LAW OF THE REPUBLIC OF MOLDOVA

About control and prevention of tuberculosis

Based on Item r) parts (3) article 72 of the Constitution of the Republic of Moldova the Parliament adopts this organic law.

Chapter I. Basic provisions

Article 1. Sphere of regulation and legal basis

(1) This law establishes the legal basis of realization of state policy in the field of control and prevention of tuberculosis for the purpose of protection of health of citizens and ensuring sanitary and epidemiologic wellbeing of the population.

(2) the Legal basis of control and prevention of tuberculosis is constituted by the Constitution of the Republic of Moldova, this law, other regulations, and also international agreements, one of the parties of which is the Republic of Moldova.

(3) This law, other existing regulations cannot limit the rights of citizens to protection against tuberculosis and rendering antituberculous medical care.

(4) If international agreements, one of the parties of which is the Republic of Moldova, establish other regulations than containing in this law, regulations of international agreements are applied.

Article 2. Application of this law

(1) This law extends to citizens of the Republic of Moldova to whom antituberculous medical care, and on physical persons and legal entity which provide antituberculous medical care in the territory of the Republic of Moldova is provided.

(2) Foreign citizens and stateless persons use antituberculous medical care according to this law and other existing regulations.

Article 3. Basic concepts

For the purpose of this law the following basic concepts are used:

tuberculosis - the specific socially caused infectious disease with preferential damage of lungs caused by tubercular mikobakteriya (Koch's stick) which is characterized by aggravations, recurrence and periodic remission;

the TB patient - the patient with the clinical signs characteristic of tuberculosis confirmed with bacteriological and/or histologic and radiological researches;

active form of tuberculosis - tuberculosis which evolutionary nature is confirmed with clinical, laboratory and radiological trials;

contagious form of tuberculosis - active or chronic form of tuberculosis with allocations of tubercular mikobakteriya and/or with destruction of lungs;

prevention of tuberculosis - complex of the normative and medico-social measures directed to prevention of spread of tuberculosis;

the tuberculosis center - the location of the person or animal, the TB patient in whose zone infection of other persons to whom contacts is possible has close relations or infection of persons who are looking after animal, suffering from tuberculosis works with sick active form of tuberculosis, or;

antituberculous medical care - complex of the medical, sanitary and hygienic and anti-epidemic measures directed to identification, inspection and treatment, including obligatory and also on observation and recovery of the TB patient in stationary and out-patient conditions;

the specialized TB medical uchrezhdeniyamediko-sanitary agencies giving antituberculous care and performing measures for prevention of tuberculosis, and also departmental specialized TB facilities;

primary medical care - the medical care provided by the family doctor and his crew and which is primary link of medical care and leaving.

Chapter II. Powers of bodies of the central and local public authority in the field of control and prevention of tuberculosis

Article 4. Powers of the Government

Powers of the Government in the field of control and prevention of tuberculosis are directed to approval and control of national strategic medium-term and long-term programs, coordinating of all intersectoral actions in the field.

Article 5. Powers of the Ministry of Health

The Ministry of Health performs the following powers in the field of control and prevention of tuberculosis:

a) development and deployment of state policy in the field of control and prevention of tuberculosis;

b) development and promotion of regulations in the field of control and prevention of tuberculosis, development of rules, regulations, requirements and state standards in the field of control and prevention of tuberculosis;

c) determination of procedure for rendering antituberculous medical care to citizens in the territory of the Republic of Moldova, development and the organization of system of rendering antituberculous medical care;

d) implementation of monitoring of application of the current legislation in the field of control and prevention of tuberculosis by the subordinated to the ministry and departmental medical and sanitary organizations;

e) implementation of the state sanitary and epidemiologic control and organization of activities for the prevention and prevention of tuberculosis;

f) the organization and implementation of epidemiological monitoring in the field of control and prevention of tuberculosis, including by means of use of information system;

g) development and implementation of special national programs in the field of control and prevention of tuberculosis;

h) ensuring effective work of the medical and sanitary Items and organizations performing actions for control and prevention of tuberculosis;

i) provision of consultations and cooperation with the international and non-governmental organizations, other organizations operating in the field of control and prevention of tuberculosis;

j) ensuring the state control of acquisition, storage and transportation of antitubercular vaccines and immunobiological medicines for early diagnosis of tuberculosis, and also drugs for treatment of tuberculosis, ensuring quality control, efficiency and safety of these drugs;

k) the organization of the medical statistical recording in the field of control and prevention of tuberculosis;

l) implementation of other stipulated by the legislation powers in the field of control and prevention of tuberculosis.

Article 6. Powers of other central industry bodies of public management

The central industry bodies of public management perform the following main powers in the field of control and prevention of tuberculosis:

a) implementation of activities for control and prevention of tuberculosis in subordinated medical institutions, infrastructure of national system of defense, insulators of pre-trial detention and penal institutions;

b) ensuring priority financing of activities for control and prevention of tuberculosis in military units and penal institutions;

c) providing conditions of the conclusion and content in the insulators of pre-trial detention and penal institutions conforming to the standards approved by the law;

d) ensuring early diagnostics, the direction on treatment, sanitary prevention and consultation of the psychologist for the purpose of decrease in the illness rate among prisoners;
