About approval of the Instruction about record keeping on the petitions of physical persons and legal entities submitted to state bodies on the companies, in organizations and the organizations of the Republic of Moldova

In pursuance of the Law of the Republic of Moldova N 190-XIII of July 19, 1994 "About submission of petitions"

The government of the Republic of Moldova DECIDES:

1. Approve the Instruction about record keeping on the petitions of physical persons and legal entities submitted to state bodies on the companies, in organizations and the organizations of the Republic of Moldova it (is applied).

2. To provide to bodies of the central and local public authority record keeping according to petitions of physical persons and legal entities with all the subordinated or located in their territory organizations according to the Instruction approved by this resolution.

3. Declare invalid the Resolution of Council of Ministers of the Moldavian SSR N 41 of February 5, 1982. "About approval of the Instruction about record keeping on offers, statements and claims of citizens in the ministries, the state committees, departments, executive committees of Councils of People's Deputies, at the companies, in organizations and the organizations of the Moldavian SSR" (Sheets of the Supreme Council and the Government of the Moldavian SSR, 1982, N 3, the Art. 27).

The instruction about record keeping on the petitions of physical persons of legally created organizations submitted to state bodies on the companies, in organizations and the organizations of the Republic of Moldova

I. General provisions

1. This Instruction establishes single procedure for deloproivodstvo during the accounting and consideration of petitions of the physical persons and legal entities given on behalf of collectives which they represent in written or electronic form, and also control of the course of their consideration and acceptance of applicants in state bodies, at the companies, in organizations and the organizations (further - bodies).

This Instruction does not extend to record keeping according to petitions which procedure for consideration is provided by the criminal procedure legislation, the legislation on enforcement proceeding, the legislation on administrative offenses and the labor law.

2. The clerical work according to the petitions addressed by physical persons in the organization is conducted separately from other types of clerical work.

Heads of bodies, structural divisions and workers of their management personnel shall take necessary measures for observance of this instruction. If necessary they exercise control of record keeping and take measures for enhancement of these activities.

3. Accounting, registration, consideration of petitions, control of execution and storage of petitions, the organization of acceptance of applicants in bodies is assigned to office, structural divisions, the secretary or the official designated for this purpose (further - office).

4. In case of dismissal of persons responsible for record keeping for petitions, put with petitions and the corresponding materials are transferred under the act.

Again accepted workers shall know requirements of the Law of the Republic of Moldova N 190-XIII of July 19, 1994 "About submission of petitions" and this Instruction.

II. Accounting of petitions

5. The petitions which arrived in bodies are registered on a centralized basis on the same day office on registration and control cards of the A5 and A6 format (appendices N 1, 2 and 3).

Information on the arrived petitions is entered into computer databank according to prototype of registration and control card of the screen according to registration number where the computer is used and the electronic option is registered in electronic archive of body.

Envelopes in which there were petitions remain in cases when they can be used for establishment of the address of the sender or when the postage stamp is necessary for confirmation of date of departure and receipt of the petition.

According to the petitions accepted during acceptance the same order of registration is established and the electronic version of the petition is stored 3 years in the database of electronic archive of body.

The petition submitted electronically shall conform to requirements to the electronic document and the digital signature according to the current legislation.

In the petition surname, the name, the residence and the e-mail address of the applicant are electronically entered

6. In case of registration of petitions on the first page the registration stamp is put down (appendix N 4) in which receipt date of petitions and registration index is specified.

The registration index consists of initial letter of surname of the author of the petition, sequence number and year of registration of the petition (for example, D-404/04). The registration index shall be constituted or added with other designations providing systematization and safety of petitions, promoting their selection and the analysis.

7. The next registration index is, as a rule, appropriated to repeated petitions, and in the corresponding column of registration control card the registration index of the first petition is specified. In the right upper corner of repeated petitions and on registration and control cards the mark "Repeatedly" becomes and all prior correspondence is selected.

The petitions which arrived from the same person in which the same question is brought up are considered as repeated if since submission of the first petition the term of consideration established by the legislation expired and the applicant did not receive the answer or is not satisfied with the answer given it.

8. The petitions of person on the same question sent to various addressees and which arrived for consideration in the same organization are registered under index of the first petition with addition of the sequence number which is put down through fraction (for example, D-401/3) D-401/1, D-401/2,.

9. On each petition the registration and control card in duplicate is filled by hand. The first copy of card is located in information card-index in alphabetical order or on subject of questions of the petition, and the second copy - in control card-index on completion dates. If registration and control cards are located in information card-index on subject of the questions raised in petitions it is recommended to use alphabetic cards in addition (appendix N 5) which shall be located in card-index in alphabetical order. For the purpose of simplification of selection of cards index can be used.
