About some questions of informing consumers of food staples and foodstuff

According to article 10 of the Law of the Republic of Belarus of June 29, 2003 "About quality and safety of food staples and foodstuff for life and health of the person" for the purpose of informing consumers on availability in food staples and foodstuff of genetically modified constituting (components) and nutritional supplements the Council of Ministers of the Republic of Belarus DECIDES:

1. Determine that:

1.1. legal entities and physical persons, including the individual entrepreneurs performing production and business volume of food staples and the foodstuff received with use of genetically modified components (components), nutritional supplements:

1.1.1. specify on each unit of consumer pack (the label, the counterlabel, label) or other data carrier of the data:

that food staples and foodstuff are genetically modified or contain in them genetically modified constituting (components);

about availability of nutritional supplements in food staples and foodstuff (in comparison (correlation) of this information with the quality requirements and safety of food staples and foodstuff established by regulating documents);

1.1.2. represent upon the demand of the bodies exercising the state control and supervision in the field of quality assurance and safety of food staples and foodstuff, and also consumers the documents certifying quality and safety of food staples and foodstuff with indication of information on content of genetically modified constituting (components) and availability of nutritional supplements (original certificates about state registration and (or) the certificate of conformity or their copies which are drawn up in accordance with the established procedure or the data on these documents specified in the accompanying documents confirming goods receipt);

1.2. in case of state registration and obligatory certification of food staples and foodstuff control of availability in them is exercised genetically modified constituting (components) and nutritional supplements;

1.3. production and business volume of the baby food made with use of genetically modified constituting (components), is forbidden;

1.4. the business volume of food staples and the foodstuff received with use of genetically modified components (components) and nutritional supplements in the absence of the data and documents provided in subitem 1.1 of this Item is not allowed;

1.5. certificates on state registration and certificates of conformity issued on food staples and foodstuff before entry into force of this resolution are considered valid before the expiration of their action;

1.6. the information about the legal entities and individual entrepreneurs performing production and business volume of food staples and the foodstuff, except for retail trade (further - producers and suppliers) which did not fulfill requirements of this Item is subject to inclusion in the register of the unfair producers and suppliers making and realizing the food staples and foodstuff which are genetically modified or containing genetically modified constituting (components) with violation of the requirements to informing consumers established by the legislation (daleereestr) which conducting performs the Ministry of anti-monopoly regulation and trade.

2. To the Ministry of Health and State committee on standardization:

2.1. till July 1, 2005 to develop and approve the list of food staples and the foodstuff which are subject to control of availability of genetically modified constituting (components);

2.2. provide within the competence control and supervision of reliability of data on availability of genetically modified constituting (components) and the nutritional supplements represented by legal entities and physical persons including the individual entrepreneurs performing production and business volume of food staples and foodstuff.

3. To the state committee on standardization:

3.1. till September 15, 2005 to carry out accreditation of laboratories on carrying out testing of food staples and foodstuff for determination of availability of genetically modified constituting (components) and to constitute the list of these laboratories;
