Memorandum of creation of Interstate Coordination Council of the Kyrgyz Republic and Republic of Tajikistan and Council of Foreign Ministers of the Kyrgyz Republic and Republic of Tajikistan

Kyrgyz Republic and Republic of Tajikistan,

based on deep traditions of friendship and neighborliness, the brotherly relations between the people of two states,

being guided by the Agreement on bases of the interstate relations between the Kyrgyz Republic and the Republic of Tajikistan of July 12, 1996 and the Contract between the Kyrgyz Republic and the Republic of Tajikistan about good-neighbourhood and partnership of May 26, 2004,

supporting further deepening and expansion of the Kyrgyz-Tajik cooperation with the purpose of effective solution of priority questions and conclusion of the bilateral relations to qualitatively new level,

for the purpose of strengthening of bilateral interaction in political, economic, humanitarian and other fields of mutually beneficial cooperation,

being interested in accomplishment of the reached agreements and bilateral international treaties,

agreed as follows:

- found Interstate Coordination Council of the Kyrgyz Republic and the Republic of Tajikistan and Council of Foreign Ministers of the Kyrgyz Republic and the Republic of Tajikistan;

- approve Regulations on Interstate Coordination Council of the Kyrgyz Republic and the Republic of Tajikistan (Appendix No. 1) and Regulations on Council of Foreign Ministers of the Kyrgyz Republic and the Republic of Tajikistan (Appendix No. 2).

Regulations on Interstate Coordination Council of the Kyrgyz Republic and Republic of Tajikistan

1. According to the Memorandum of creation of Interstate Coordination Council of the Kyrgyz Republic and the Republic of Tajikistan and Council of Foreign Ministers of the Kyrgyz Republic and the Republic of Tajikistan the Kyrgyz Republic and the Republic of Tajikistan (further - the Parties) establish Interstate Coordination Council (further the ISS).

2. The ISS in the activities is guided by international treaties which participants are both Parties, the decisions and this Provision.

3. The ISS is headed by heads of states.

4. Heads of governments of the Parties are part of the ISS.

5. Members of the governments of the states of the Parties, and also the invited persons can participate in meetings of the ISS (under approval).

6. The ISS as required can create working groups on permanent or temporary basis.

7. The chairman of the ISS (further - the Chairman) is the head of state in the territory of whom there takes place another meeting if heads of states do not make other decision.

8. The ISS holds the meetings at least once a year serially in the territory of each of the Parties.

9. At the request of heads of states of the Parties meetings of the ISS can be held under the chairmanship of heads of governments of the Parties.

10. For the solution of urgent questions at the initiative of the either party emergency meetings of the ISS can be convened.

11. The ISS performs the following functions:

- considers the most important, matters of principle of development of the relations between the Kyrgyz Republic and the Republic of Tajikistan;

- determines strategy, the main directions and perspectives of development of the relations and makes the decisions directed to implementation of the reached agreements;

- determines single policy on ensuring mutual safety in fight against the international terrorism, extremism, organized crime, drug trafficking, illegal migration and other challenges and threats of homeland security of the Parties;

- determines line item by the main regional and global international problems and questions which are of mutual interest.

12. Decisions of the ISS are made on the basis of consensus.

13. Financing of activities of the ISS is performed at the expense of each state independently, within the means provided in the government budget for the corresponding year.

14. The parties independently incur the expenses connected with participation of the delegations in ISS meetings.

15. The host state creates necessary organizational, information, material conditions for holding meeting of the ISS.

16. Coordination of activities of the ISS is assigned to Council of Foreign Ministers (further - SMID).

17. The decisions and documents made by the ISS are constituted in duplicate.

18. Working language of the ISS is Russian.

Regulations on Council of Foreign Ministers of the Kyrgyz Republic and Republic of Tajikistan

1. According to the Memorandum of creation of Interstate Coordination Council of the Kyrgyz Republic and the Republic of Tajikistan and Council of Foreign Ministers of the Kyrgyz Republic and the Republic of Tajikistan and Item 16 of the Regulations on Interstate Coordination Council of the Kyrgyz Republic and the Republic of Tajikistan (further - the ISS) the Kyrgyz Republic and the Republic of Tajikistan (daleestorona) establish the Council of Foreign Ministers of the Kyrgyz Republic and the Republic of Tajikistan (further - SMID) coordinating activities of the ISS.

2. SMID in the activities is guided by international treaties which participants are the Kyrgyz Republic and the Republic of Tajikistan, solutions of the ISS, the decisions and this Provision.

3. SMID is headed by Ministers of Foreign Affairs of the Parties.

4. At the request of Ministers of Foreign Affairs of the Parties meetings of SMID can be held under the chairmanship of deputy ministers of foreign affairs of the Parties.

5. Meetings of SMID are held prior to ISS meeting serially in the territories of each of the Parties which terms of carrying out are coordinated through diplomatic channels.

6. In case of need at the initiative of the either party emergency meetings of SMID can be convened.

7. SMID performs the following tasks and functions:

- study of questions of the agenda of meetings of the ISS;

- determination, as required, according to the agenda of meetings of the ISS, the list of the invited persons for participation in its meetings;

- preparation of drafts of decisions and other documents ISS;

- approval of terms of holding meetings of the ISS;

- preparation of information and analytical, reference and other materials for the ISS;

- control of implementation of solutions of the ISS;

- analysis of condition and tendencies of development of the Kyrgyz-Tajik relations;

- consideration of topical and important issues of bilateral cooperation;
