About approval of the Provision, the description and sample of the certificate on return to the Kyrgyz Republic

(as amended on 23-05-2018)

According to the Law of the Kyrgyz Republic "About external migration", for the purpose of rendering assistance to citizens of the Kyrgyz Republic on entry into the Kyrgyz Republic in case of loss of the documents proving their identity by them, the Government of the Kyrgyz Republic decides:

1. Approve enclosed:

- Regulations on the certificate on return to the Kyrgyz Republic;

- the description of the certificate on return to the Kyrgyz Republic;

- sample of the form of the certificate on return to the Kyrgyz Republic.

2. To the ministries, the state committees, administrative departments and other executive bodies of the Kyrgyz Republic to bring the regulatory legal acts into accord with this resolution.

3. To provide to the Ministry of Foreign Affairs of the Kyrgyz Republic informing foreign states on introduction of the certificate on return to the Kyrgyz Republic.

4. Publish this resolution in mass media.

5. To impose control over the implementation of this resolution on department of defense, law and order and emergency situations and department of external relations of Government office of the Kyrgyz Republic.

Regulations on the certificate on return to the Kyrgyz Republic

I. General provisions

1. This Provision determines procedure for registration and issue of the certificate on return to the Kyrgyz Republic in case of loss by citizens of the Kyrgyz Republic of the diplomatic passport, the service passport, the all-civil passport, the passport of the citizen of the Kyrgyz Republic (further - the passport) outside the Kyrgyz Republic.

2. The certificate on return to the Kyrgyz Republic is the temporary identity document of the citizen of the Kyrgyz Republic and providing it the right to return to the Kyrgyz Republic.

3. In case of loss by the citizen of the Kyrgyz Republic of the passport to him the certificate on the return to the Kyrgyz Republic (further - the certificate) approved by the Government of the Kyrgyz Republic is granted.

4. The form of the certificate is the document of the strict reporting.

II. Procedure for issue of the certificate

5. Issue of the certificate is performed by diplomatic representations and consular establishments of the Kyrgyz Republic according to the written application of citizens of the Kyrgyz Republic, for the term necessary for return to the Kyrgyz Republic, but not over 30 days. Certificate effective period on return to the Kyrgyz Republic of citizens of the Kyrgyz Republic, and also the faces transferred by judicial or law enforcement agencies of foreign state, which are subject to issue, extradition or readmission constitutes 90 days. In case of execution of certificates on return to the Kyrgyz Republic of citizens of the Kyrgyz Republic and the faces which are subject to issue, extradition or readmission, the employee of diplomatic representation or consular establishment of the Kyrgyz Republic in the column "Basis" of the form of the certificate puts down special stamp or the corresponding record by ink by hand, confirmatory/testimonial is made that this citizen of the Kyrgyz Republic is in process of issue, extradition or readmission.

In case of the address concerning issue of the certificate the applicant represents:

a) the statement of the established sample according to appendix to this Provision;

b) the document (the protocol, the reference, etc.) issued by competent authority of the state of stay, the confirmatory fact of the address of the applicant concerning loss of the passport. In case of impossibility of representation owing to various circumstances of the document (the reference, the coupon notification, the protocol, etc.), the applicant represents the detailed written explanation, with indication of all circumstances and the reasons of loss of the passport;

c) two photos of 3x4 in size;

d) the documents allowing to identify the identity of the applicant and to confirm nationality of the Kyrgyz Republic (the identity certificate of the citizen of the Kyrgyz Republic, the certificate of birth, the military ID, the identity certificate of the officer (ensign), the military ID of the reserve officer, the draft assigned certificate, the official ID with the photo) or the written applications certified by the consular official in accordance with the established procedure at least two citizens of the Kyrgyz Republic confirming the applicant's personality with application of copies of their passports.

6. By provision by the applicant of the documents specified in Item 5 of this provision, the certificate can be granted without additional check of the identity of the applicant.

7. When implementing the procedure of identification of the identity of the applicant the Ministry of Foreign Affairs of the Kyrgyz Republic, the diplomatic representation or consular establishment of the Kyrgyz Republic connected in the procedure established by the legislation of the Kyrgyz Republic to the automated Passport system of authorized state body of the Kyrgyz Republic in the sphere of registration of the population uses the data and data containing in this automated system. In case of impossibility of provision by the applicant of the documents specified in Item 5 of this provision, diplomatic representation or consular establishment of the Kyrgyz Republic in day of adoption of the statement for execution of the certificate for conducting check and identification of the identity of the applicant, sends the corresponding inquiry to authorized state body of the Kyrgyz Republic in the sphere of registration of the population or territorial subdivision of authorized state body of the Kyrgyz Republic in the sphere of registration of the population.

8. By results of check in the sphere of registration of the population or its territorial subdivisions within five working days from the moment of receipt of request send authorized state body of the Kyrgyz Republic any, not forbidden means of communication, necessary information to the diplomatic representation which sent inquiry or consular establishment of the Kyrgyz Republic, with reference to reference number of request.

9. The certificate can be granted by diplomatic representation or consular establishment only after receipt of all necessary information about the applicant excluding any doubts concerning his identity and belonging to nationality of the Kyrgyz Republic.
