Procedure for the admission of the carriers having the corresponding licenses to accomplishment of the international airborne transportations of passengers and (or) loads

1. This Procedure is developed according to Item 3 of the order of the Government of the Russian Federation of June 23, 2007 N 397 "About licensing of transportations by air transport of passengers and transportations by air transport of loads, and also about enhancement of state regulation of activities of carriers in the field of airborne transportations" (The Russian Federation Code, 2007, N 27, the Art. 3284) and establishes the procedure of the admission of the carriers having the corresponding licenses to accomplishment of the international airborne transportations of passengers and (or) loads taking into account provisions of international treaties of the Russian Federation.

2. The Federal Air Transport Agency (Rosaviatsia) performs the admission of the carriers having acting the air operator certificate and licenses (yu) for transportations by air transport of passengers and (or) loads for a period of five years.

In case of the termination of effective period of the admission the carrier directs the application and documents specified in Items 6 and 7 of this Procedure to Rosaviatsia.

3. Rosaviatsia performs the admission:

a) in the presence of not used rights to implementation of international carriages of passengers and (or) loads according to provisions of international treaties of the Russian Federation;

b) in case of the rights to implementation of the international airborne transportations of passengers and (or) loads following the results of the conclusion and (or) change of international treaties of the Russian Federation or execution of temporary arrangements with the countries with which the Russian Federation has no international treaties in the field of air traffic.

4. Information on the rights specified in subitems "an" and "b" of Item 3 presents of the Procedure is published on the website of Rosaviatsia, and also in printing mass media, about the rights specified in the subitem "b" - no later than five working days from the date of emergence of the rights.

5. Rosaviatsia performs the admission:

to accomplishment of the international regular airborne transportations of passengers and (or) loads;

to accomplishment of the international irregular (charter) airborne transportations of passengers and (or) loads.

6. For the admission to accomplishment of regular international airborne transportations of passengers and (or) loads or modification of the admission according to the paragraph the fourth subitem 19.2 of this Procedure the carrier directs the application (the appendix N 1 to this Procedure) and the following documents to Rosaviatsia:

the development plan for air-line for at least six consecutive seasons of the schedule of the International Air Transport Association (IATA), including with indication of the frequency of flights in week on seasons, types of aircrafts (taking into account perspective of updating of the park of aircrafts);

the reference from tax authority on lack (availability) of debt on the taxes and fees established in the Russian Federation for the last complete accounting period.

7. For the admission to accomplishment of irregular (charter) international airborne transportations of passengers and (or) loads the carrier directs the application (the appendix N 1 to this Procedure) and the following documents to Rosaviatsia:

the list of freighters of aircrafts with whom the carrier signed the relevant agreements or has confirmation about intention to sign the relevant agreements;

letters on approval (carrying out approval) of accomplishment of transportations of the carriers appointed on behalf of the Russian Federation which are carrying out transportations on the declared air-lines in the cases provided by international treaties of the Russian Federation (in case of refusal in approval the appointed carriers shall provide written reasons for refusal);

the reference from tax authority on lack (availability) of debt on the taxes and fees established in the Russian Federation for the last complete accounting period.

8. Consideration of the application and the documents attached to it performs the structural division of Rosaviatsia responsible for the organization of licensing of transportations by air transport of passengers and transportations by air transport of loads (further - structural division).

9. Statements and documents attached to them for the admission to accomplishment of the international regular airborne transportations of passengers and (or) loads and the international irregular (charter) airborne transportations of passengers and (or) loads are represented by carriers to Rosaviatsia in the period of the first five working days of every month.

Consideration of the submitted applications and documents attached to them is performed by structural division to the 20th day of every month.

Rosaviatsia of the additional rights to implementation of the international airborne transportations of passengers and (or) loads having the right in case of origin following the results of the conclusion and (or) changes of international treaties of the Russian Federation or execution of temporary arrangements with the countries with which the Russian Federation has no international treaties in the field of air traffic to perform acceptance from carriers of statements and documents attached to them after the specified terms.
