About approval of the Concept of homeland security of the Republic of Moldova

The Parliament adopts this organic law.

Art. 1. - Approve the Concept of homeland security of the Republic of Moldova stated in annex.

Art. 2. - Declare invalid the Resolution of Parliament on approval of the Concept of homeland security of the Republic of Moldova and creation of Coordination council on project development of the legal and other regulations regulating construction, preparation and use of Armed forces, N 445-XIII of May 5, 1995 (The official monitor of the Republic of Moldova, 1995, N 35, the Art. 399).

CONCEPT OF THE HOMELAND SECURITY OF THE REPUBLIC OF MOLDOVA

The concept of homeland security of the Republic Moldovadokument, reflecting overall assessment of the circle of safety in national and international levels in which the Republic of Moldova is effective. It determines the purpose and the main directions of homeland security, and also the general values and the principles protected by the Moldavian state and society.

The concept of homeland security of the Republic of Moldova represents system of the ideas reflecting priorities of the state in the field of homeland security.

1. Principles, general values, purposes, main directions of homeland security. Threats, risks and weak points concerning homeland security of the Republic of Moldova

1.1. Status of permanent neutrality

The Republic of Moldova - the sovereign and independent, single and indivisible state, its territory is inaliennable. According to article 11 of the Constitution the Republic of Moldova proclaims the permanent neutrality which implies that our country is not member of military blocks and does not allow placement in the territory of foreign troops or arms of other states and military blocks.

The status of permanent neutrality is the basic principle and the base of the concept of homeland security. Therefore, all actions performed by system of homeland security of the Republic of Moldova for the purpose of ensuring national security are based on this principle.

In this sense the Republic of Moldova makes efforts for ensuring compliance with the permanent neutrality by subjects of international law.

1.2. Purposes of homeland security, main directions of ensuring national security

Homeland security represents fundamental condition of existence of the people of the Republic of Moldova and the Moldavian state and is one of the country purposes. The purposes of homeland security of the Republic of Moldova are providing and protection of independence, sovereignty, territorial integrity, constitutional order, democratic development and internal security, and also strengthening of statehood of the Republic of Moldova. Specific place in this sense is held by protection and promotion of national values, interests and the purposes. Homeland security represents not only safety of the state, but also safety of society and citizens of the Republic of Moldova both in the territory of the Republic of Moldova, and beyond its limits.

Homeland security of the Republic of Moldova is implemented by means of the adequate political, economic, diplomatic, social, legal, educational, administrative and military measures, intelligence and counterintelligence activities, and also by means of effective overcoming crises according to the current legislation and provisions of international law.

The way of integration of the Republic of Moldova to the European Union, maintenance of the good bilateral and regional relations and participation in multilateral cooperation are the factors promoting protection of interests of the Republic of Moldova and goal achievement of homeland security.

Based on the national interests, and also on the obligations following from process of the European integration, the Republic of Moldova is guided in the policy of homeland security by the following installations:

- ensuring compliance with the status of permanent neutrality;

- recovery of territorial integrity of the state, elimination of foreign military presence, strengthening of independence and sovereignty of the state;

- maintenance of high dynamics of process of the European integration;

- ensuring democratic development of society and strengthening of its internal security;

- the progressing economic and social development of the country by means of acceleration of political, economic and institutional reforms, first of all those which allow to reach compliance to criteria of the accession to the European Union;

- development and the most complete use of human potential - the main resource of the country, as much as possible effective protection of interests and the rights of the citizens within the country and beyond its limits;

- strengthening of economic, social, energy and ecological aspects of safety.

For goal achievement of homeland security the Republic of Moldova will provide implementation of the foreign policy, security policy and defense, will strengthen constitutional order, public safety and safety of the spheres, vital for the state, in coordination with other programs and measures at the national level. Process of assessment and the analysis of the threats and risks influencing homeland security is the essential element in activities of bodies of the public power and competent organizations determining state policy in the field of homeland security. At the same time it creates necessary conditions for short-term planning by the executive authority of the coordinated actions taken by government institutes in the respective areas.

1.3. Threats of homeland security

1.3.1. Dnestr conflict

Existence of the separatist mode enters disparate into the single legal system of the Republic of Moldova, causing impossibility of provision of legal aid to citizens of the Republic of Moldova in settlements of left bank of Dniester (Transnistria), endangering the international legal cooperation on this site. Efforts on the problem resolution of provision of legal aid to citizens of the Republic of Moldova in settlements of left bank of Dniester (Transnistria) in the conditions of guaranteeing the basic rights and freedoms established by the international and European legal mechanisms which part is the Republic of Moldova will be increased. Ways of permission of the Dnestr conflict will be based on the Constitution of the Republic of Moldova.

1.3.2. Risks of emergence of interethnic tension

Taking into account that the Republic of Moldova is the multiethnic and multinational state, the threat of emergence of elements of chauvinism, nationalism and separatism remains. In spite of the fact that the legislation of our country in this area is rather progressive and now these elements are not strongly expressed, in promotion of domestic and foreign policy interests of all ethnic groups in the territory of the country will be considered.

1.3.3. Threat of the international terrorism

Against the background of decrease in military threats of the international security not conventional threats, in particular threats of globalization of phenomenon of the international terrorism and danger of distribution of chemical, biological, radiation and nuclear weapon, including acquisition by its non-state actors grow.
