About approval of Rules of registration and accounting of chemical products

For the purpose of implementation of the Law of the Republic of Kazakhstan of July 21, 2007 "About safety of chemical products" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of registration and accounting of chemical products.

2. This resolution becomes effective after ten calendar days after the first official publication.

Rules of registration and accounting of chemical products

1. General provisions

1. These rules of registration and accounting of chemical products (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 21, 2007 "About safety of chemical products" (further - the Law).

2. Rules determine order of registration and accounting of chemical products, except for its separate types, order of registration and which accounting affirms the authorized body performing state regulation in the field of safety of chemical products according to industry orientation.

3. Action of these rules does not extend to pesticides (agricultural chemicals) registered in accordance with the established procedure by the relevant authorized body in the field of development of agro-industrial complex.

4. The chemical products which are not registered according to requirements of these rules except exhibition or the prototypes which are not intended for realization and use are not allowed to the address in the territory of the Republic of Kazakhstan.

5. In these rules the basic concepts used in the Law and also the following concepts are applied:

"the register - the list of chemical products which contains necessary data on its registration and is kept by authorized body in the field of the industry and industrial and innovative development (further - authorized body);

registration of chemical products - entering by authorized body of data on chemical products into the register by results of consideration of requisitioning instruments and issue of the registration certificate;

the registration certificate - the document issued by authorized body on chemical products for the purpose of confirmation of its registration and entering into the register.

2. Order of registration and accounting of chemical products

6. The basis for registration of chemical products is its compliance to requirements of the legislation of the Republic of Kazakhstan in the field of safety of chemical products.

7. Process of registration and accounting of chemical products include:

documents acceptance, represented by the applicant (the producer, the supplier, the importer) for registration of chemical products;

consideration of documents and decision making about registration of chemical products;

registration of chemical products.

8. For registration and accounting of chemical products the applicant (the producer, the supplier, the importer) submits the following documents to authorized body:

registration application of chemical products;

the material safety data sheet of chemical products which contents shall conform to requirements of the Law.

9. The authorized body within five working days from the date of, the receipt of the statement following behind day, considers documents and makes the decision on registration of chemical products or issue of motivated refusal.

In case of refusal the authorized body returns all documents submitted by the applicant (the producer, the supplier, the importer) and notifies him in writing with indication of causes of failure.

10. The basis for refusal in registration of chemical products are:

discrepancy of chemical products to requirements of safety and security legislation of chemical products;

submission of incomplete information in the material safety data sheet of chemical products;

submission of false information on chemical products in the material safety data sheet of chemical products.

11. The decision on refusal in registration of chemical products can be appealed by the applicant (the producer, the supplier, the importer) according to the current legislation of the Republic of Kazakhstan.

12. In case of elimination of notes of authorized body the applicant (the producer, the supplier, the importer) repeatedly addresses to authorized body according to the procedure, established by these rules.

13. Entering of data on chemical products into the register is the final stage of registration and accounting of chemical products and is followed by issue of the registration certificate of chemical products or motivated refusal.

14. Effective period of the registration certificate of chemical products five years.

15. In case of loss, spoil of the original certificate the applicant (the producer, the supplier, the importer) shall inform on registration for chemical products timely authorized body and submit the application for issue of the duplicate of the registration certificate.

The duplicate of the registration certificate is issued by authorized body within five working days from the date of receipt of the statement.

16. The re-registration of chemical products is performed in the following cases:

changes of the name, location or reorganization of the applicant (producer, supplier, importer);

changes of the name, form of release and structure of chemical products, scope and recommendations about its use, modification of the specifications and technical documentation on chemical products, change of requirements to safety of chemical products;

expirations of the registration certificate of chemical products.

17. Within five working days from the moment of change of the name, the location or reorganization the applicant (the producer, the supplier, the importer) submits the application for re-registration to authorized body with appendix of the supporting document and original certificate about registration of chemical products.

At the same time the re-registration of chemical products is carried out within ten working days from the date of receipt of the statement by entering of corresponding changes into the register and issues of the new registration certificate.
