About approval of the Instruction about procedure for classification, investigation and accounting of transport emergency cases on inland waterways of the Republic of Belarus

Based on the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985 "Questions of the Ministry of Transport and Communications of the Republic of Belarus", the Ministry of Transport and Communications of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for classification, investigation and accounting of transport emergency cases on inland waterways of the Republic of Belarus.

2. Declare invalid the order of the Ministry of Transport and Communications of the Republic of Belarus of December 31, 1999 No. 250-Ts "About approval of the Regulations on procedure for investigation and accounting of transport emergency cases on inside navigable waters of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2000, No. 30, 8/3014).

3. This resolution becomes effective from the date of its official publication.

The instruction about procedure for classification, investigation and accounting of transport emergency cases on inland waterways of the Republic of Belarus

Chapter 1. General provisions

1. This Instruction determines procedure for classification, the organization, conducting investigation and accounting of transport emergency cases with inland navigation vessels, vessels of the swimming mixed (river sea) (further - vessels), their structures.

2. For the purposes of this Instruction terms in the values determined in article 1 of the Code of inland water transport of the Republic of Belarus are used.

3. Action of this Instruction extends to the transport emergency cases made by courts (vessel), their structures irrespective of pattern of ownership and also to cases of damage of rafts, ferry crossings, floating bridges, other floating objects (further - floating objects), shipping hydraulic engineering constructions, bridges, moorings, other engineering constructions on inland waterways of the Republic of Belarus (further - engineering constructions) or their parts courts (vessel), their structures.

4. Treat transport emergency cases:

4.1. the incident connected with movement and maneuvering of courts (vessel), their structures, which entailed at least one of the following effects:

causing bodily harms and (or) death one and more person;

damage, constructive destruction, flooding, death of courts (vessel), their structures, including owing to damage of their cases and loss of stability, and arisen with respect thereto losses;

damage, destruction of engineering constructions;

oil spills and oil products from courts (vessel);

traffic congestion of courts.

As traffic congestion of courts it is understood:

the termination (impossibility) of navigation on certain sites of inland waterway in connection with overlapping of the ship course by the courts (vessel), their structures, floating objects which sank or become on bank for the term of over 12 hours from the moment of approach to such sites of delivery vessels;

vessel idleness aground and other drying features (for passenger carriers - more than 12 hours, cargo ships - over 24 hours);

4.2. the incident connected with movement and maneuvering of courts (vessel), their structures, made owing to gross violation of rules of in-land navigation of the Republic of Belarus, other requirements for safety of navigation irrespective of effects;

4.3. collisions (blows), piles of courts, their structures irrespective of their effects;

4.4. the mechanical damages of courts (vessel) (cases, superstructures, ship devices, powerhelm units) received in case of removal of courts (vessel) from bank and in other cases provided that such damages require considerable, disproportionate to their actual value, costs for their elimination and are not connected with damage of courts (vessel) and their devices in the course of loading/unloading of courts (vessel) at moorings or when processing courts (vessel) on raid in port.

5. Do not treat transport emergency cases and action of this Instruction does not extend to the following incidents:

5.1. flooding, constructive destruction, damage of courts (vessel), their structures on parking, raids, under processing in ports, on repair or sediment, not connected with movement and maneuvering of courts (vessel), their structures;

5.2. the explosions and the fires in courts (vessel) which are not connected with collision of courts, blows and their piles on obstacles;
