Based on Art. 20 of the Law No. 121-XVI of May 4, 2007 on management of public property and its privatization (The official monitor of the Republic of Moldova, 2007, Art. No. 90-93, 401) DECIDES: the Government

1. Approve Regulations on the Register of public property it (is applied).

2. To public bodies represent to the Agency of public property once a year, till April 15, the report on the public property which is in their management on methods and results of its use, as of January 1 every year, according to the samples given in  appendices No. 8-14 to the specified provision.

3. To the agency of public property:

provide information processing from the submitted reports and perform the corresponding entries in the Register of public property according to the rules of its maintaining established in the above-stated provision;

provide to the Government till May 1 annually information on bodies of public management which did not submit at the scheduled time reports on the public property which is in their management;

represent to the Government till June 15 the year balance of public property as of January 1 every year.

4. Public bodies provide the relevant information according to the regulations established by the legislation in cases when information on public property and its movement is the state secret.

5. Determine that the state/municipal companies and commercial societies with public or public private equity, and also the states having public property in economic maintaining, represent to relevant organs of the central or local public authority the annual financial reports and other data necessary for creation of reports on public property, methods and results of its use.

6. Declare invalid the Order of the Government No. 1016 of October 1, 1998. "About approval of the Regulations on the Register of public property" (The official monitor of the Republic of Moldova, 1998, Art. No. 94-95, 988), with subsequent changes and amendments.

Regulations on the Register of public property

I. General provisions

1. The regulations on the Register of public property (further - the Provision) are developed according to the Law No. 71-XVI of March 22, 2007 on registers (The official monitor of the Republic of Moldova, 2007, Art. No. 70-73, 314) and other regulations.

2. This Provision establishes procedure for maintaining, storage and recovery of the Register of public property (further - the Register).

3. The agency of public property (further - the Agency) owing to the powers, stipulated by the legislation, performs functions of the holder of the Register of public property.

4. Data on book value of property of the state and municipal companies, public organizations, commercial societies with public and public private equity, and also the data on shares (shares in the authorized capital) which are in public property, on the state-owned property transferred to the economic jurisdiction to commercial societies, this about the subject of the agreement on public and private partnership and also data on real estate in public property of the state are entered in the Register (further - objects of accounting).

5. The register is subdivided into the following subregisters:

a) the subregister No. 1 - property of public organizations (appendix No. 1);

b) the subregister No. 2 - property of the state/municipal companies (appendix No. 2);

c) the subregister No. 3 - shares (share in the authorized capital) which are in public property (appendix No. 3);

d) the subregister No. 4 - the state-owned property transferred to the economic jurisdiction to commercial societies (appendix No. 4);

e) the subregister No. 5 - public and private partnership (appendix No. 5);

f) the subregister No. 6 - the public property delivered in trust management (appendix No. 6);

g) the subregister No. 7 - real public estate of the state (appendix No. 7).

6. Public bodies submit reports with the cover letter. Documents on the basis of which entries in the Register are made shall be signed and certified by seal of the body providing information. In cases when the provided information occupies several pages, they shall be sewed, and the reverse side of the last page - is signed and assured by seal of relevant organ. The reports submitted in an inappropriate way are considered as unpresented.

II. Maintaining Register

7. The register is kept in manual and electronic forms in state language. In case of distinction of records records from the Register which is kept in manual form are recognized true manual and electronic forms of the Register.

8. Registrars and person, authorized to exercise internal control over maintaining the Register, are appointed the order of the director of the Agency.

9. For the purpose of conducting complete and reliable accounting of data on public property the Register (subregister) is kept with respect for the principles established by the legislation.

10. Maintaining the Register in manual form is performed by means of entering of data into books of registration (further - books) which sheets proshnurovyvatsya and numbered. The number of sheets is specified on the last page and is certified by the authorized representative of the Agency exercising control over maintaining the Register with putting down of control signs: signs and seals. Replacement of sheets in books by withdrawal and gluing of new sheets is forbidden.
