The protocol between the State Customs Committee of the Russian Federation and the State Customs Committee of Ukraine on customs clearance of transit cargoes

of July 21, 1992

The State Customs Committee of the Russian Federation and the State Customs Committee of Ukraine which are referred to as further "Contracting parties"

pursuing the aims of providing customs clearance of all transit cargoes,

agreed as follows:

Article 1

For the purposes of the this Protocol the terms below have the following value:

a) "loads" - the goods and other objects of business entities, unaccompanied baggage and vehicles of citizens acquired in the territory of one of Contracting Parties or in the territory of the third state;

b) "the third states" - the states which are not the Parties of the this Protocol.

Article 2

The loads imported from the third states into the Russian Federation or exported from the Russian Federation to the third states by en route through the territory of Ukraine are subject to customs clearance in the Russian Federation.

Article 3

The loads imported from the third states into Ukraine or exported from Ukraine to the third states by en route through the territory of the Russian Federation are subject to customs clearance in Ukraine.

Article 4

Transit cargoes are exempted from customs examination, except as specified, when there are bases to believe that they contain the goods prohibited to import, export and transit according to the legislation of Contracting Parties.

Article 5

Contracting parties mutually represent each other inventories, prohibited to import, export and transit through their territories.

Article 6

Contracting parties recognize stamps and customs providing each other and exchange their samples.

Article 7

The loads exported from the Russian Federation or from Ukraine to the third states by en route through the territories of each other and which are not drawn up by customs according to the Russian Federation or Ukraine are not allowed to the omission to the third states.

Contracting parties will inform each other on cases of detention of such loads for their possible registration of the state of departure by customs authorities.

Article 8

The loads imported into the Russian Federation or Ukraine from the third states by en route through each other territories go for customs clearance to customs of the state of appointment.

Article 9

The transit cargoes transported between customs of Contracting Parties are subject to customs clearance according to the procedure of customs clearance of transit cargoes.

Contracting parties will sign the Agreement on the procedure of customs clearance of transit cargoes and interaction of customs authorities in case of such registration within 2 months from the date of signing of the this Protocol.

Article 10

The this Protocol does not regulate questions of possible introduction of payment for transit of goods by all modes of transport, vehicles and services of commercial nature through the territories of Contracting Parties as the specified questions go beyond competence of Contracting Parties.

Article 11

Contracting parties mutually communicate about violations of provisions of the this Protocol.

Article 12

All matters of argument connected with accomplishment and interpretation of Articles of the this Protocol are solved by consultations between Customs Services of Contracting Parties.

Article 13

The this Protocol becomes effective from the date of its signing.

Any of Contracting Parties can refuse participation in the this Protocol in three months after the written notice of it of other Contracting Party.

It is made in Minsk on July 21, 1992 in duplicate in the Russian and Ukrainian languages, and both texts are equally authoritative.
