About consumer protection

shortcoming - separate discrepancy of goods (work, service) to mandatory requirements of standards, conditions of agreements or usually qualifying standards, and also information on goods (work, service), provided by the manufacturer (the contractor, the seller);

the essential shortcoming - shortcoming which makes impossible or inadmissible use of goods (work, service) according to its purpose or cannot be eliminated concerning this consumer, or for its elimination big costs of work and time are required, or does goods (work, service) to others, than it is provided by the agreement, or is shown after its elimination again.

Section I. General provisions

Article 1. Consumer protection law

The legislation of Turkmenistan on consumer protection consists of this Law and other legal acts published according to it.

If the international treaty with Turkmenistan establishes other rules about consumer protection, then rules of the international treaty are applied.

Article 2. Law coverage

Operation of the Law extends to citizens entrepreneurs, the companies, the organizations and organizations irrespective of patterns of ownership, accessory and types of their activities, to citizens of Turkmenistan, citizens of other states and stateless persons in the territory of Turkmenistan.

Article 3. Obligations of the manufacturer, the contractor, the seller on quality assurance of goods (works, services) and possibilities of their use by the consumer

1. The manufacturer, the contractor, the seller shall:

make, sell to the consumer goods, transfer results of the performed work, render service, conforming on quality to mandatory requirements of standards, terms of the contract, and also information provided by them to the consumer about goods (works, services);

to timely provide to the consumer the necessary and reliable information about goods (works, services) providing possibility of their competent choice. By separate types of goods (works, services) the list and methods of bringing information to the consumer are established by the Cabinet of Ministers of Turkmenistan;

provide the companies with sign with indication of profile and forms of the organization of activities, trade name, legal address (the location of the owner of the company) and information on operating mode if trade and servicing are made out of the permanent location of trade enterprise, the company household and other types of servicing;

inform consumers on the applied rules of production, sales of goods, performance of works, rendering services;

provide without fail with the certificate goods (works, services).

Information on goods (works, services) without fail shall contain:

the name of standards to which mandatory requirements goods shall conform (works, services);
