About approval of the Technique of shortchanging of payment for joint use of technology power networks

According to the Law of Ukraine "About power industry", the Regulations on the National commission of regulation of power industry of Ukraine approved by the Presidential decree of Ukraine, of 14.03.95 N 213 (with changes), and on accomplishment of the order of the Cabinet of Ministers of Ukraine of 20.06.2007 of N 452-p "About fee streamlining which are provided by owners of power networks" the National commission of regulation of power industry of Ukraine DECIDES:

1. Approve the Technique of shortchanging of payment for joint use of technology power networks which is applied.

2. This resolution becomes effective since January 1, 2009.

3. In accordance with the established procedure to provide to department of regulation of the relations of licensees with consumers submission of this resolution on state registration in the Ministry of Justice of Ukraine.

Technique of shortchanging of payment for joint use of technology power networks

I. General provisions

1.1. This Technique establishes methodology of shortchanging of cost of reasonable maintenance costs of technology power networks of joint use, including procedure for creation of expense budget of owners of networks on content of their technology power networks, procedure of payments of amount of processing equipment of power networks in conventional units of the electrotransferring organizations in the territory of which implementation of licensed activities electroinstallations of owners of networks, and owners of networks, procedure for determination of standard rates of expenses on conventional unit and expense allocations on content of networks between subjects of managing which use networks, on the parts answering to payment for joint use of appropriate subject of managing are attached.

The technique is obligatory for application by all legal entities and physical persons which have contractual relations of rather joint use of technology power networks.

1.2. In this Technique the stated below terms and determinations are used in such value:

the owner of networks - legal entity or physical person which possesses on the property right or uses technology power networks and which has no license for the right of implementation of business activity on transfer of electrical energy;

complete transformer substation (further - KTP) the substation constituted from cases or blocks with built in in them by the transformer and other equipment of distribution installation which is delivered collected or prepared for assembly;

the standard rate of expenses on conventional unit - the relation of reasonable maintenance expenses of power networks of the electrotransferring organization to the numerical characteristic of these networks for amount of conventional units;

amount of technology power networks - the numerical characteristic of technology power networks of appropriate subject of managing in conventional units which displays specific operating expenses and content of power networks;

radio stations of systems of very high frequency and short waves (dalsheradiostantion of the VHFs and QUARTER systems) - one or several radio transmitters or radio receivers or set of radio receivers and radio transmitters together with the service equipment which provide radio service on very and short radio waves;

distribution (electric) point (further - RP) the electric distributing device which is not part of substation;

transformer substation (further - TP) - the electric substation intended for transformation of electrical energy of one tension to energy of other tension by means of transformers.

Other terms and determinations are used in this Technique in the value established by the Instructions for use electrical energy approved by the resolution NKRE of 31.07.96 N 28 (in edition of the resolution NKRE of 17.10.2005 of N 910), registered in the Ministry of Justice of Ukraine 02.08.96 for N 417/1442 (further - PPEE).

1.3. Expenses of the owner of networks are determined concerning those power networks which are used by the owner of networks together with other user and are allocated on the unilinear scheme which is the integral appendix to the agreement on joint use of technology power networks.

1.4. The list of operating expenses which join in expense budget on content of technology power networks of joint use of the owner of networks is determined according to the Section II "Procedure for creation of the estimate of reasonable annual expenses of the owner of networks on content of power networks of joint use" of this Technique by the form given in appendix 1.

1.5. The owner of networks shall provide management of activities for content of technology power networks of joint use by the principle of economic feasibility and for the purpose of achievement of optimum cost of services for their users.

1.6. In case of non-compliance with parameters of quality of electrical energy and decrease in reliability of electric utility service as a result of inadequate content of technology power networks of joint use the owner of these networks is responsible according to the legislation of Ukraine and terms of the contract on joint use of technology power networks, concluded according to PPEE.

1.7. The owner of networks shall keep separate financial accounting of the expenses connected with content and operation of technology power networks of joint use.
