About approval of Rules of realization by local executive bodies of housing built within the State program of housing construction in the Republic of Kazakhstan for 2008 - 2010

According to the State program of housing construction in the Republic of Kazakhstan for 2008 - 2010 approved by the Presidential decree of the Republic of Kazakhstan of August 20, 2007 No. 383, the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of realization by local executive bodies of housing built within the State program of housing construction in the Republic of Kazakhstan for 20082010 years.

2. To local executive bodies of areas, cities of Astana and Almaty:

1) to make realization of housing to citizens of the Republic of Kazakhstan according to these rules;

2) quarterly, no later than the 10th following the accounting period to provide information on realization of housing to the Ministry of the industry and trade of the Republic of Kazakhstan and the Ministry of Finance of the Republic of Kazakhstan.

3. To the Ministry of Justice of the Republic of Kazakhstan according to the legislation of the Republic of Kazakhstan to organize work on registration of the property rights to real estate.

4. This resolution becomes effective after ten calendar days after the first official publication.

Rules of realization by local executive bodies of housing built within the State program of housing construction in the Republic of Kazakhstan for 2008 - 2010

1. These rules of realization by local executive bodies of the housing built and (or) acquired at private builders within the State program of housing construction in the Republic of Kazakhstan for 2008 - 2010 (further - Rules) determine procedure for realization to citizens of the Republic of Kazakhstan of housing built within implementation of the State program of housing construction in the Republic of Kazakhstan for 2008 - 2010 approved by the Presidential decree of the Republic of Kazakhstan of August 20, 2007 No. 383, at the expense of the funds allocated from the republican budget on returnable basis including reuse by local executive bodies of areas, cities of Astana and Almaty of the budget credits allocated in 2006-2007 and also the affordable housing built and housing which is not realized within the State program of development of housing construction in the Republic of Kazakhstan for 2005-2007, except for on which agreements of kupliprodazha are not signed, but the decision of authorized body on realization of housing based on the decision of the Commission was made, or loan agreements are not signed (further - unrealized housing).

2. In these rules the following basic concepts are used:

1) the co-borrower - the spouse (spouse), close relatives of the borrower (the parents, children, adoptive parents adopted full and not full brothers and sisters, the grandfather, the grandmother, grandsons), and also the persons jointly obtaining loan and bearing responsibility, solidary with the borrower, for its return;

2) young family - family in which both spouses did not reach age of twenty nine years, or incomplete family in which children (child) are raised by one of parents who did not reach age of twenty nine years, including divorced, vdovy;

3) the loan agreement - the agreement signed between the creditor and the borrower on provision of loan;

4) the borrower - the applicant who signed the loan agreement with the creditor;

5) the creditor - "Housing Construction Savings Bank of Kazakhstan" joint-stock company;

6) State program - The state program of housing construction in the Republic of Kazakhstan for 2008 - 2010 approved by the Presidential decree of the Republic of Kazakhstan of August 20, 2007 No. 383;

7) the request - the petition from the citizen with the enclosed necessary documents for participation in the State program in authorized body with reflection of consent to receipt of data by authorized body from the legal inventory;

8) the applicant - the citizen of the Republic of Kazakhstan who submitted the application;

9) the housing commission - the commission created by the decision of local executive body for the consideration of questions of realization of housing built and (or) acquired at private builders at the expense of the funds allocated from the republican budget on returnable basis by local executive bodies of areas, cities of Astana and Almaty to participants of the State program and unrealized housing;

10) solvency assessment - the complex of actions held by the creditor for assessment of possibility of the borrower timely and completely to serve and settle expected loan on acquisition of the housing built and (or) acquired at private builders at the expense of the funds allocated from the republican budget on returnable basis by local executive bodies of areas, cities of Astana and Almaty and unrealized housing;

11) authorized body - local state body on housing-and-municipal questions;

12) the notification - the letter of the creditor in the established form sent to authorized body and confirming possibility of provision to the applicant of loan for the acquisition of housing built and (or) acquired at private builders at the expense of the funds allocated from the republican budget on returnable basis by local executive bodies of areas, cities of Astana and Almaty and unrealized housing.

3. The local executive body the decision creates the housing commission under the leadership of the first head (or replacement his faces) areas, the cities of Astana and Almaty (the cities, areas). The housing commission is created of representatives of local executive and representative bodies, public organizations, mass media.

The local executive body will organize work of the housing commission and authorized body, determines the locations of collection points for requests, provides their material equipment and carrying out explanatory work.

4. The authorized body at least in six months prior to commissioning of the first apartment house of annual amount of construction and (or) in the presence of unrealized housing informs in mass media on housing sales terms with indication of category of citizens, the number of housing, places of documents acceptance, start date and documents acceptance completion, and also in writing notifies the creditor.
