Regulations on implementation of activities for installation, operation, management, support and/or liquidation of networks of electronic communications on frontier of the Republic of Moldova

1. The regulations on implementation of activities for installation, operation, management, support and/or liquidation of networks of electronic communications on frontier of the Republic of Moldova (further - the Provision) determine procedure for construction, carrying out prospecting works for designing, reconstruction or liquidation (withdrawal from operation and dismantle) networks of electronic communications or separate constructions and means of electronic communications, and also their operation and support, in cases when networks of electronic communications cross frontier of the Republic of Moldova or are placed in borderland.

2. Activities in the field of electronic communications on frontier of the Republic of Moldova are regulated by the Law on electronic communications N 241-XVI of November 15, 2007, the Law No. 215 of December 28, 2011 on frontier of the Republic of Moldova, international treaties which party is the Republic of Moldova, and also this Provision (the daleeustanovlenny mode).

3. Implementation of activities for installation, operation, management, support and/or liquidation of networks of electronic communications shall not do harm to health of the population, the environment or homeland security of the Republic of Moldova and foreign states, adjacent with it, to create noises to content of frontier of the Republic of Moldova and accomplishment of tasks of the General inspectorate of Boundary police, to pose threat for safety of flights of aircrafts, to operation and content of engineering constructions, including earlier established networks of electronic communications, and also integrity, reliability of functioning and safety of networks of electronic communications of the Republic of Moldova.

4. In case of passing of network of electronic communications on borderland without intersection of frontier of the Republic of Moldova the action area of the mode set by this Provision includes section of network of electronic communications between points of its intersection of inner boundary of borderland.

For networks of electronic communications in boundary waters the action area of the set mode extends to all route of networks of electronic communications which is in the Moldavian part of boundary waters.

5. The supplier of networks (further - the applicant) who intends to perform activities for installation, operation, management, support and/or liquidation of networks of electronic communications on frontier of the Republic of Moldova shall get permission from the National agency on regulation in the field of electronic communications and information technologies (daleeagentstvo) according to the procedure provided by the Law on electronic communications N 241-XVI of November 15, 2007.

6. The applicant who intends to carry out installation works of networks of electronic communications in border zone in 7 days prior to activities gives notification to which the following documents are attached to the Agency:

a) card of the description abstraction of the designed network;

b) copies of the agreements signed with owners of land of either other real estate objects, or the resolution of degree of jurisdiction;

c) copies of the conclusions of Service of information and the safety, the General inspectorate of Boundary police, the State ecological inspection, the town-planning certificate and the construction license issued by bodies of local public authority in the territory of which activities implementation is planned (further - the coordinating bodies);

d) the project of networks of electronic communications which cross frontier, approved and approved according to the Law on quality in construction No. 721-XIII of February 2, 1996, and geographical coordinates of the area of work;

e) the expert opinion on Sections of the single project relating to networks of electronic communications in case of designing of networks of electronic communications as a part of the single project with other networks of infrastructure.

6-1. The applicant who intends to perform activities for installation, management and/or operation of network of electronic communications in border areas represents to the Agency the notification not later than 7 days prior to activities to which the following documents are attached:

a) card of the description abstraction of the established network;

b) the scheme of the network of electronic communications established in border zone, accompanied with the analytical description and specifying of the used equipments and cables, addresses and geographical coordinates of their location;

c) copies of protocols on acceptance of the complete works on installation performed according to provisions the Law No. 721-XIII of February 2, 1996;

d) copies of the conclusions of Service of information and safety, Generalnyy inspectorate of Boundary police, State ecological inspection and bodies of local public authority of the respective area.

6-2. The supplier of network electronic communications which plans to perform activities for liquidation of the network of electronic communications established in border zone represents to the Agency the notification not later than 30 days prior to the specified activities to which the following documents are attached:

a) the declaration under the personal liability on carrying out necessary measures for quality assurance and continuity of provision of services of the electronic communications provided to ultimate users in connection with the subsequent liquidation of this network;
