The government of the Russian Federation and the Government of Ukraine which are hereinafter referred to as with Contracting Parties
considering the developed integration commercial ties of the Russian Federation and Ukraine, interdependence and complementarity of economies of two countries,
attaching importance to deepening of economic integration of the Russian Federation and Ukraine,
being guided by the Agreement between the Government of the Russian Federation and the Government of Ukraine on free trade of June 24, 1993,
aiming at creation of equal opportunities for business entities and to establishment of conditions of fair competition in mutual trade,
recognizing that free movement of goods and services requires implementation of mutually agreed measures,
confirming intentions of the Russian Federation and Ukraine to become Contracting Parties of the General Agreement on Tariffs and Trade (GATT), sharing the purposes and the principles of GATT and in view of the results of agreements and agreements reached within the Uruguayan round of multilateral trade negotiations
being convinced that creating favorable conditions for development and diversification of trade and deepening of commercial and economic cooperation on the basis of equality, mutual advantage and the commonly accepted rules of international law will promote harmonious development of the bilateral relations between the Russian Federation and Ukraine and, thus, to promote economic development, improvement of living conditions and employment of the population of two countries, performance improvement of work and financial stabilization,
confirming the commitment to the purposes and the principles of the Commonwealth of Independent States taking into account mutual desire to deepening of economic integration within free trade regime, including step-by-step creation of the Customs union,
agreed as follows:
Contracting parties for the purpose of implementation of further interaction in the field of foreign economic relations will develop measures for expansion of free trade for ensuring development of integration processes between the Russian Federation and Ukraine.
Contracting parties will provide practical interaction between the state bodies responsible for forming of offers on further realization of free trade regime between the Russian Federation and Ukraine.
For this purpose in 2-month time from the moment of the introduction of this agreement in force Contracting Parties form the mixed working group on preparation of the offers directed to the balanced approved reducing withdrawals from free trade regime between the Russian Federation and Ukraine (further hereinafter is referred to as - working group).
The working group will carry out the analysis and will prepare offers for the Governments of the Russian Federation and Ukraine on the following questions influencing mutual trade including:
1) adequacy and balance of withdrawals from free trade regime;
2) measures of tariff regulation of trade and way of their reducing, including the possible schedule of reducing the remaining restrictions;
3) measures of non-tariff regulation of trade and way of their reducing, including the possible schedule of reducing the remaining restrictions;
4) ensuring transit of the loads occurring from the territory of the countries of Contracting Parties and sent to the third countries and from the third countries according to the agreements existing between Contracting Parties.
1. From the moment of the signature of this agreement Contracting Parties will not introduce new quantitative restrictions in mutual trade, except as specified, of articles 3 and 10 of the Agreement between the Government of the Russian Federation provided by provisions and the Government of Ukraine about free trade of June 24, 1993.
2. The parties are recognized that step-by-step, and then and complete lifting of restrictions in mutual trade is caused by accomplishment of the coordinated works on:
- harmonization and unification of systems of tariff and non-tariff regulation of trade between both states according to the principles of GATT;
- to determination of trade policy in relation to the third countries.
After the introduction of this agreement in force Contracting Parties will determine the inventories falling directly or indirectly under withdrawals from free trade regime in separate protocols to this agreement.
Reducing each list of such goods by Contracting Parties will be performed in coordination according to general actions for liberalization of mutual trade.
Contracting parties recognize reasonable to develop the specific measures following from this agreement purposes, directed to regulation of trade to the relation to the third countries on the basis of the principles and regulations of GATT.
Implementation of Articles of this agreement will not interfere with accomplishment of obligations of the Contracting Parties fixed in the multilateral agreements signed by the State Parties of the CIS which participant is at least one of Contracting Parties, including the Contract on creation of Economic union, the Agreement on creation of the free trade area and the Agreement on re-export of goods and approval procedure for re-export, and also other international torgovoekonomichesky agreements.
This agreement becomes effective from the date of exchange of notifications on accomplishment by Contracting Parties of interstate procedures necessary for this purpose and will remain in force before the expiration of twelve months from date when one of Contracting Parties sends the written notice to other Contracting Party about intention to stop its action.
It is made in Kiev on February 8, 1995 in two authentic copies, everyone in the Russian and Ukrainian languages, and both texts are equally authoritative.
