RESOLUTION OF THE PRESIDENT OF TURKMENISTAN

About enhancement of structure of state bodies

(as amended on on August 20, 2001)

For the purpose of further enhancement of structure of state bodies I decide:

1. Establish since July 1, 2000 the number of staff of employees of central offices of the ministries and departments (without personnel on protection and servicing of buildings) according to appendix.

2. Approve the enclosed Regulations on structure and the number of staff of employees of central offices of state bodies.

3. To the Ministry of Economics and finance of Turkmenistan to approve staff lists and salary fund of employees of central offices of the ministries and departments taking into account the changes following from this resolution.

Regulations on structure and number of staff of employees of central offices of state bodies

This Provision regulates conditions of forming of structure and determination of the number of staff of employees of central offices of state bodies - the Ministries, the state and national committees, organizations under the Cabinet of Ministers of Turkmenistan, state associations, corporations and concerns (the ministries and departments hereinafter are referred to as further).

I. Structure of central office of the ministry, department

1. The structure of central office of the ministry, department includes structural divisions - the leading management (department) conducting department, independent management (department), department of management (department), section (sector).

Structural divisions of central office of the ministry, department shall incorporate:

a) the leading management (department) consisting of functionally interconnected departments.

Creation of the leading management (department) of the simplified structure (without availability in its structure of departments) is possible in the ministries and departments which are cross-industry (interdepartmental) governing body;

b) the leading department consisting of functionally interconnected sections (sectors). In some cases the leading department can not have as a part of sections (sectors);

c) independent management (department) which can not incorporate sections (sectors);

d) section (sector) which is formed only as a part of department.

2. The specific structure of central office of the ministry, department is determined depending on functional orientation of its activities, and also from the limit of total number of workers set in legislative procedure taking into account drivers and personnel by protection and servicing of the building.

At the same time in the ministry, the department which is industry body of the public or economic board, the leading management (department) is created if in its structure there are functionally interconnected departments.

The leading management (department) of the simplified structure can be created in the ministry, the department which is cross-industry (interdepartmental) state body.

3. Positions of employees of central office of the ministry, department are determined according to the Single nomenclature of administrative and management personnel of the companies, organizations and organizations approved by National institute of the state statistics and information of Turkmenistan and the Ministry of Economics and finance of Turkmenistan on July 28, 1999.

4. Total number of employees of central office of the ministry, department is established by acts of the President of Turkmenistan.

The number of workers in structural divisions of central office of the ministry, department shall be at least:

in the leading management (department) incorporating departments - seven people;

in the leading management (department) without departments - five people;

in the leading department - four people;

in the department which is part of management (department), independent department - three people;

in section (sector) - three people.

In department, section (sector) with number of workers in number of three people the position of the assistant department head, the sector (section) is not provided.

5. In case of establishment of structure of central office of the ministry, department it is necessary to proceed from the following ratio of quantity of positions of separate employee categories:

a) positions of heads and deputy managers of structural divisions of managements (departments), departments, sections (sectors) - no more than 35 percent of the number of staff of employees of central office;

b) positions of economic advisers (consultants) - no more than 1 percent of the number of staff of employees of central office;

c) the position of the chief engineer (the economist, the power engineering specialist, the geologist, the mechanic) is entered if necessary in coordination with the Cabinet of Ministers of Turkmenistan.

The number of drivers is established according to the approved standard rates on limit of official cars.

The number of junior service personnel is established, proceeding from regulations of servicing or by quantity of workplaces according to the standard rates established by the Ministry of Economics and finance of Turkmenistan.

II. Work payment terms

6. Reference of the ministries and departments to groups on compensation and official pay rates of their heads are established according to acts of the President of Turkmenistan.

7. Compensation of employees of central office is performed on the basis of the official pay rates established by the staff list of the ministry, department according to the scheme of official pay rates approved by the Ministry of Economics and finance of Turkmenistan.

8. Staff lists are developed separately for the main structure and service personnel, including drivers, and approved with the Ministry of Economics and finance of Turkmenistan.

9. On the separate positions (which are not specified in the scheme of official pay rates) are established:

official pay rate of the chief engineer (the economist, the power engineering specialist, the geologist, the mechanic) - at the level of 80% of salary of the deputy manager of the ministry, department;

official pay rate of the chief accountant heading structural division and performing methodical and organizational management of accounting and the reporting at least in 5 subordinated organizations and constituting summary accounting records in centralized procedure - in the amount of salary of the head of department (department, the leading department), and in other cases - in the amount of salary of the chief of independent department;

official pay rate of the chief of household department, the personnel department performing methodical and organizational management of accounting and the reporting at least in 5 subordinated organizations in the amount of salary of the chief of independent department;

official pay rate of the chief of household department, the personnel department which is not performing management of subordinated organizations and also the chief of general department - in the amount of salary of the chief specialist.
