About the state guarantees of the equal rights and equal opportunities for men and women

This Law establishes the state guarantees on provision of the equal rights and opportunities to persons of different floor in political, social, economic, cultural and other areas of activity of the person; it is designed to protect men and women from discrimination on the basis of floor; it is directed to approval of the progressive democratic relations between men and women.


Article 1. The basic concepts used in this Law

Gender the behavior of persons of different floor - acquired, socially set; social aspect of the relations between men and women which is shown in all spheres of life, including policy, economy, the right, ideology and culture, science and education.

Gender discrimination (direct, indirect) - any distinction, exception or preference which limits the rights and interests of persons on the basis of sex; it is directed to easing or deprivation of recognition, use or implementation of equality of men and women in political, economic, social, cultural, civil or any other areas of public life.

Gender policy - the state, public work directed to establishment of equality in relations between persons of different floor.

Gender statistics - the statistics reflecting the relevant provision of persons of different floor in all spheres of socio-political life and covering gender problems and the relations in society.

Gender examination - monitoring and the public and legal analysis of the national legal system, and also project evaluation of regulatory legal acts regarding respect in them for equal opportunities, the rights, obligations, responsibility, the ravnopartnersky relations and equality of result for women and men, non-admission of gender discrimination.

Gender representation - availability as a part of any organization of persons of different floor in the established proportion.

Gender equality - the equal legal status of women and men and equal opportunities for its realization allowing persons irrespective of floor, freely to use the capabilities for participation in political, economic, labor, social, public and cultural spheres of life.

Gender equality - equal rights, obligations and responsibility of persons of different floor to the law, except the attenuating circumstances established by the legislation of the Kyrgyz Republic.

Gender indicators are the indexes or measuring instruments using quantitative and qualitative indexes for summing genderno of the significant changes happening in society during the certain period of time.

The gender relations - nature of behavior and the address between persons of different floor in the course of communication or when implementing different types of joint activities.

The gender analysis - process of assessment of various impact made on women and men, the existing or offered programs, the legislation, the state political policy in all spheres of society and the state.

House work - the form of labor activity directed to family requirements satisfaction. House work is one of types of social and useful and productive work which lays the foundation of human and social capacity of the country.

Quotas - one of types of the temporary special measures which are expressed in the legalized level of representation of persons of both sexes at political institutes, in the sphere of employment relationships and other spheres which can be cancelled in process of achievement of the balanced representation of men and women in state bodies and local government bodies.

Integrated approach to gender issues - strategy by means of which interests and experience of women and men become the integral aspect in case of creation, accomplishment, monitoring and assessment of the legislation, policy and programs in all political, economic, labor, social and other spheres to eliminate inequality between men and women.

Indirect gender discrimination - discrimination without direct specifying on sex.

Violation of gender equality - active or passive behavior which is shown in the form of humiliation, contempt, and also restriction of the rights or rendering privileges in connection with sex of person.

Objects of gender equality - the public, political, economic and other social relations which are subject to legal regulation.

Direct gender discrimination - the discrimination which is directly specifying sex.

Equal opportunities - system of the means and conditions necessary for real achievement of gender equality.

Equality of result - the concept of equality according to which is recognized that for achievement of equal (identical) results by men and women it is necessary to show to them various relation because vital conditions of that and others are various.

The Ravnopartnersky relations - cooperation or joint participation in the state and public life on equal terms persons of different floor.

Sexual harassment - the actions of sexual nature expressed verbally or physically, degrading and offending person which is in labor, job, material, family and other dependency.

Special measures - the measures of organizational, legislative, institutional nature directed to support of persons of one of floors in the most discrimination sphere of activity. Special measures can be temporary.

Article 2. Purpose and tasks of this Law

The purpose of this Law is achievement of parity provision of women and men in all spheres of activity of society.

Tasks of this Law is creation of national mechanisms of providing for persons of different floor:

- equal rights, obligations and responsibility in political, social, economic, labor and other activity;

- equal opportunities;

- the ravnopartnersky relations in all spheres of activity;

- equalities in the family relations;

- equalities of result.

Article 3. Principles of this Law

This Law is based on the following principles:

- respect for rules of international law in the field of ensuring gender equality;

- democracies;

- legality;

- nondiscriminations;

- responsibility and the reporting of each department for realization of gender policy;

- assistance and participations of civil society in promotion of gender policy.

Article 4. The legislation of the Kyrgyz Republic in the field of the gender relations

The legislation of the Kyrgyz Republic in the field of the gender relations is based on the Constitution of the Kyrgyz Republic and on the international treaties and agreements which came in the procedure established by the law into force which participant is the Kyrgyz Republic, and consists of this Law, the laws adopted according to it and other regulatory legal acts of the Kyrgyz Republic.

This Law extends to citizens of the Kyrgyz Republic, foreign citizens and stateless persons, constantly or temporarily staying in the territory of the Kyrgyz Republic, legal entities and the state on behalf of state bodies and local government bodies.
