Chapter 1. General provisions

Article 1. The main terms applied in this Law and their determinations

1. Accreditation of the journalist of mass media – confirmation of the right of the journalist of mass media to cover the actions organized by state bodies, political parties, other public associations, other legal entities and also other events which are taking place in the territory of the Republic of Belarus and beyond its limits.

1-1. Broadcasting of TV or radio program – distribution by the legal entity to which functions of editorial office of mass media, or the foreign organization of TV or radio program independently or with use in the procedure for networks of telecommunication of the operator of telecommunication established by the legislation are assigned.

2. Type of mass media – the newspaper, the log, the bulletin, radio - the TV, video, film chronicle program, online media, other set of information messages and (or) materials (transfers) having periodic character and intended for the indefinite group of people.

3. The video, film chronicle program, radio - TV program – set of audio-, audiovisual messages and (or) materials (transfers), audiovisual works, radio - telecasts, having the permanent name and having periodic character.

3-1. The owner of Internet resource – the legal entity or physical person, including the individual entrepreneur exercising rights of possession, uses and (or) orders of Internet resource.

3-2. The owner of the news aggregator - the legal entity, the individual entrepreneur exercising rights of possession, uses and (or) orders of the news aggregator.

3-3. The owner of online media - the owner of the Internet resource which underwent state registration according to the procedure, established by this Law.

4. Release of mass media – issue of printing mass media, the mass media extended through global computer network the Internet including online media, or broadcast of television, broadcasting mass media.

5. It is excluded.

6. The journalist of foreign mass media – the physical person who is engaged in collection, editing and creation (preparation) of information messages and (or) materials for the legal entity to who functions of editorial office of the mass media registered outside the Republic of Belarus are assigned, connected with this legal entity employment relationships and having accreditation in the Republic of Belarus.

7. The journalist of mass media – the physical person who is engaged in collection, editing and creation (preparation) of information messages and (or) materials for the legal entity to who functions of editorial office of mass media are assigned, connected with this legal entity employment or other contractual relations.

8. Foreign mass media – the mass media created outside the Republic of Belarus according to the legislation of foreign state the foreign physical person and (or) the foreign organization which location is not the Republic of Belarus.

8-1. Internet resource – the website, the page of the website, forum, the blog, appendix for the mobile device, other information resource (its component) placed in global computer network the Internet by means of which mass information extends.

9. News agency – the legal entity who is performing collection, creation (preparation), storage of information messages and (or) materials and their distribution in mass media and having at the same time the status of the legal entity to who functions of editorial office of mass media, and the distributor of products of mass media are assigned.

10. Correspondent office – separate division of the legal entity to which functions of editorial office of mass media are assigned and which performs collection, storage and creation (preparation) of information messages and (or) materials for these mass media, and also distribution of its products.

11. Mass information – the printing, audio-, audiovisual and other information messages and (or) materials published in the seals reported by means of broadcasting of TV or radio program, Internet resource or in other form of distribution intended for the indefinite group of people.

11-1. Monitoring of mass information – process of collection and information analysis, containing in products of mass media, on Internet resource, for the purpose of compliance with law assessment about mass media.

12. Unreliable information – the untrue information messages and (or) materials spread by mass media, Internet resource.

12-1. Obligatory public packet of TV programs – the list of TV programs obligatory for distribution of telecommunication by operators, service providers of telecommunication in the territory of the Republic of Belarus.

12-2. News materials - the information messages and (or) materials containing information on the current questions in economic, political, social, scientific and technological, ecological, military and other spheres of life activity of the state and society.

12-3. Obligatory public packet of TV programs - the list of TV programs obligatory for distribution by distributors of products of television mass media in the territory of the Republic of Belarus.

13. Frequency of mass media – release of mass media certain number of times through certain period.

14. Printing mass media – the newspaper, the log, the bulletin, other edition having the permanent name, sequence number, end-to-end numbering of pages and which are published at least once in six months.

15. Products of mass media – the circulation (part of circulation) of separate number of printing mass media, separate release of radio - the TV, video, film chronicle program, the circulation or part of circulation audio-or videos of the program, and also information messages and (or) materials spread by means of online media.

16. No. 213-Z is excluded according to the Law of the Republic of Belarus of 20.12.2014

17. Broadcasting mass media – the radio program extended with use of networks of telecommunication at least once in six months.

18. Distribution of products of mass media – sale, subscription, delivery of printing mass media, audio-or videos of programs, broadcasting and relaying of radio - TV programs, demonstration of film chronicle programs, other form of bringing mass information to general data, including by means of Internet resource, online media, the news aggregator.

19. The distributor of products of mass media – the legal entity, the individual entrepreneur performing distribution of products of mass media according to the procedure, established by the legislation, and also the legal entity or physical person, including the individual entrepreneur which is the owner of Internet resource, the owner of online media, the owner of the news aggregator in case of distribution of products of mass media by means of Internet resource, online media, the news aggregator.

19-1. Online media – the Internet resource which underwent state registration according to the procedure, established by this Law.

20. Mass media – form of periodic distribution of mass information with use of seal, broadcasting of TV or radio program, global computer network the Internet, and also online media as form of distribution of mass information with use of global computer network the Internet.

21. Subjects of legal relationship in the field of mass information – republican state body in the field of mass information, public coordination council in the field of mass information, the founder (founders), the editor-in-chief, the journalist of mass media, the legal entity to who functions of editorial office of mass media, and also news agency, correspondent office, the distributor of products of mass media, the owner of Internet resource, the owner of online media, the owner of the news aggregator are assigned.

22. No. 213-Z is excluded according to the Law of the Republic of Belarus of 20.12.2014

23. Television mass media – TV program extended with use of networks of telecommunication at least once in six months.

24. The founder (founders) of mass media – physical person or legal entity, state body, independently or together with other physical persons or legal entities the mass media which made the decision on creation and addressed for its state registration.

25. The physical person – the citizen of the Republic of Belarus, the foreign citizen, the stateless person.

26. The legal entity to who functions of editorial office of mass media are assigned – the legal entity of the Republic of Belarus performing production and release of mass media based on the decision of the founder (founders) of mass media (further – the decision on the editorial office of mass media) or if the specified legal entity is not founder of mass media or is one of cofounders, based on the agreement of this legal entity with the founder (founders) of mass media (further – the agreement on the editorial office of mass media).

Article 2. Legal regulation of the relations in the field of mass information

1. The relations in the field of mass information are governed by the legislation on mass media, international treaties of the Republic of Belarus, and also the international legal acts constituting the right of the Eurasian Economic Union.

2. The legislation on mass media is based on the Constitution of the Republic of Belarus and consists of this Law and other acts of the legislation.

Features of legal regulation of the relations regulated by this Law can be established by the president of the Republic of Belarus.

3. If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 3. Coverage of this Law

1. Operation of this Law extends to mass media, including the online medias established in the Republic of Belarus and also to foreign mass media in the part concerning them activities in the territory of the Republic of Belarus and (or) distribution of their products in the territory of the Republic of Belarus.

2. If this Law does not provide other, its action (except requirements about state registration of mass media) extends to Internet resources by means of which mass information extends.

Article 4. Basic principles of activities of mass media

The basic principles of activities of mass media are:

accuracy of the information – mass media shall distribute information untrue;

legality – information shall not contradict requirements of the legislation;

equality – mass media proceed from equal rights of all physical persons, state bodies, political parties, other public associations, other legal entities on distribution and receipt of mass information;

respect of human rights and freedoms – mass media provide observance of the human rights and freedoms guaranteed by the Constitution of the Republic of Belarus and other acts of the legislation;

variety of opinions – mass media provide free expression and distribution of different opinions and views in society;

development of national culture – mass media facilitate distribution and dissemination of national cultural values;

protection of morality – mass media shall not allow distribution of information encroaching on regulations of public morality;

observance of regulations of professional ethics of journalists and generally accepted standards of morality – journalists of mass media in the activities shall respect strictly the rules of professional ethics and generally accepted standards of morality.

Article 5. Freedom of opinions, beliefs and their free expression

In the Republic of Belarus freedom of opinions, beliefs and their free expression are guaranteed to everyone.

Article 6. Inadmissibility of monopolization of mass media

Monopolization of mass media by the state, the organizations or certain citizens is not allowed.

Article 7. Inadmissibility of illegal restriction of freedom of mass information

Illegal restriction of freedom of mass information which is expressed is not allowed:
