About approval of the Procedure for cross-border transportation of dangerous wastes
For the purpose of ensuring execution of Item 1.7 of the Presidential decree of the Azerbaijan Republic of July 31, 2007 "About application of the Law of the Azerbaijan Republic "About modification and amendments in the Law of the Azerbaijan Republic "About production and domestic waste" the Cabinet of Ministers of the Azerbaijan Republic decides No. 609:
1. Approve "Procedure for cross-border transportation of dangerous wastes" it (is applied).
2. This Resolution becomes effective from the date of signing.

1.1. This Procedure regulates import on the territory of the Azerbaijan Republic, export and transit transportation of dangerous wastes for the purpose of their use.
1.2. Import to the Azerbaijan Republic of dangerous wastes which safe conversion is impossible for the purpose of their transit transportation, burial and neutralization is prohibited.
1.3. Cross-border transportation of dangerous wastes is performed in accordance with the terms, stipulated by the legislation the Azerbaijan Republic and international treaties which it joined.
1.4. Export of dangerous wastes from the territory of the Azerbaijan Republic to the country which is not the member "The Basel Convention on the Control of Trans-boundary Movement of Hazardous Wastes and their removal" is forbidden (further - the Basel convention) (except as specified agreement signatures between said country and the Azerbaijan Republic about cross-border transportation of dangerous wastes).
2.1. Import, export and transit transportation to the Azerbaijan Republic for conversion, burials or storages of dangerous wastes is performed according to international agreements taking into account requirements of the Law of the Azerbaijan Republic "About environmental impact assessment".

2.12. The physical persons and legal entities transporting in the established form the Ministry of Ecology and Natural Resources of the Azerbaijan Republic warns about date of completion of cross-border transportation of dangerous wastes. The Ministry of Ecology and Natural Resources of the Azerbaijan Republic based on the specified prevention provides information on it to the relevant authorities of the states participating in transportation of waste.
2.13. The Ministry of Ecology and Natural Resources of the Azerbaijan Republic keeps in the procedure established by the legislation the state account and the reporting under import of dangerous wastes on the territory of the Azerbaijan Republic, to their export and transit transportation.

3.1. Cross-border transportation of dangerous wastes can be performed by the cars specialized and meeting the requirements of the relevant legislation, railway, sea, river, air transport.
3.2. The parties which are taking part in cross-border transportation of dangerous wastes (the owner (owner) of waste, carrier of waste and person responsible for waste discharge) shall transport, preventing (or minimizing) their negative impact on the environment and health of the person. 3.3. 3.5. In case of any emergency situation in transit of dangerous wastes, the operative communication with carrier shall be established. 4.1. Export of dangerous wastes from the Azerbaijan Republic is not allowed without the consent of the state importing waste or the states participating in transit of waste.
4.2. Cross-border transportation of dangerous wastes is recognized illegal the following cases:
* in case of the non-notification of the states interested in cross-border transportation of dangerous wastes about transportation of waste;
