ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

About establishment of the extent of damage which is caused to water biological resources and which should be considered large

(as amended of the Order of the Government of the Russian Federation of 19.11.2019 No. 1472)

The government of the Russian Federation decides:

1. Determine that the extent of damage which is caused to water biological resources (further - bioresources) and which should be considered large is determined according to appendix by federal executive bodies, authorized to exercise control in the field of fishery and preserving water bioresources, in tons (for marine mammals - in terms of the heads) as difference between amount of actually got (caught) water bioresources and quota of the production (catch) of water bioresources specified in the permission to their production (catch) issued to the individual entrepreneur or the legal entity.

In case of production (catch) of types of the water bioresources which are not specified in permission to production (catch) of water bioresources (except for admissible prilov), the extent of damage which is caused to water biological resources and which should be considered large is estimated from all amount got (caught) over admissible prilov water bioresources.

Causing factual determination to water bioresources of damage in the amount of which should be considered large, is performed for the purpose of implementation of the Federal Law "About Fishery and Preserving Water Biological Resources" and is the basis for the forced termination of the right to production (catch) of the water bioresources carried to objects of fishery.

2. This resolution is not applied to the types of water bioresources included in the Red List of the Russian Federation.
