation or storage are established by the licensee.
2.7. The licensee provides training and examination of personnel of the company according to the Standard regulations on procedure for carrying out training and examination concerning labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of January 26, 2005 N 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for N 231/10511.
It shall be performed according to Regulations on procedure for test of knowledge by personnel of the company of regulations and rules on nuclear and radiation safety, according to the list of questions approved with Gosatomregulirovaniya of Ukraine with obligatory participation of his representative.
2.8. The licensee provides conducting special check of personnel for the purpose of provision of admissions to special works according to the Procedure for conducting special check for provision of the admission to physical persons to work on nuclear installations and with nuclear materials, approved by the resolution of the Cabinet of Ministers of Ukraine of December 25, 1997 N 1471.
2.9. The licensee provides information security which contains the state secret.
2.10. The licensee organizes planning, development, approval, enforcement of the project documentation and modification of it at all stages of work on designing and quality control, including accounting, the reporting, storage of the project documentation, provides conducting effective control of the project documentation.
2.11. The licensee implements and provides functioning of the quality system according to standards of series of GSTU ISO 9000.
2.12. The licensee bears responsibility for quality of the performed works and observance of requirements of the current legislation, regulations, rules and standards for nuclear and radiation safety by it. Specific conditions and limits of responsibility of the licensee and customer of project works make a reservation in the contract.
Any subject of activities in the field of use of nuclear energy, i.e. the legal entity (the company, organization or the organization of any form of housekeeping) or the physical person performing activities in the field of use of nuclear energy can be the customer of project works.
