According to Articles 29, 39 Laws of Ukraine "About protection of the rights to plant varieties" and the subitem 7 of Item 5 of the Regulations on Public service on protection of the rights to plant varieties approved by the resolution of the Cabinet of Ministers of Ukraine of August 19, 2002 No. 1182, we ORDER:
1. Approve the Procedure for import to Ukraine of prototypes of plant varieties for the purposes of examination on suitability on distribution of grade and export from Ukraine of landing material of plant varieties which is applied.
2. To public service on protection of the rights to plant varieties (Hadzhimatov V. A.) submit the order on state registration to the Ministry of Justice of Ukraine and publish it in the statement of Gossortsluzhby "Protection of the rights to plant varieties".
3. To impose control over the implementation of the order on the deputy minister of agrarian policy of Ukraine Melnik S. I.

1.1. This Procedure is developed according to Articles 29, 39 Laws of Ukraine "About protection of the rights to plant varieties" and the subitem 7 of Item 5 of the Regulations on Public service on protection of the rights to plant varieties approved by the resolution of the Cabinet of Ministers of Ukraine of August 19, 2002 No. 1182.
1.2. This Procedure extends on the physical persons and legal entity which are importing on customs area of Ukraine prototypes of plant varieties for the purposes of examination on suitability on distribution of grade and exporting landing material of plant varieties out of limits of customs area of Ukraine.
2.1. Prototypes of plant varieties which are imported into Ukraine for the purposes of examination on suitability on distribution of grade are not assessed with import duty and are not subject to quoting, licensing and certification and the state sanitary and hygienic examination. Quarantine survey of these samples is performed on bezoplatny basis.
2.2. Their customs clearance is performed without certificates of conformity based on documentary confirmation of Gossortsluzhby that these samples are imported for conducting examination on suitability on distribution of grade.
2.3. Documentary confirmation of Gossortsluzhby is the notice on import of prototypes for examination on suitability on distribution of grade (appendix 1) which is issued by Gossortsluzhboy to the physical persons and legal entities which submitted the application for grade, or to persons authorized by them and is applied to documents for customs clearance.
3.1. Export out of limits of customs area of Ukraine of the landing material which is the material carrier of grade which is object of intellectual property right is performed based on permission of the owner of the patent for the corresponding plant variety about what Gossortsluzhba issues documentary confirmation (appendix 2) according to the appeal of the physical persons or legal entities which are exporting landing material. Permission of the owner of the patent for plant variety and documentary confirmation of Gossortsluzhby moves the physical persons and legal entities which are exporting landing material, or persons authorized by them to customs authority for customs clearance.
3.2. Export out of limits of customs area of Ukraine of the landing material which is the material carrier of grade which is not object of intellectual property right is performed based on documentary confirmation of Gossortsluzhby (appendix 3) which is issued according to the appeal of the physical persons or legal entities which are exporting landing material. Confirmation of Gossortsluzhby moves the physical persons and legal entities which are exporting landing material, or persons authorized by them to customs authority for customs clearance.
