About service in customs authorities of the Kyrgyz Republic

This Law determines procedure for service in customs authorities of the Kyrgyz Republic (further - customs authorities) as in the militarized law-enforcement structure of the state and basis of legal status of officials of customs authorities.

Chapter 1. General provisions

Article 1. Service in customs authorities

The service in customs authorities is type of public service of the citizens of the Kyrgyz Republic (further - citizens) performing professional activity on realization of functions, the rights and obligations of the customs authorities which are a part of the system of law enforcement agencies of the Kyrgyz Republic.

Article 2. The legislation of the Kyrgyz Republic on service in customs authorities

The legislation of the Kyrgyz Republic on service in customs authorities is based on the Constitution of the Kyrgyz Republic and consists of the legislation of the Kyrgyz Republic in the field of the customs affairs, this Law and other regulatory legal acts of the Kyrgyz Republic regulating procedure for service in law enforcement agencies.

Article 3. Officials of customs authorities

(Further - customs officers) only the citizens of the Kyrgyz Republic who do not have nationality of foreign state capable on the business and moral qualities, the education level and the state of health to carry out the tasks assigned to customs authorities of the Kyrgyz Republic can be officials of customs authorities.

Article 4. Employees of customs authorities

1. For the purpose of technical supply of activities of customs authorities the corresponding positions of civilian employees of customs authorities are provided in their staff lists (further - workers and employees). The list of the specified positions is determined by the head of authorized state body in the field of customs affairs.

2. Employment relationships of civilian structure (workers and employees) of customs authorities are regulated by the Labor code of the Kyrgyz Republic.

Article 5. Special ranks and positions of customs officers

1. To customs officers the following special ranks are given (further - special ranks):

1) ordinary Customs Service;

2) lance sergeant of Customs Service;

3) sergeant of Customs Service;

4) staff sergeant of Customs Service;

5) foreman of Customs Service;

6) ensign of Customs Service;

7) senior warrant officer of Customs Service;

8) second lieutenant of Customs Service;

9) lieutenant of Customs Service;

10) senior lieutenant of Customs Service;

11) captain of Customs Service;

12) major of Customs Service;

13) lieutenant colonel of Customs Service;

14) colonel of Customs Service;

15) major general of Customs Service;

16) lieutenant general of Customs Service;

17) colonel general of Customs Service.

2. The positions held by customs officers, and corresponding to these positions special ranks are subdivided into the following groups:

1) ordinary structure (ordinary Customs Service);

2) the younger commanding structure (the lance sergeant of Customs Service, the sergeant of Customs Service, the staff sergeant of Customs Service, the foreman of Customs Service, the ensign of Customs Service, the senior warrant officer of Customs Service);

3) the average commanding structure (the second lieutenant of Customs Service, the lieutenant of Customs Service, the senior lieutenant of Customs Service, the captain of Customs Service);

4) the senior commanding structure (the major of Customs Service, the lieutenant colonel of Customs Service, the colonel of Customs Service);

5) the highest commanding structure (the major general of Customs Service, the lieutenant general of Customs Service, the colonel general of Customs Service).

3. Lists of positions of customs officers younger, average and senior commanding structures and special ranks corresponding to these positions, and also qualification requirements to the customs officers holding the specified positions affirm the Government of the Kyrgyz Republic.

4. In case of dismissal of the employee of customs authority from service in customs authorities with the right to pension the words "in resignation" are added to special rank.

Chapter 2. Revenues to service in customs authorities

Article 6. Conditions of revenues to service in customs authorities

1. Arrival of citizens on service in customs authorities is voluntary and is performed on terms of the contract about service in customs authorities (further - the contract).

2. In customs authorities the citizens of the Kyrgyz Republic who do not have nationality of foreign state, ended the higher educational institutions conforming to requirements of article 6 of the Law of the Kyrgyz Republic "About public service" are employed 35 years meeting for the business and personal qualities the requirements determined by the customs legislation of the Kyrgyz Republic are not more senior:

to positions leading and the faculty - according to the decision of the head of authorized state body in the field of customs affairs, without restriction aged;

to positions of ordinary structure and the younger commanding structure - 30 years having working life at least two years are not more senior.

3. Positions of ordinary structure and the younger commanding structure of customs authorities are completed with persons capable on the education level, personal and business qualities, the state of health to carry out the obligations assigned to them.
