About approval of the Regulations on procedure for technical investigation of the reasons of accidents and incidents on hazardous production facilities

In pursuance of the Law of the Republic of Belarus of January 10, 2000 No. 363-Z "About industrial safety of hazardous production facilities" and resolutions of Council of Ministers of the Republic of Belarus of May 29, 2000 No. 774 "About implementation of the Law of the Republic of Belarus "About industrial safety of hazardous production facilities" (2000, No. 54, 5/3294) the Ministry of Emergency Situations of the Republic of Belarus decides the national register of legal acts of the Republic of Belarus:
1. Approve the enclosed Regulations on procedure for technical investigation of the reasons of accidents and incidents on hazardous production facilities (further - the Provision).
2. Recognize invalid Regulations on technical investigation of the reasons and accounting of the accidents which did not entail accidents, on the objects under control to the Promatomnadzor, approved by the Ministry of Emergency Situations of the Republic of Belarus of February 27, 1998. (Bulletin of normative legal information, 1998, No. 11; it is registered in the Register of state registration 09.04.1998 No. 2412/12), Standard regulations on investigation and accounting of the not categorical accidents and production malfunctions which did not entail accidents, on the objects under control to the Promatomnadzor, approved by the Ministry of Emergency Situations of the Republic of Belarus of February 27, 1998. 1. This Provision is developed according to articles 16 and 20 of the Law of the Republic of Belarus of January 10, 2000 No. 363-Z "About industrial safety of hazardous production facilities" (The national register of legal acts of the Republic of Belarus, 2000, No. 8, 2/138) and establishes procedure for conducting technical investigation of the reasons of accidents and incidents on hazardous production facilities, obligatory for all organizations, the individual entrepreneurs performing activities in the field of industrial safety of hazardous production facilities in the territory of the Republic of Belarus and also republican state bodies, local administrative and executive bodies in the territory of which hazardous production facilities are located.
2. The approximate list of types of accidents on industries, work types, dangerous productions and objects is given in appendix 1.
3. On each fact of emergence of accident on hazardous production facility technical investigation of its reasons is made.
4. In case of accident the organization operating hazardous production facility:
4.1. without delay reports about it in form 1 according to appendix 2 to department on supervision of safe operation in the industry and nuclear power of the Ministry of Emergency Situations of the Republic of Belarus (further - the Promatomnadzor), to the higher organizations, associations on subordination subordinated to Council of Ministers of the Republic of Belarus, the ministries, other republican state bodies, local executive and administrative organs, and in case of the accidents which are followed by emissions, pourings of dangerous substances, explosions in addition reports in territorial authorities of the Ministry of Emergency Situations of the Republic of Belarus, the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus, the commission on emergency situations under Council of Ministers of the Republic of Belarus;
4.2. in case of group accidents and (or) accidents with heavy and death, resulted from accident, without delay reports about it also to other bodies and the organizations according to Item 41 of Rules of investigation and accounting of the labor accidents and occupational diseases approved by the resolution of Council of Ministers of the Republic of Belarus of January 15, 2004 No. 30 (The national register of legal acts of the Republic of Belarus, 2004, No. 8, 5/13691);
4.3. keeps invariable the place of accident prior to investigation, except as specified, when it is necessary to conduct works on accident liquidation, preserving life and human health;
4.4. performs actions for localization and mitigation of consequences of accidents on hazardous production facility;
4.5. takes measures for protection of the surrounding environment, life and health of workers in case of accident on hazardous production facility;
4.6. represents all information necessary for said commission for implementation of the powers to the commission on technical investigation of causes of accident.
5. The head of the organization operating hazardous production facility bears responsibility for implementation of the functions assigned by this Provision according to the legislation of the Republic of Belarus.
6. Control of observance of the procedure for technical investigation of the reasons of accidents established by this Provision, and also of timely accomplishment of actions for their elimination is performed by the higher organizations on the subordination, the ministries, other republican state bodies, associations subordinated to Council of Ministers of the Republic of Belarus according to their powers, the Promatomnadzor.
7. Technical investigation of causes of accident is made on each fact of its origin and is directed to establishment of circumstances and causes of accident, the extent of damage suffered, development of measures for elimination of its effects and actions for the prevention of similar accidents on this and other hazardous production facilities.
8. Technical investigation of causes of accident is made by the special commission (further - the commission on technical investigation of causes of accident) headed by the representative of the Promatomnadzor. The commissions are included representatives: local executive and administrative organ and (or) local government body in the territory of which the hazardous production facility is located; the organization operating hazardous production facility; higher on subordination of body or organization and other representatives according to the legislation of the Republic of Belarus.
The commission is created based on the order of the Promatomnadzor in coordination with the organizations which representatives are entered into structure of the commission.
9. According to article 16 of the Law of the Republic of Belarus the President of the Republic of Belarus can make the decision on creation of state commission on technical investigation of causes of accident "On industrial safety of hazardous production facilities" and to appoint the chairman of said commission.
