Agreement on bases of the interstate relations between the Kyrgyz Republic and Republic of Tajikistan

The Kyrgyz Republic and the Republic of Tajikistan, the "High contracting parties" which further are referred to as,

based on the Declaration on the state independence of the Republic Kyrgyzstan of August 31, 1991 and on the Declaration on the state sovereignty of the Republic of Tajikistan of September 9, 1991

aiming to build democratic, secular, constitutional states,

wishing to strengthen and develop long-term commercial and cultural ties, to strengthen friendship and the mutually beneficial cooperation which is equitable to national interests of the people of both states, cause of peace and safety

intending to develop the interstate relations on the basis of the principles of sovereign equality, non-interference to internal affairs, settlements of controversial problems conciliatory means, refusal of use of force or threat of force, and also other conventional principles and rules of international law,

being guided by the aspiration to strengthen the contractual legal basis of relations of the sovereign states,

confirming the commitment to the purposes and the principles of Articles of organization of the United Nations, the Helsinki Final act, the Parisian Charter for new Europe, documents of Organization for Security and Cooperation in Europe and the Commonwealth of Independent States,

obyazuyas to respect the international standards about human rights,

agreed as follows:

Article 1

High contracting parties recognize each other as the sovereign states and shall abstain from actions which can cause damage to their state sovereignty.

The relations between High contracting parties are under construction on the basis of the principles of sovereign equality and respect, the rights inherent in sovereignty, nonuse of force or threat of force, including economic and different ways of pressure, territorial integrity and inviolability of borders, peaceful settlement of disputes, non-interference to internal affairs, respect of human rights and fundamental freedoms, equality and the right of the people to dispose of the destiny, fair accomplishment of obligations, mutually beneficial cooperation and other universally recognized norms of international law.

Article 2

High contracting parties guarantee to the citizens, irrespective of their national or other distinctions, the equal rights and freedoms.

Questions of acquisition of nationality of one of High contracting parties by persons living in the territory of other High contracting party will be settled by the relevant agreements on the basis of the legislation of High contracting parties on nationality.

Article 3

Each of High contracting parties guarantees to the citizens of other High contracting party living in its territory irrespective of their national identity, religion or other distinctions, the civil, political, social, economic and cultural laws and freedoms in compliance, with the universally international standards about human rights.

Each of High contracting parties protects the rights of the citizens living in the territory of other High contracting party, gives them full assistance and support according to the legislation of High contracting parties and rules of international law.

Article 4

The Kyrgyz Republic and the Republic of Tajikistan show care of satisfaction of language and spiritual needs according to the Tajiks living in the territory of Kyrgyzstan and the Kyrgyz living in the territory of Tajikistan, High contracting parties within current laws will cooperate in satisfaction of these requirements.

High contracting parties promote expression, preserving and development of ethnic, cultural, language and religious identity of ethnic minorities and the developed unique ethnocultural regions.

Article 5

High contracting parties are recognized and respect territorial integrity of the Kyrgyz Republic and the Republic of Tajikistan.

Article 6

High contracting parties, aiming at further strengthening of international peace, recognize need of cooperation of both states in the field of defense and safety on the basis of Acts of independence and sovereignty of High contracting parties and according to the Charter of the UN.

Article 7

High contracting parties will develop equal and mutually beneficial cooperation in the field of policy, economy, culture, health care, ecology, science, the equipment, trade and in other areas, to promote broad information exchange, honesty and to strictly observe cross liabilities.
